That's why I'm not rushing to mail all the applications too quickly even though I already have my marriage certificate. I thought I had to submit documents before my wife's J1 visa expires but I learned that I can still submit everything if she overstays her visa. So now I'm building a strong portfolio of bona fide marriage evidence to support my petition and feel that will take a few months having to show both of our matching names and address on license/passports, converting banks to joint accounts, and our domestic traveling with family/friends to have as more solid proof.

It’s so frustrating to wait for so many years, but I agree it’s worth to be more prepared. The Evidence of Financial Report requirements differ from INSIDE the US (Adjustment of Status) vs NVC to foreign Consulate. Yes, if Inside US they only care about last couple yrs tax returns (and will usually avg them.) If a Native country consulate however, the tend to care more about current Income (but you still need to provide tax returns. TIP: BE SURE to check the CURRENT YEAR 125% Poverty Level and BE SURE to be a min of 135%. If too close to 125%, they will assume you manipulated the numbers.

We been legal residents for a year now. We have a son that is attending college here in the US for the past year, and we would like to know how could we help him to become a resident himself? He is 23 years old and unmarried. What are the forms that we need to fill out? We are both retired and our only income comes from our home country. I overstayed my J1 visa. I got the J1 waiver from the DOS. I heard I can file for green card now. But, should I provide the USCIS of the reason why I overstayed? With what? Evidence?

I am really having difficulty understanding income requirements 🤔 if someone is making around 20k a year, how the heck that one can sponsor anyone else? Isn’t the amount of taxes one paid is a decisive factor?
My income for last 3 years is not enough but this year I have enough to cover the income for bring my mom I’m aready sent the last 3 tax return but they ask about join sponsor or house hold
If you don't file taxes you need to get a sponsor somebody that makes money that is willing to say that if your mother ever ask for financial aid from the government they will be the ones providing it for her not the government.
Hi @Kseniya , thank you with your guidance I file form I-130 and they are approved but now NVC have require Affidavit of support, my income is legit but I have just been in US for 4 months and I do not have the tax returns for this year, what can I provide instead of tax returns, I just have my pay stubs.

Hi Kseniya, I'm really stressed now! My wife and I just responded to an RFE regarding i864. I never submitted my W2s to support my 2022 return, so we figured the rfe was for this. I've submitted 6 months worth of paystubs making my current pay rate which is well above requirements but all my returns for 3 years was part time work during college... will this be rejected?
We're going through the consulate in England for my wifes case. We were told we can do the i-864 right after submitting the i-130 which we did. Can you please answer if this is okay? I did all my application with my maiden name, I am about to go to my biometrics today. Does anybody know if I can go in there and give my new name (my husbands) of did I have to do that since the beginning. I havent been able to change it yet because I don't have a valid ID. Hi, thank you for response me. So is there any problem when you resubmission without green sheet (rejection notice) and uscis said you should add that green sheet when you resubmission? I am same situation and want to resubmit before the rejection notice delivery because I have no time before my old EAD expires. One more question, when resubmit, how long does it take for you to receive EAD card? Thank you so much.
@@okita273 it appears to be fine. I resubmitted before I get the rejection notice, so I did not have the green sheet by that time. It might have helped that I resubmitted within 1 day of my initial application!

Is it possible to use the Petition I-130 for Parent? The goal is for Mom and my daughter to travel freely on occation for visits with me. Hello, I sent my I-130 online two months ago and I was taking my time to fill the i-485 and collect all the evidence, but a coworker told me that I should have sent everything together and my case will probably be denied later on. I’m freaking out! And rushing to finish my I-485. So is it ok to send I-485 months after I-130?

One question: if sponsor made $10k AGI in 2019, $30k AGI 2020 and $$40k AGI in 2021, is it enough to fulfill requirements? (Even though 2019 AIG wasn't above poverty line)?
