That Sargent is a REAL cop. One of few. If police would actually study and keep current with the laws they are entrusted with to uphold and not go off personal opinion or agenda things would go so much better for us all.

No, that sergeant has just been around long enough to know a losing battle. he walked all the way from inside to save his deputy. if he truly were a "REAL cop", these officers would already know these laws as he does. he doesnt care about not harassing people, he only cares about not harassing ones with cameras.

The cop was only wrong at saying he was wrong..he wasn't wrong he was just following the suggestion of the Sgt. The Sgt didn't have to come out he was just avoiding paperwork from an escalation. He is very smart and cool.

Because the Supreme Court has also ruled that you may not resist the lawful orders of a Police officer, even if they are wrong. They ruled that a court of law is the police to determine right/wrong, and not in the street (where citizens encounter officers). Therefore, when you refused to obey the lawful order of an officer, YOU are in violation of the law. IF (a big IF) the officer is also in violation (not just YOU THINK their in violation), then a COURT OF LAW will determine that, and issue appropriate sanctions. Either way, in some states, what he did is a crime. In all states, it's extremely rude. Toward good, hard working people.

Agreed. I am not saying that the guy flying the drone is right, because I do see the police point of view as well. But, to say who cares is contempt of the law. Governments makes laws, police enforce laws and the Supreme Court ensure that there is law and order. If we had no Supreme Court then there is only a totalitarian state. This cop is a dangerous breed.

Yes it is, but there's no need to be a dick about it when the sergeant was being very reasonable and nice. The drone op was clearly looking for confrontations like this, especially since he said it's happened several times before. The sergeant pretty much finished the confrontation but the drone op just had to try stiring it up a bit more because he wasn't getting the reaction he wanted. Happens almost every time in videos like this, makes it very hard to side with the public side when every time they're just being assholes who intentionally get into situations like this.

Amen Ben. The first guy it's a bit more understandable, but to the second guy he should have just said "Thank you" or something to that effect. That second cop was keeping the peace and doing the right thing, and op just couldn't leave well enough alone. I don't like the idea of big brother and all powerful government anymore than the next guy. But after Sarg tells you you're cool, why continue the hostility??? I agree that we as people need to hold law enforcement accountable for wrongdoing, which definitely happens. But that seems different than what this guy is doing. Like you said, he seems to be intentionally looking for a certain reaction.

I saw the original video and in it he said that he had previous bad encounters with this police department and he threatened to sue them, so the only reason the seargant responded in this manner was because of those previous encounters.

A good cop will admit he was wrong regardless Los Pollos Hermanos you have no point of reference to say that's the only reason he did. Everyone makes mistakes and people somehow expect cops to know every law on the books which is ridiculous. Like the poster of this video that put in the description that the sergeant shut the officer down for misconduct which he didn't because the officer was not performing misconduct, he was simply performing his job based on his current knowledge of the law.

I get you but at the same time a good cop would not argue something based on what he thinks and your right they are not expected to know every law but this one is simple the guy is in public recording the Sargent did correct him and he walked away which was good there are many videos when the cop is wrong and the rest of the other cops know it's wrong but they back each other up so you are right it was cool that he admitted he was wrong. Now I wonder how he would have acted if the Sarge didn't come out and correct him how far would he have taken it? Who knows.

Did anyone else notice the sargeant gave an unsolicited apology? Perhaps the nicest, most grounded peace officer I have observed in all the dozens of hours of these types of videos I've watched. It made my heart swell with happiness. More peace officers, and really, anybody, should demonstrate this kind of grace. Thank you, officer.

-Regular guy, I agree with you on the fact that the Sergeant shouldn't let his subordinate do this kind of thing. However, I think there wasn't a better response that we could see on camera from him. What happens off camera is whats important, for all we know the srg had a meltdown on that guy and scared him straight. Optimistic, i know but lets cut the srg some slack.

