A man with two DWI convictions is accused of hitting and killing a pedestrian and failing to call 911 for half an hour. Dallas police say when the suspect finally did call 911, they found his BMW with heavy damage and a human body part in the passenger seat.

A second or third DWI conviction includes a driver's license suspension of 180 days to two years.Sep 21, 2020 The Texas Governor could change the law but chooses not to for political reasons like raising taxes to pay for new prisons to house offenders so they pass laws that judges must follow that let them out because we can't afford to house these people.

You should know people drive without license and or insurance, even "Americans" who drink and drive and have their license suspended still drive without it. I'm almost done with probation from a DUI from last year...it's cost me my relationship, privileges and hours lost at work, thousands upon thousands of dollars....trust me, it does, or at least for me it does. Thank God I've never hurt anyone

In some states there are severe consequences for driving with license suspended for dui. An 18 month suspension comes to mind.

You're skipping a party, the police that routinely falsify information. Almost 10 years ago I was accused of dwi for being unable to perform a field sobriety test, I was arrested and spent the night in jail, the cop told the judge that I wouldn't answer any questions and just handed him my license insurance and registration when stopped for going 2 mph over the speed limit. First off, I never speak to the police when stopped, I take a right to remain silent seriously and talking won't get you out of a ticket. What was shocking to the court is when the cop was asked how many dwi arrests he'd made, he said over 700 in the more than 3 years he was a trooper, the judge couldn't believe it. I was found not guilty after a year long battle, and I'm sure the cop was put on a Brady list.

Judges must follow the law and must follow sentencing guidelines. In Texas, a first-time DWI conviction includes a driver's license suspension of 90 days to one year. A second or third DWI conviction includes a driver's license suspension of 180 days to two years. Sound too lenient? Those were passed by politicians, not judges. Politicians that Texans keep voting into office. Want tougher laws? Then vote for people willing to implement tougher laws. If politicians vote to make a first offense DUI conviction punishable by 5 years in prison, then that will be Texas law and a Judge MUST sentence a first offender to 5 years in prison. It's not the judges who are the problem, it's the law makers.

@@donmiller2908 Standard penalty for a DWI in my county is a suspended license (most don't have one to suspend, or it's already suspended), 3 days in jail (suspended) and a $350 fine. So, the actual penalty is a $350 fine. That's it. The driver doesn't need to have a lawyer to get that deal, it's standard for all DWI defendants. Of course there's a translator for the majority of people who come through, since they don't speak English. It's not just the judges, it's the prosecutors. Our DA has a 97% dismissal rate.

The District Attorney must prove that Munoz intended to kill the person who's arm was in the passenger seat of his car. If the DA cannot prove intent then Munoz or any Judge (Like that would ever happen) cannot be charged with murder, which is an intentional killing. The best is manslaughter, which is accidental. You need to understand the definition of murder/homocide and manslaughter

I think it's "as long as prisoners are a labour force that can not be utilized to subsidize their own keep it is too expensive to keep everyone who should be behind bars behind bars". I'm not advocating Chain Gangs but there must be some way to have prisoners work off the expense of keeping them.

@@audralynn7454 saying the victim has not yet been identified doesn’t mean they haven’t found them. In fact, it doesn’t necessarily even mean that they don’t know who it is yet. The impact was violent enough to rip the victims arm off - the rest of the remains may not be recognizable, so even if they had ID on them, police will seek other methods to confirm that it is, in fact, that person

No it is the minimum sentencing laws passed by your politicians you voted into office that the judges must follow that let these people free so try holding them responsible for once, if they passed laws that actually punished people for their crimes we would not have so many of these problems. Dumping people in jail for first offenses without any care for underlying causes or treatment isn’t going to change the course for repeat offenders like this one. I do agree the first penalty should be STIFF. No just 90 days of a suspended license. Probation for first offenses that don’t include injury should be for much longer too. But I do agree that once you have a second DWi/DUI you should face jail time. But if there are any injuries or deaths from a drunk driver, that automatically gets upped to serious time for murder, with long sentences.

@DESIGNS-vo1mt local DA handles the prosecution, local judges/juries handle the sentencing. There's significant backlash to oversentencing which is a big reason you see repeat offenders. I'd suggest the person who got hit should've been more wary as that's a bar area with lots of drunk drivers at night.

