Ep64: LDS Church Sues and Financially Threatens Town: The Cody, WY Temple Story

What happens when the LDS church wants to build a temple in your town? In this episode of Mormonish, Rebecca and Landon dig into the ongoing Cody, WY temple situation to uncover the tactics the church is using to manipulate the outcome.
The new temple is slated to be built in a neighborhood not zoned for this type of structure. With concerns over traffic, dark skies, height requirements, and more, a group of citizens have formed “Preserve Our Cody Neighborhoods” to try to relocate the temple to a more appropriate site.
The fight is heating up and emotions are high as the church filed two lawsuits and threatened to bankrupt the city with legal action.
We discuss the situation with Cody resident Yvonne Chandler who gives us the inside scoop into this currently unfolding story.

I wouldn’t be surprised if the two years spent on “studying” Cody architecture, they where actually studying the laws and looking at loopholes.

I personally knew a family the South Whittier stake wanted their house because the church had to build their parking lot around it : they were always sending missionaries over to convert them and when that didn't work they tried to get a Mormon who was a Whittier policeman to shut down their home business. This was in the 90's and so they have been doing underhanded things 4 a long time.

How would it be to be an LDS missionary in Cody after all this... Made a tough job even more difficult. The church is literally shooting itself in the foot with their behavior.

So sad to hear the church acting this way 😢 "Do as I say, not as I do". Huge double standard in the church. I'm impressed with those in Cody who are standing up for their town and to keep the laws of the land. If the situation was reversed then the church would put this article in the Liahona magazine as a faith building story of living your standards and standing up for what you believe in. Sigh.....

The letter from the SP counselor was tone deaf and gross. How long do you think it will be before we get a general conference address talking about the miracle of getting past the Cody city council to build the house of the Lord?

One more example of tithing moneys being used inappropriately. Using their billions to threaten a small town and bully their way through the “laws of the land”. Thank you mormonish, y’all are doing good things.

I'm used to consider myself a proud member of the Church of Jesus Christ of Latter-day Saints but now I'm ashamed to be a member. I wish I could support the citizens of Cody but I'm poor and can't do so. It is disgusting the way my church has behaved. I hope the citizens of Cody win in court against big bullies like the Church of Jesus Christ of Latter-day Saints and set the tone for other proud communities. Go Cody! Go!

I think it would be useful for any future organizations or cities dealing with the Mormon church to have the mindset from the get-go they are dealing with a greedy corporation, not a church. This would get them up-to-speed much faster on how to prepare & respond. Hopefully this situation with Cody will open up more eyes of the nation as to how the Mormon church operates. The veneer of niceness is very thin. I feel very badly for Cody residents. This is so wrong.

And this IS the pattern of the mormon church. Step one-come in love bombing the town. Step 2 -baffle them with BS. Step 3 pull out the big guns. Step 4- bring in the attorneys and endless lawsuits. Sameo sameo wherever they go. The same tactics that got them run out of Palmyra, NY, Kirkland, OH, Nauvoo, IL. Only thing that has changed is their vast amount of wealth. They aren't shy about telling each city that bucks their plans. Tis OK . We will take you to court, forever. We've got more money than God. I have heard this countless times. Just ask the residents of Helena, MT. They went through this exact same battle.

Another great episode!. A small town buckles under a huge corporation. I bet Walmart would be more accommodating than the LDS church.

Communities instill community requirements on Walmart all the time to make it conform with their master plan and community and Walmart conforms. That is part of being a good neighbor. This temple could be built without a spire (like several other temples ) and not spotlighted (like any other building) and still serve the purpose for which it was intended but the LDS church does not compromise. My heart aches for the city of Cody. I feel shocked that RNelson has come up with these prefab Temples with no concern for the city. I worked with Nelson in surgery and I know his temperament…… Don’t mess with me I am a Cardiovascular Surgeon!” We would jump and do whatever he wanted!!!The church is NOT a heart and life. It is about Zoning!!!

