I contacted the police department and lodged a complaint. This was not just a detainment. It was an ARREST according to SCOTUS. Any time law enforcement puts you in a squad car and transports you somewhere, it is a defacto arrest.

Once you're Arrested & Transported the police department is TOTALLY responsible for well being of your Bodys' Safety AND your Properties' Safety. They owe this guy Property Damages. Start with filing complaints(they usually find no fault with themselves), then see if you can at least talk to a civil rights attorney for a consultation. Just my suggestions
Anybody who audits is a hero in my books. Every auditor will get arrested. Practice these lines ahead of time outloud and be comfortable saying them: 1. Am I being detained? 2. I do not waive my 1st, 4th, and 5th amendment rights 3. I am not resisting. Say each multiple times at the appropriate time. Take care. Have a security plan. Let someone know your plans. Do not film on your primary phone. Phones and cameras are regularly seized and held for no reason other than to hassle the auditor. Any equipment seized by the popo may be infected with malware and tracking software. Back up your videos off site. We live and learn. Have a lawyer lined up. Watch lots of other experienced auditors.

@@timothymoore596 I would first check local lawyers, also they may have a program in your area that helps people with cases and should do pro bono if not they may charge a small fee to get it started. I would do some google searches Not for profit lawyers or groups in your area

If the store wants to tell you that you can’t come back, then you would be criminally trespassing AFTER the police told you not to go back. They don’t get to take you back there to tell you not to come back. They arrested you when you were detained AND then transported. If they detain and move you to new locstion, that’s an arrest. Or if the detainment takes a long while.

Something doesn't add up. If they wanted to issue him a written trespassing notice. Why didn't they just issue it on the spot where they originally detained him? Instead they opted to physically detain him and physically relocated him back to the property. Does that not turn the detainment into a defacto arrest? Furthermore due to their actions, it resulted in the damages of his own property. which they would be legally responsible for during the duration of his custody under their authority.
this cop could not investigate himself out of a paper bag, his actions were unlawful and wrong. there seems to be more than 1 that are seriously ignorant about the basics of the job they are doing can't believe they have badges and guns.
One cannot be transported BACK to a location in order to issue a trespass. TOTALLY unlawful. Please file a formal complaint and find a civil rights attorney. BTW, you were NOT simply detained. That was a de facto arrest. Hell, even a simple detainment is a "custodial arrest".
You need to contact a lawyer. This is an unlawful arrest. You may have to take this to federal court to ensure that you get a fair trial. I am not a lawyer, so please get a consultation with a civil rights lawyer
You can't really go anywhere from here. There was no real damages. 'De minimus non curat lex' = the law does not concern itself with trifles. I apologize Timothy, but you will not find a civil lawyer that will take this case.
Congratulations brother but you dont need an attorney or even money to file and collect on deprivation of rights under color of law offenses, otherwise impoverished and minority victims would have no rights because they couldn't find attorney's willing to represent them or afford anything related to pursuing compensation. All any victims have to do is issue letter of intent to sue or at most actually file the 1983 form, when they have no legal justification, there is no way they can take it to trisl so they have to satisfy a settlement which is entirely untaxable as its considered compensatory still even though its outside of court matter. I can absolutely promise you this is as easy as issuing letter of intent to sue, they had absolutely no legal authority to even detain you much less arrest and abduct you and nothing occured in their presence or any evidence of any crime, even to be trespass warned all it requires is that you leave when told to and they abducted you to show you they own you and they can haul you back to their buddies to mock the joke they binded and abducted to bring back for laughs and disrespect so they can destroy your self esteem and Spirit to show the pinks they are owned by what goot bpys they are! This is 6 figures guaranteed in settlement alone i promise!!! No attorney or even money needed to file and collect i promise.
