Hello, so my wife and I got married January of this year. Proxy marriage through the state of Utah. I am an American citizen and she is Nepali but she works in London. We did our consummation In February 2024. We met for 10 days in London and have many pictures, receipts, plane tickets, and text messages. If your spouse lives abroad it is not require to him to sign the form i-130A (Read indication at the top of the from i-130A). So, he can fill out i-130A and DATE it on computer and send you the PDF file. But since you are in the USA, and you fill out the i-130, you must SIGN and DATE that form (i-130).

Hi @Kseniya, if an individual (beneficiary) is serving two years home residency requirement as a part of J1 exchange visitor visa in their home country, can the petitioner (for instance spouse), who is a US citizen submit the form I-130 (petition for Alien Relative) right away or have to wait two years before filing? Please let me know sooner as I just want to make sure before filing in order not to lose the filing fees due to rejection or denial. Thank you.
You can submit the I-130 as soon as the two of you are legally relatives of each other. The prime example of this is once someone has become your spouse, they become your family by-law. There is no delay or wait time in submitting the I-130 other than if the two of you are NOT relatives legally speaking (e.g. they are your romantic partner but not spouse yet). There are no restrictions to the I-130 because someone is on a J1 visa or any other type of visa (e.g. F1). There can be red flags if someone is the beneficiary within 90 days of getting their first visa (F1, J1, etc).

I am a Russian citizen and currently, Moscow has paused all visa services. Can I put another country (for example Georgia) if we don't have any ties to that country? Thank you in advance!

Hello! I have a question if you, or anyone else reading this could help me out. My husband and I have already gotten all the forms in and the USCIS has requested evidence of a bona fide marriage. We got our taxes done together, got both of our names on a bank statement, and 2 affidavits from close friends. We are trying to get health insurance together but haven't been able to yet, and the deadline is coming in a few weeks. My question is, do you think that the evidence we were able to get will be enough? And, is there any other type of insurance we would be able to get together that is relatively inexpensive (like maybe car rental insurance, etc.?--- something quick.) We are also unable to add my name onto any bills, as we're still a young couple and live with my husband's parents. Any help or suggestions will be great, thank you so much!

You need to prove that you can support him until he becomes a US Citizen and you need to prove that your income is 125% over the poverty guidelines depending on your household size. If it’s just you and him (household size:2) then your income should be around $23k/year.
