Filing a lawsuit complaint against your employer?
This employment law secret is something that will have a significant impact whether you get paid on your case or not.
Most employees don't realize it, but large companies will generally have an insurance policy coverage called EPLI. Employment Practices Liability Insurance provides coverage for these exact situations.
So what people don't realize is, it's often not the employer out of pocket who will pay the employee to settle an employment lawsuit claim. It's the insurance coverage that will pay the money to settle.
This is a little outrageous when you think about it from the context of justice. Are employers really paying the price for violating their employees rights?
However, there are benefits from the perspective of the employee filing the complaint letter as well... As the likelihood of the employer choosing to settle the case and pay recovery to the individual is increased dramatically.
When the money isn't coming out-of-pocket for the employer, it's more likely they choose to settle with the insurance paying to make the problem go away.
The hard truth is, many of our clients who come to our law firm looking for help after a serious situation in the workplace have been impacted directly or indirectly financially. They are in dire straits. They may have suffered an illegal job loss, been discriminated against in the workplace and suffered a series of negative actions or demotions impacting their income. The point is, in these situations a fast settlement recovery is often a life-line for the employee and their family to make ends meet and get back on their feet.
EPLI insurance coverage increases the likelihood of the company settling the employment law claim. A formal letter of complaint is issued, and the seriousness and merit of the facts contained are reviewed - and they determine whether they want to fight or not.
The secret, as mentioned in this video, for better or worse, is that a company with an EPLI policy is much more likely to settle and pay the employee.

Even more of a reason for employers or "small busineses" to not mistreat their employees and abide by the laws. Strategically not purchasing or not renewing EPLI does not deter a worker from pursuing their rights. Seeking justice shouldn't be contingent upon insurance coverage. If you were indeed wronged hold the employer accountable.

So just because they opted out of EPLI the employee won’t get paid?

Good question and the employee could still get paid, but it will have to go through the lengthy legal process. The employer is more likely to quickly settle the case if they have this EPLI coverage. It also depends on the per claim deductible that the employer has to pay.