The Sergeant definitely did a stern "fuck off" to him in the most professional way possible to his underling, the way he immediatly walks away and even takes flak from the camera dick shows there's definitely more nuance going on here. Although I agree that sure the Sergeant could publically reprimend him infront of the camera, and it'd be cool, then this would be a sensation, he'd be a sensation, life would be a sensation, he just can't have all that senstationalism in his life. So he just took the easiest way out. Camera dick should have been a little less of an entitled brat to the Sergeant, but hey that's life in this day and age, the first cop really jimmy'd his ruffled chips, and more cops are doing the same in the past and even went as far as to get verbal confirmation that he was allowed to film there. So I guess he was just really pissed off at this point and was hot and in the moment. What we need is cop canniblism, a movie where a virus only infects cops and they start eating eachother and the good cops are left, and the bad cops are all zombies, and there's only like 3 good cops per station. And as the cop zombies burst from the glass windows of the station and attack the public, a vision from Buddah, Allah, and Jesus (in Boyband format) to all the surviving cops that they must save the world from the zombie cops from hell who are actually escaped demons from Satan's secret sex dungeon where he keeps the most perverted of the perverted and subjects them to the most G-rated softcore pornography for eternity, and then they break out of his sex dungeon, and they flee out of hell, and they go through a gateway which is guarded by Frank Serpico (Who went to hell on a technicality for being a "traitor" so instead of punishment was given the role of guarding one of the seven doors out/into hell) and this is why they get bad cops because they use Serpico's energy to go through the doorway and the world's police all over turn into zombies who eat because they haven't ate in years. I don't wanna say demon cop rapists are what they become, but they definitely are rapist demonic law enforcement. And it's up to 3 rookie cops with no time, no options, no shortage of bullets... I agree 100% Unfortunately all over the USA there are police officers that are under-trained, forget what they have learned and give no effort to CONTINUING to learn the laws they swore to uphold. They're training is extremely limited due to fund and timing constraints. They have to "learn" on the job, so to speak for the most part..... and that doesn't work for me. If you wanted to do that at McDonalds or Walmart, that's fine.... but when we're talking about people that carry firearms and use lethal force, it become a whole different matter.

+Tommy Nickels and on what source did you get that information?Are you a cop? Have you gone around the country asking every officer their knowledge of the people's rights? Is it just that you only watch RU-vid videos of bad cops? Also there is nothing in the Constitution about flying drones, and with all the crazy things happening around the world, it is a little weird someone flying one around a police station. I wouldn't have blocked traffic but I'd definitely talk to the man on why. It's just easy to see he just wanted a reaction from police.

Arthur you should come to Australia! You would love living in a police state. Nobody does anything stupid like saying no to a cop, if they do they get frisked and taunted into swearing at police which is illegal. Everybody is happy to be pulled over for no reason, just to be tested for drugs and alcohol and the road worthiness of their vehicle for a random inspection. It makes the world safer. Especially the $300 fines for speeding 3 miles per hour over the speed limit. Leave that hippy bullshit freedom loving USA and come here. It's basically the same except we have better healthcare.

Angelbelle The unfortunate truth about law enforcement is, it only takes about 19-21 weeks of education, in the form of the police academy, before someone can be labeled an officer. They do undergo further training once they've graduated, in the form of a probationary period. Usually served alongside a veteran member of their force(who has undergone the same schooling). Conversely, Lawyers must aquire a bachelor's degree in the subject of their choosing and pass the LSAT before even making it into law school. That's if their undergrad GPA was good enough. Law school is usually three years, sometimes more depending on a person's preferred pacing. Tl;Dr It takes six months before they give you a gun and badge and tell you to enforce the laws it takes criminal defense attorneys can only practice after seven years. Haha.

I don't think that cop would have been less shrewd if the guy had committed an actual crime, but said he was unaware of the law. He would be told that ignorance of the law is no excuse. But the cop--who, by the way, said that he doesn't care what the Supreme Court or the Constitution says-was displaying his ignorance of the law. The ones who enforce the law have an obligation to know it.

It's called "A free country" what out forefathers fought to keep and if you want to fly a drone then that is your right, you would rather live in a police state? The second this cop said "I don't care about the supreme court" he should lose his job, instantly no if and's butts or or's. In the constitution it clearly states that "an acting officer can not uphold the laws if he does not know the laws", this cop should be removed and sent straight back to the academy to be trained as he does not know the law, hard to tell others they breaking the law when he has no idea what the law is.

