Axe of Despair was clarified as being an archfiend card back when Dark Crisis released the chesspiece archfiends

4:34 yes that was an illegal play. Axe of despair is an archfiend card but does not count towards controlling an archfiend for falling equip. Rulings at tournaments & RBET says it's treated as such but does not considered as one.