With all that $$$, why suddenly CHEAP-SKATE pre-fabs? That c-s thing is an ESSENTIAL way of thinking. Bet nothing in HIS life is cheap-skate! Also very telling how the popups were surreptitiously delivered, BEFORE talks! (Angels or aliens?) If they are boldly making threats, they are confident of their POWER TO TAKE WHAT THEY WILL USING the name, "Jesus." That's what the $$$ is for.

Erda, UT fought the temple and the push for it to go to vote won. The temple ended up moving to Tooele, UT. They wanted to do smaller lots and condensed housing around the temple. Erda is a small town farming community. Most lots are .5 acre, acre or larger. Not really a condensed Housing area. Kind of amazing that they don’t seem to care about the current community they are potentially building in.

In about 1991, in my City of Escondido, CA...I was on the City Council. 28 year old LDS...somewhat non-attending (long story...I was on the wrong side of politics for local Mormon leaders...cold shoulder). Well, The Church buys two pieces of land. One to build a Chapel and One to build a Stake Center. One of the parcels is almost 100% Eucalyptus Trees...about half fully grown. The Other Site is in a quiet residential area...THE STAKE CENTER....not fronting any significant road....have to drive through quiet residential area to get to it. Anyway, I get a call from Local LDS Leader that Church Development Team is flying in from SLC and wants to talk with ME to discuss their "problems" with getting these Projects going. I do a sit down. 28 year old me...Stake President...Another Local Physical Facilities Guy....Realtor Sister from my Old Ward...and a couple of Suits from SLC. LONG STORY SHORT..... They can't figure out why the City won't let them cut down EVERY SINGLE TREE ON THE 90% TREED LAND IN A NEIGHBORHOOD THAT IS BASED AROUND RURAL TREED SINGLE FAMILY LOTS.....AND The City is not real happy with the idea of putting a rather large and sometimes intense facility in the middle of a rural neighborhood. They want my help. I told them that I would vote no 100 out of 100 times on any Plan-Project that cuts down every tree on such a piece of land....and I told them further I would say that face to face with The Prophet if he came down to see me. I did say it nicely, but I wanted to make it clear. I also told them it was would be almost impossible to get the Neighbors to support the Stake Center Project....that personally I'd have a hard time voting yes on approving it. BUT.... off the top of my head and with my knowledge of my City I said..."Why would the LDS Church want to be The Black Hat in two different neighborhoods in the City??" And that they should look at two other sites which were both fronting two major roads and both had access to and from I-15. The Church withdrew one Project...tried to push the Other One through....failed....and if I recall, bought BOTH pieces of Land I recommended and built the Stake Center on one...and never built the Other Chapel. The Church thought it should get Red Carpet. BUT...they were VERY polite and acted very professionally.

Good for you. Escondidites salute you. No chance they improved their siting process now that they have $130 billion. Just ask downtown Mesa, AZ where church bought up, evicted & tore down affordable housing to redevelop around temple. Such good neighbors. /s

Should be noted the towns at 37:00 are all tiny communities within Park County (except Powell which is the next town over from Cody ~20 miles away). They're all technically within the same county but Park County is huge (~7000 sq miles) they're not in Cody and would not deal with the eyesore. Certainly they went to their members for these signatures. Clark and Wapiti are not really towns but tiny hamlets. Meeteese maybe has 300 people.

I hope Cody prevails but if the temple HAS to be built there why can’t the church compromise on the spire. Not all temples have spires such as Mesa, Hawaii and Paris. Ostentatiousness seems to be the goal.

Paris ordinances didn't allow for a steeple, because no building can be taller than Versailles. Did the church sue Paris government like they are bullying Cody City right now? No way!! They just complied, even though it took years to find land that were reported to be suitable. Temple site missionaries use that story to illustrate how the church can work with (not against) local governments to build these temples... Add to edit: Paris temple is in the same district as Versailles. That's the reason for that height limit/ordinance. If a building is in that district, the building cannot surpassed the height, in measurement, as the Palace.