As long as there are people as stupid as you are, the police won't be able to handle their realy bad cops. This cop was maybe not well enough informed on any judicial decision, but he was far from corrupt (not sure you know the definition of this anyway) or criminal. He made a mistake (strange one for me because i think in my country it is legit to ask for id) and beside that even admitted that regarding to his sergeant he made a mistake. Jesus, the fuck is wrong with some people? Cops attitude and understanding of the constitution was wrong but the dude is suspicious as fk filming a police facility of all things. These people go to work and never expect the day someone might surprise them with a bullet and they can't go back to their families. All the young cop did was ask who he is and why was he doing that suspicious activity. And the second the sarg told him it's fine he walked away and even said he was wrong.

I think this is my FAVORITE 1st Amendment audit of all time. Part of police reform is making absolutely sure young officers are educated on the rights citizens have. The tyrannical methods commonly used in many instances make a mockery of the rights we clearly have, according to our most important founding documents.

The American people didn't pass the law; they elected criminals who passed it for them. After 9/11, Congress created legislation which was signed into law by the POTUS, that declared American soil a battlefield. They have also cleared American airspace for over 30,000 drones. As well, POTUS has claimed the right to detain American citizens without a trial and, oh yeah, the right to kill American citizens without due process, a right to a fair trial and hear the evidence and face the witnesses who have accused them. Why, again, do you think police have this attitude? A storm is coming...

Really? There could be no ill intent? The cameraman was right in principle not in spirit. Asking for his job is witch hunting. Once confronted with lawful information he was immediately submerged and had a knee-jerk response (unfortunately common with humans in an authoritative position). You should hope he learns from this and becomes a more informed officer.

"according to my Sargeant, yes i was" Kudos to the Sargeant who very polite and calmly explain the reality of the matter and is knowledgeable about the law. Whether or not the person filming was right or wrong, the über arrogance from Officer Fouguere was more than bubbling over and forgot that he is a public servant, paid for with our taxes. Yes he is out to do his job but not in the form of intimidation and arrogance. I have to say that not all police officers are arrogant like officer Fouguere, but a big number of them are. It is only sad to see such arrogant people try to intimidate citizens so they can feel big. Trust me, i lived through a civil war and saw many soldiers who were such arrogant people like officer Fouguere, at the sound of the first firecracker, they wet their pants and filled their underwear.

In some cases, we *do* "sacrifice liberty" and we do so because the alternative is far more damaging than the sacrifice. I think in today's environment with terrorism being a real and probable threat, that it's fair to say that the trooper was acting in the interest of the public. Filming government facilities, especially critical infrastructure like a police station is a huge alarm bell. He could have been gathering information on how many officers are there, what firearms do they carry, what are their routines etc... If he were to just leave it be I would be saying he is not acting in the peoples interest and ensuring security and safety of the country , state or town. I''m not saying go arrest everyone who wants to film a police station, but if in a situation that is obviously suspicious in nature, even if not in intent, just comply and give your name, dont be a self righteous jackass. Maybe I am wrong, but getting name and date of birth hardly seems to be flexing your muscles of power, if there is nothing you have done wrong there is nothing that can go wrong. Its almost a human decency situation, if you see someone standing near your place of work and filming it by himself, especially if that building is a hub of people, you would be curious yourself and probably ask, or at least if you have an ounce of awareness and security you should. If that person refuses to provide anything it would certainly ring major alarm bell's, or it again should. Granted he obviously spoke to other officers and did talk to them to some degree of his purpose, what is the harm in telling it again if another officer obviously was not part of your initial explanation. If this is what the general public act like in these times, boy ISIS is going to have an absolute field day my friend.

+Unnecessary Risk I get what you're saying but it's not quite accurate. I agree it was the officers job to try and investigate suspicious activity, but suspicious does not equate to criminal. Once the officer went and asked the guy for ID and the guy exercised his legal right not to give it without a probable cause or reasonable suspicion then the officer should have taken a different approach just like with any investigation. When blocked on one avenue you find another one. He should have told the guy to have a nice day and then just watched him until he was satisfied the guy was not a threat. But what he did instead was harass a man who was not doing anything illegal. I can't stress this next sentence enough because people can't seem to understand the concept: It is NOT a civilians job to do ANYTHING but follow the law. If a civilian chooses to be nice to someone who is infringing upon his/her rights, fine, but if not that doesn't give a cop leave to try and strong-arm them into compliance.

