Real world reality inevitably seeps in.
I was watching Billions last night, all I could think about were red flags for every HR violation, EEOC issue, etc. etc.
Along these lines, I get asked alot about whether I can help get someone's job back after termination.
Here I explain why a forced reinstatement never works out in real life.
Because if you think about it, though there may be a path legally to get you reinstated into the position you had at your old job - there are a number of real world considerations which shouldn't be ignored.
For example, it's very likely if we use the law to force reinstatement, that you won't be very long until your employer finds a legal way to get rid of you.
You can expect the scrutiny to be high, your every move put under a magnifying class, and let's face it - sooner or later you will likely make a mistake providing them the opportunity they need to fire you once again.
This time however, they will be more careful to stay within the guidelines of the law since you already took action.
The point is, what's best for you and your future should be taken into consideration.

If your former employer is the only place in your entire state where you can make a certain level of money and be home with your family. Then going back is better than having to live far away to make a living for your family.

Thanks for sharing. This is an interesting perspective and it sounds totally reasonable to me. Everyone wants a fresh start after something like that but sometimes economic need and/or the employee’s value to the organization likely prompts people to do this.

The only way I can see that route of reinstatement working out is if there is repentance on the part of the employer. In fact, in that case, the employer would settle and admit he was wrong and willing to make it right without a court's help.

Yes you can get your job back after being fired. I've heard of people and seen people getting hired back at companies that they have been fired from before. People can look up how many companies have hired people back that they have been fired from before, you can get a job back that you have been fired from depending on what you did and depending on the company's rules, or boss.

She took me back because nobody wants 3rd shift and she was desperate!! And I have a problem saying no. But I can clearly see that in the year and a half that I was gone, NOTHING has changed! I'm looking but for now because of travel distance, I'm still there.

What if i was with a temp agency and i got argumentative over the offical applicantion i didnt want to fix something on my job history..another words i did 4 months through a temp agency with a job i still want and when i was filling out the application for the new company to transition from the staffing agency i didnt want to include something in my applicantion and the boss called the sfaffing agency and said we arent interested. This was literally on the day they were going to hire me. I should have not argued. Anyways can i keep trying to get hired after the fact? It has a pension and free healthcare.

@@pamextvflora5019ex boyfriend or girlfriends are not a very light thing to get back. A job that fired you might be easy to get back depending on the boss, what you did or the company rules it’s always up to them.
