Murder is a deliberate act with the intent to take a person's life. It would be hard to prove that was his intent. That's why a lesser charge was selected as it is easy to prove beyond a reasonable doubt. Just firing at random into the car is very different from if they stopped at the roadside and had words then this idiot pulled his gun and shot the other in the chest killing him. That would be an easy murder to prove in court.

Truth. That's why I never use my horn, just brake early and drive a little under the limit. Even had a cop stop me for driving 50 in a 55, and he was evasive in his reasoning for stopping me. Kept me there asking again and again if there was some kind of a problem, finally I said, "Just go call your supervisor out here and we will let HIM straighten you out, that I broke no traffic laws and this is illegal imprisonment to keep me here for 50 minutes without ANY charges, just you THREATENING to call out a Drug dog to search my car. And me refusing every time you ask me to let you search it. My Lawyer is gonna love this." Less than 5 minutes later he walked back to me, telling me to watch MY attitude and start driving legally. It's very difficult for prosecutors to prove to a jury what a suspect was _thinking._ Prosecutors are more likely to get a conviction if they go for the crimes they know they can prove: possessing and firing the gun. They have witness testimony and physical evidence and a confession that proves he fired the gun.

There is a flip side to that someone who gets in the fast lane and is going the same speed as the other lane and doesn’t move out of the way to let everyone else by is inconsiderate and has no intention of trying to share the road with the rest of society! While it isn’t ok to shoot them their inconsiderate selfish attitude can be infuriating! I am a considerate driver but also not a slow driver, so get out of the fast lane if you’re not going fast. It is not your responsibility to speed police the fast lane and doing the speed limit in the fast lane is also unacceptable if you’re not passing someone. Just get over. It’s rude and inconsiderate to block other people’s flow.

I got pretty mad once when some jerk blew his horn at me for stopping to check traffic at a red light to make a right turn. He wanted me to blow right through it I guess. It was a momentary stop, just long enough to make sure no one was coming from the left. People are crazy. That was a few years ago, I gave him the one finger salute. Thankfully that was before everyone was carrying a gun. I wouldn't do it now.

You must drive on roads with no traffic. Trying to put 3 lane traffic into 2 lanes just doesn't work. There's no need for anyone to drive OVER the speed limit in the fast lane, because, you know - speed limit.

You shouldn't be on the road if you think the left lane is the fast lane and not the passing lane.

@@XsaviXander In our state, the law says the right lane is for slower traffic. The only thing it says about passing is to pass on the left. Anyway, I never drive in the left lane, but I do take it well before I'm going to make a left turn if the traffic is heavy, so I won't be cutting someone off or not be able to make the turn. It is not only for passing. It is also for planning ahead so you don't have to do any last minute maneuvers in traffic.

ALWAYS watch other cars approaching an intersection. if they show no sign of stopping you better be ready to stop yourself. NEVER assume the other drivers are going to do the right thing. its the only way to keep yourself and other occupants safe.

I agree. Used to be an otr truck driver. What you say is a profound problem that is the source of so many people’s rage. You get certain people that just don’t care about anyone else but themselves, and will park it in the left lane. I’ve seen over a mile of bad traffic just because of one person. Some states are worse than others, but California takes the trophy for the most irresponsible and selfish drivers in our entire nation.

I've had to follow a-hole truckers like that for over 20 miles at 20MPH under the speed limit on I-35. You also have OTR truckers that think they have the right of way...period, because their job is on the road.

In California's Bay Area, the center divider has signs at regular intervals that say "Keep Right Except To Pass". That should be done nationwide.

Some people think that someone going 75 in a 65 zone should get out of the way so they can go 100. Sometimes if the traffic is a bit heavy and I know I have to make a left turn a bit ahead I drive in the "fast" lane (so I can avoid last minute lane changes in traffic), going 50 or 55 in the 45 mph and have people zoom at 65 or 75 mph. That's just not right. Some idiot in our state government wants to make driving in the fast lane illegal. Can you imagine all the last minute chaos to get into the left turn lane? Not to mention having an unused traffic lane - sure that would work.

We need better government control over the speed in the highway. We need better governors in cars that will limit the speed and equalize it for everyone. We don't need lifted trucks going 100 on a 65. More government control on cars is needed.bheck we should just ban cars.