Mission Attrition I get what you are saying, but in my eyes the trooper most definitely had probable cause to get some ID from the man. At the end of the day the civilian was being a jackass for the sake of it, There was absolutely no benefit for the trooper to possess the mans particulars. I imagine a name check would have been conducted and if there are previous alerts of suspicious behavior or actions, then steps would have been taken, however, if there were no such alerts then it is obvious that he is just filming because he is interested or plain old felt like it. People need to understand the situational circumstances. If the civilian is just standing around minding his own business in a shopping center, or out the front of his house, or place of work etc, then it would be unreasonable and unfair to demand his particulars, but this situation was not like those above and was definitely suspicious to say the least. It is every citizens responsibility to watch for and report suspicious behavior and ask themselves 'Is this normal, what are they doing, who are they?' This is especially true for any police officer/soldier/security officer as it is their paid job to ask these questions. I dont know why people get so offended by this and cant see the situation from the officers point of view. Now especially since there are shooting, or rather executions of officers in the public domain, it can be expected that the days where they will just look at some guy filming and loitering around the police stations or areas of police gatherings and assume it to be innocent are gone. Let me set you a scenes - imagine if there was some guy standing out the front of your kids daycare center, or out the front of your house etc, and he is filming you and others near by. In days of old you would have thought nothing of this, but these are not the days of old and there are MANY people out there that will blow up a daycare full of children without hesitation and call it gods work. Now keep this in mind and add the fact that police officers and other government officials are even more specifically targeted by said people. So you think to yourself 'I'm calling the police, something just doesn't feel right here and I am concerned there may be something more insidious in nature to this.' Scenario 1: The officer attends and speaks to the gentlemen who now understands that he was making you nervous and apologizes, providing his details to the officer who confirms there is no safety alerts on the male and leaves him to his lawful activities and you at ease knowing all is correct. Scenario 2: The officer approaches the male and asks him what his purpose in filming or loitering around is, however is met with avoidance and hostility. The officer requests the males name, however the male refuses to. The officer approaches you now and says "Sorry sir, I agree it looks suspicious but hey, I dont want to infringe this mans rights so im just going to leave him here and go. If he does turn out to be a terrorist or starts shooting the place up, call me then." Sorry for the wall of text, but I just want people to see reason other than 'fuck the police' because that seems to be the issue here, Hell, I dont even live in America, but like i said, in this circumstances and VERY recent history of terrorist and other attacks, i would call it 'reasonable suspicion' enough.

Unnecessary Risk I am a former police officer who is now a regular civilian so I see things from both perspectives. Here's the thing. Yes, it's suspicious for a guy to be arbitrarily walking around with firearms but again that doesn't make it criminal. If I were called to that scene I would have done the same thing initially. I would have asked the guy for his ID as I could and should do. But the moment he chooses to exercise his right not to produce it, as he could and should do in this situation, as a police officer I would say "ok, I just want to let you know you're making people nervous." At that point I'd just watch him for however long I felt the need to make sure he didn't do anything illegal. Sure the guy might get pissed off about it but I'd be full within my rights to do so just as he's full within his rights to carry the weapons. That way he can carry on with his business legally and unhindered and the public that are counting on me to protect and serve them can feel better knowing a cop is keenly observing a guy walking around with guns. So in your scenario 2: the cop (if he's a good cop) would say "Sorry sir, I agree it looks suspicious but hey, I dont want to infringe this mans rights so im just going keep an eye on him."

I am a former police officer in Australia too by the way my friend, good to talk to other ex officer's ☺️ I just think that if an officer has suspicion enough to hang around and basically babysit some guy, there should be enough probable cause to obtain his particulars. I just don't see the harm in it. I know Australia is vastly different to America and I am not trying to compare the two, but reasonable suspicion here is much easier to come by. For example if there have been some assaults or burglar activity etc in an area, and someone is walking around in all black with a hoodie on, that is more than enough to obtain his particulars. Now granted the person may just be innocently walking just because he felt like it and can, and sure it may inconvenience him and make him feel like I am bullying him, but at the end of the day, he will understand when the burglaries or other crimes drop in the area. In Western Australia, when we look someone up on our system, it's basic information only, just criminal history, address, name and drivers licence details, nothing to be worried about, is it different in America? I just don't see the benefits for police in having your details in those circumstances, as in why is it assumed by most that the officer is only asking them for his own benefit, rather than out of reasonable suspicion?
