My name was involved in a case which happened before my joining. Warrant was issued and jailed for 3 days (2020) after leaving the company in 2018. Had no idea about the case and my lawyers also played an important role with my company in keeping me darkness. Am 45 now and am jobless for past 4 years. Last year my company and vendor made out of court settlement and it's 1 year now. I have the certified copies of the company complain criminal case. Now I want compensation for negative back ground verification, name, reputation, pay loss and humiliation in the society. I want to file defamation after 1 year as the case is disposed on 22.04.2022. Kindly suggest which format would fetch me compensation - Criminal or Civil? as 1 year has passed from the case disposal. Note: have lost faith in Kolkata lawyers!

"If the answer came in any RTI that general female post was = 0 but department has selected general female on one post which is from scheduled tribe category total 4 posts in recruitment were reserved for general category and my marks in that more than female candidate, if she is selected on the basis of horizontal reservation then her marks should have been more than mine" This is the main reason behind I filled writ petition in Rajasthan highcourt and writ petition pending since 2020 any chance about the allow writ petition???

Sir nice video, sir i have one question, what happen if respondent do not file written reply in writ petition even after court said in order to file, what are optons left with petitioners

Even after the court passes a specific order of filing a written reply in writ petition, if the opposite party does not file it, then two things can happen. First the court may either proceed to hear the case without the written reply of the respondent. In this situation the court may presume that the respondent who has failed to file reply to the petition has nothing to say about the correctness of the contents of the petition.... And on this basis the court may proceed to decide the case. Secondly it may also happen that if the court feels that the respondent has not honoured the court's order of filing a written reply and that the written reply is necessary for properly determining the questions before the court, then the court may pass stringent orders directing the respondents to personally appear before the court, so that they can be dealt with for not honoring the court order. The court me treat this conduct of the respondent as disrespect to the court and may take action.

Hi am having one doubt.... In any court case, if person doesn't have any surname or initial does court or lawyer adds surname or initial...? For example my name is Hemanth in every document, ever as per bank account (my father has surname),....can court add that surname or initial in case holder name (will it show same ecourt if they add surname?

I think no. Whatever your name is as recorded in the document the same will be reflected. If at all you want it to be changed by adding your surname you will have to make an application.

Sir, how much time should legally allowed to file a Reply/ counter Affidavit to State govt. In my case 4 months had completed from first hearing but State govt had not filed their reply yet. Please reply sir

Actually 4 months time is enough for a responding to file reply. But there is no guarantee that respondents will find reply within that time only. If the respondents are not filing reply within a reasonable time then the petitioner or his lawyer can press the court for proceeding with the matter without the reply of the respondents. The experience shows that even the court would want to have reply of the respondents before it to decide the matter more effectively. Therefore the courts normally grant time to the respondents to file reply. But even then if the petitioner keeps on pressing for hearing the matter without reply of the respondents then someday the courts may take a strict stance against the respondents which would compel them to file their reply.