WOW!!! Another very informative podcast. Yvonne gave great detail to the layout of the area and better solutions for everyone involved. Too bad the church didn't hire her to be their pr person. Also very sad that the church not only doesn't care about the community but especially how this situation is going to cause great difficulties for the members in the surrounding areas. It's disappointing that members of the church didn't see through this bullying of the church to this community. How can people not see the greed and narcissism of this project. The majority of the members that are temple worthy don't even live there. All this giant eyesore does is give the church a giant free light up billboard to advertise the church. Praying and spreading the word about this to everyone I know. Thank you Rebecca and Landon. Im really loving being informed and strengthen by your programs.

The Catholic church in Utah built a beautiful church between Kimball Junction and Park City that blends in beautifully to the landscape, and mountain setting. The Mormons are so arrogant, and in Russell Nelson's words...Myopic.

My daughter was married there and my son was married at the big white barn on the was in to PC. Both beat my SLC temple marriage 😢 PS the St. Mary’s chapel wedding was the BEST EVER !

As a then Single Adult dating a Canadian, I heard a lot about the Vancouver temple, built in 2010. The person in charge was invited to speak on both sides of the border, and described a difficult process of buying pieces of land that were not for sale, and negotiating compromises from the city of Langley BC. Not sure why Wyoming should be different.

I think another thing to consider when looking at where the church is building all these temples is I believe, that they have housing areas set aside in these buildings for the church leadership to stay with their families when visiting these areas.

Mormon temples are essentially the same. They change up the "artwork" to try and appease the locals for one. Then there is a mormon church built right next to the temple so when they have their open house it's staged from there. They ALWAYS try and coerce, talk, cajole, hoodwink members into retiring near a temple because living as a mormon is all about works. They are brainwashed from an early stage to life is all about the temple. So as a retiree their big goal is to live very near a temple and do their "works" there. And the works? Well that's a whole nether story.

In the 1990s a ward building was built in Julian, California according to town codes matching the historic gold mine town architecture. Population about 6,000. It cost a million back then which was much more than other ward buildings. It was comply or don’t build. It can be done.

The church is not transparent on any numbers so even if they released numbers it would not be active membership. Great question.

There are interviews on Rameumpton Ruminations about behind the scenes of head quarters. In these episodes, the guest pointed out that before Nelson, temples were built according to clear cut criteria such as priesthood holders in the area, etc. With Nelson, there are no rational criteria any more. He builds temples on a whim.

The parts are most likely manufactured by a Mormon-owned company that makes a lot of money from the construction of temples.

As a total different point-Joseph Smith himself would have been ashamed to have a log cabin temple! He wanted to be associated with Roman architectural ideals because they symbolized wealth to him. Wealth= heaven! Whitewalls= heaven! Hwitepeople = heaven! Log cabin= poor people=followers not leaders!

It looks Middle Eastern or Roman. There is what is called National Park Service architecture. Some of the Old Fred Harvey Hotels like the one at Grand Canyon National Park. The El Tovar.

The OKC temple was not wanted by the neighbors, for reasons they anticipated would be problems for their community, like whether the style would be nice enough to blend with the expensive homes that would surround it, traffic, constant noise from ppl coming and going etc. The community lost lawsuit church won. Surprisingly after it was completed the community was pleased and there were no complaints about any of their previous concerns. As a matter of fact they were very pleased because it raised the value of their properties. The members were the only ones with complaints because it was built in the wealthy part of the city which made it burdensome for the south end of the city where the majority of the temple workers would come from. Like most members they just shut their mouth and pretended to be thrilled to take a day trip each time it was their turn to work it. 🤗

This happened in Edmonton, AB, Canada too. People from the neighborhood did not want that lit up spire at night time. A compromise was reached when the church decided to not turn on or leave the light on the spire all night long.