It is public knowledge that Alcohol has made tens of thousands of people dissappear from this physical realm. However, alcohol is legal because a certain community of people made it so. There was lots of money to be made. Marijuana on the other hand remains federally illegal because it is seen as a drug used by mostly people of color. (Stereotyped) Plus it's the only drug that can be detected days after use.

Unbelievable! He just kept driving aa if he had ran over a bump in road, no remorse, no nothing. Considering he was a two time DWI'er already they will most likely give him a year with 10 years probation and a fine. The person he ran over cannot come back but Munoz gets to go on. @@TwisterTornado It is very rare that in most of the DUI/OWI/DWI et al body/dash cam videos the kids have multiple prior offences, suspended DL, etc. and they still get signature bonded out. In multiple states is is a misdemeanor unless you kill someone.

I don't care if he is rich or poor, our so called justice system lets impaired drivers off with no less than a slap on the hand now compared to "back in the day when we old people were young". Judges must follow the law and must follow sentencing guidelines. In Texas, a first-time DWI conviction includes a driver's license suspension of 90 days to one year. A second or third DWI conviction includes a driver's license suspension of 180 days to two years. Sound too lenient? Those were passed by politicians, not judges. Politicians that Texans keep voting into office. Want tougher laws? Then vote for people willing to implement tougher laws. If politicians vote to make a first offense DUI conviction punishable by 5 years in prison, then that will be Texas law and a Judge MUST sentence a first offender to 5 years in prison. It's not the judges who are the problem, it's the law makers.

These type of people are a clear threat to society, how many times are we going to read about the same story…innocent life being taken by a repeat offender, few years ago a drunk driver ran a cross walk in front of my house where a grandmother was pushing a stroller with her 2 yr old grand baby, he killed them both and kept going, later police caught him and told me he had a suspended license from a previous drunk driving conviction 🙏🏾 🕊️ 🗽

Your bias is showing. People who aren't citizens ARE deported when they are arrested for committing crimes. If you spent any time in a courtroom, you'd hear that conviction means deportation for non-citizens. They say it when they read everyone their rights. Since this is his third DUI, he's obviously a citizen.

As a recovering alcoholic with over 40 years sobriety, I feel far more qualified than most to comment. It is stupid to blame the judges or the system. That is entirely what is wrong with the world. We as people are more than willing to accept credit for good, but as a whole are not willing to accept blame for the the bad things. Anyone who has reached the age to be able to drive legally knows that it is against the law to drink and drive. This is not a grey area. The legal limits are set low so there is no grey area. If you have consumed any alcohol in the previous hour, you are not legally fit to drive. We can blame but the person who is responsible. Granted, it is easy to blame the judicial system, but fixing blame without giving a solution is just another way of not takkng blame and passing it on to someone else. Anyone who has ever been arrested for a DUI/DWI knowing that it is against the law, has a problem with alcohol. It has clouded their judgement to a dangerous level. In my opiniion, each state should adopt these measures. First offense should be with no plea bargain whatsoever. If you fail a blood alcohol test within 2 hours of your arrest, you receive a fine of 10% of your yearly gross income. No exceptions. Your license will be suspended for one year with no exceptions. You will be forced to attend AA meetings at the rate of one per day for a year. The first thing an alcoholic needs to understand is they have a problem. They will never be able to control it. They need to learn how to live their life without drinking. They can never drink socially. I'm sorry, but the desease is addiction, alcohol is the symptom..Texas still has people doing long prison sentences for possession of marijuana. Letting a serial drunk driver to drive is wrong. We need to stop thinking of alcoholism and social drinking as the same thing.

This is eerily similar to the story last year where a man hit a person in Dallas and drove all the way to Fort Worth with a whole BODY in his windshield. DFW has a terrible drunk driving problem and the slaps on the wrist make it worst.

I was waiting in court as a witness. I watched as people went ahead of the case. This guy got up there. It was his 12th DUI in 7 years. Old man hit 3 of his neighbors mailboxes. They let him go with probation i remember thinking wow only a matter of time before he kills someone.
