Dealing with copycats can be super stressful. It's definitely a jarring experience to see someone rip off your small candle business but I hope this video helps give you the tips to deal with forms of copying and trademark infringement.

This is precisely why I am registering my trademark before I even launch. The LLC is already good to go, now it's just getting that accomplished today and moving on from there. I am very proud to say that I do the graphic designs myself and will only take references of real life objects to use in my artwork, but that's it, because I mainly don't want to spoil the creative mind and just let it flow. Your videos have been a huge help. I am so grateful for your information and cannot wait to place my own footprint/ nice out there.. it's a bit different, but I hope people will like it as much as I do. With all things considered, it does concern me too and I hope you don't mind, but I took a screenshot of your response to the people who were infringing on your mark, as so I could word it in my own way if I ever need to approach someone in this manner. I really hate confrontation, drama, etc. as well and feel that your information here is well placed. Thank you so much! Side note: I am keeping in mind the copy and paste person, generally won't stay with the business model for long, because there is rarely, if ever, any passion with it. Like comparing a teacup candle, to a lifelong 50oz candle. I think the originals last longer for that reason.

hi ishani, very interesting video, i feel your frustration, as i am setting up my own candle company i have had countless ideas and when i search them up i found that they already have been done which is how i came across you, , i have had ideas for years and i get beat to it, last year i got certified as a meditation coach and immediatly thought of doing a candle collection to compliment the sessions but of course i cannot do that now, im stil searching individual ideas , its hard and there is no way i would want to upset anyone even if unintentional , well done on your products they are amaizing x

Hi Anna, Thank you for sharing. The thing is, it's ok if the idea has been done, but make it your own. Labels, colours, branding and description. I think there's no problem in doing a meditation range so long as you are not copying someone identically if that makes sense. What I am referring to is people outright copying concept after concept and using words from my website. Make a mood board of all the brands you like and circle what it is you like about them and create your own concept :) Thank you for your kind words. Good luck with your business!xx

I'm confused. That second example you talk about, are they not trademark infringing and copyright infringing on your brand? Is that not something you can legally go after them for to remove the collection you said you wished they had taken down but didn't? Just trying to clarify here how trademark and copyright infringement works, because if we can't legally get someone to remove those infringed upon things then what good is it? Thanks!

So unfortunately, unless you trademark an illustration it’s really hard to enforce. I mentioned in the video, the concept was similar but the moon and sun with the face weren’t exactly the same (not as good imo 😂) but overall trying to fight it legally would have cost money which would I would have to reallocate from my business which wasn’t worth it as the brand is smaller and doesn’t have as much reach. So I weighed up the pros and cons. I think it really depends on each individual and their position.

I know! It's the worst, and to be honest made me question if I brought it on myself because I make youtube videos which is partly why i stopped too but we can't let a few people stop us from doing what we want to do. If it happens just know, that if you continue to innovate and be the best you can, they'll not be able to compete. 😊