Interesting to know! Funny to hear about all this location obsession in Wyoming considering the Edmonton one is tucked away in a residential area off a freeway. I'd seen the little Moroni and spire peaking out driving the Whitemud a zillion times but didn't know what the neighbourhood was like til earlier this year when I had a work thing at the community league hall across the street.

I was in an accident a three years ago. I was in a haze waking up after surgery in my hospital room. What was that building glowing in my room. In daylight I see it’s the Oakland Temple. Pretty obnoxious how they are flooded with lights

Let's be serious. The lit up temple spire is advertising to back up the LDS church lie that they're fastest growing church. If losses & inactivity rate were honestly acknowledged its a shrinking church. Temples are nothing more than billboards from the community perspective. Also tells non-member locals who has the money & power. Apparently blasting this message to Yellowstone tourists, no park entrance unguarded is the point. Who would Jesus impress with conspicuous temples that will one day be run by contractors with tax free dollars when current baby boomer TBMs fade to black? Those younger who barely stand weekly church won't volunteer for temple duties.

Yeah they put their temple in Helena smack dab in the middle of a residential area that had been there for years. An older residential area. You could tell as trees and shrubbery is very well established. This particular residential area as others in this area of Helena, MT. had a covenant against outside exterior streetlighting. There is NO street lighting there except wait for it......the new Mormon temple. The Mormons came in love bombing them and promises up the gazoo. None of them kept. They were told they would dim the lights. After it was built found out nope on that. Many other broken promises. We talked to many many residents in that area that were furious with the mormons for being lied to. They made alot of enemies in that town also. One of their parting shots is "We'll do better next time"

So help me get the facts straight: 1. The site in the residential area was originally approved for the temple by whom? 2. Once plans for the temple were revealed (when did this happen?) citizens of Cody became concerned. 3. Citizens of Cody recommended the church build the temple in a commercial area but the church sued them over this issue. Is that basically correct?

Year 2021 this started. Slow process. All in open. No protesters in 2021. Nor 2022. Nor in March 2023. Many have showed patience.

It’s typically the interior architecture that is customized to fit location. Exterior is pretty standard among each temple.

We talked to an architect who told us they will pick a theme for the inside like a state flower or something upon which to build the theme around but it still ends up being gaudy chandeliers and flowery draperies. Doesn’t help with the neighbors if the only place you tie to the local culture is inside where they can’t go! Lol. Thanks for pointing that out!

Davis, California has a “light ordnance” that no bright outside lights can be on after 9pm because people like to view stars, planets, etc. and need complete darkness. Even street lights are dimmed.

It’s interesting how different the perspective is depending on who you are. She is very misinformed on many points. The temple is basically tucked away and visible only from one angle from the road for a few feet. This is for worship not for show. Everyone calm down.

I just drove from Layton to Lehi, I saw the temple in Layton, Bountiful, Salt Lake, Jordan River, Daybreak, Draper and once in Utah County Timpanogas and Saratoga Springs all from the freeway. Tell me again how they aren’t for show?

Sadly, the LDS legal threats are having their intended effects. The city looks like it is crumbling under them. If this thing gets built with its "non-101 ft spire" there's going to be trouble, and I mean physical trouble. This town is filled with people with LONG memories, and certain "methods" of handling problems.

If the Mormon Church is building a temple to serve a Godly purpose, they would respect those in the community and place it in another (zoned) area nearby. If the Mormon Church is wanting to build an aesthetic masterpiece for their own attention, then they should continue to fight the people in Cody, Wyoming to place a temple in a cherished neighborhood.

Not mormon but the ai made log temple looks very cosy I’d think the town over there would be more in for that as it suits their environment better. Norwegians have wooden stave churches (ok fine they’re not LDS churches, but it’s cosy and cultural) so why not Cody having a cute log temple? As long as the church members can do what they wish to do inside the building it should be perfectly fine. Not everything has to be marble and stone.

Hmmm! When there wasn’t a permit issued and the Cody PZB denied the permit I bet you weren’t saying that because they had denied the permit it clearly meant the church didn’t comply with the code or the city wouldn’t have denied the permit. The only reason the church has a permit is because they threatened to sue the city into bankruptcy forcing the PZB board to vote in favor of the permit even though they didn’t want to.

what?? where did you get that story? I have been following this the whole time. never denied a permit. the pzb kept tabling the decision until they finally approved it. and it approved as designed because the church withdrew the request for exemption for the steeple, going with the interpretation of the codes (the steeple being unoccupied it has no restriction on height in the codes). Nowhere does it say the permit was ever denied. the mayor withheld it after it was approved but the mayor doesn’t have the authority to deny or veto or whatever you are claiming happened.

I’m grateful my community has had different experience. Did you know? The land on which the new Feather River California Temple sits was sold to the Church of Jesus Christ in the 1970s by Mehar Tumber and his family, who are devout Sikhs. The Church built a stake center on the land 50 years ago. That building has been replaced by the temple. The public is invited to tour this new house of the Lord from Saturday, August 19, through Saturday, September 9, 2023, except Sundays. “I am completely, completely overwhelmed with the beauty of the temple,” said Tumber’s daughter, Raji. She described the temple as “a forever building,” a place that radiates faith. She said she felt her father was present as she walked through the temple and that he is surely “smiling big and so happy” that this holy structure is part of the community.

Sounds like they built it in an area that already housed a large religious building so I’m sure the neighbors looked at the temple as an upgrade. Up until Thomas Monson, this was the case. The new temple locations were based on KPIs just like you described, because the numbers indicate the demand for a temple and the opportunity that the temple is actually used. This is however over with Nelson. He decides on temples on a whim without looking at KPIs.

I live in Cody, went and spoke at the city council meetings on the temple being built. I sympathize with those who fear it being built. But the church went above and beyond to comply with Cody zoning laws. Cody zoning laws state (and this was addressed in the first city council meeting.) that steeples are allowed. The building itself is smaller then what would be allowed to built there. The lightning itself is designed to only light the temple, not the surrounding area using siding on the corners to keep the light reflected on just the temple. (This was not needed to comply with cody zoning laws, but was done out of respect for the area.) As for the amount of traffic, Cody and the surrounding area is small. Nothing like the huge cities in Utah. Temple worship is not like church worship where you will have large crowds gathering at once. Temple worship is individual. And with how small Cody and the surrounding area is, it will be very small amounts of traffic throughout the week.

Temples are better suited in and around residential areas. Temples are central to families and a great focal point to any community. From the photos of the property, doesn’t seem very built up so don’t know what look it’s really changing. I could see if it was being built in the middle of town. Not the outskirts of it.

That is your worldview not the people of Cody’s. To the people in that neighborhood they can’t even go in that building, they can’t go in and see their LDS neighbor married they get to sit outside, to these people it is an urban blight on their natural landscape. There are other views and opinions out there and they should be respected as well. Something the church gives great lip service too but then ignores and sue’s every contrary opinion. Clearly this community is NOT drawn together by this building it has been decisive!

That's what happens when mormon universiities churn out dentists and doctors. They research and help them buy up practices that go up for sale, help or totally float their loans. win/Win for the church and the recent practitioner. Lifelong tithing member and temple worker. I had been in dentistry for over 30 years and saw this start happening a number of years ago. Told many people about it and they just thought I was making it up. It's very hard in our area to find a dentist that isn't a mormon but I did manage.

I grew up in Western towns like Cody. This is a *rural* residential area. It is not suited for a large religious building such as a temple, cathedral, or synagogue. The area here discussed is *meant* to be less developed, to keep the mountainous bluff and area pristine and under-developed. You get a Mormon Temple in a rural residential area, you destroy the chances for families to live in that rural area. Because it essentially ceases to be rural. Their views and protections as a rural neighborhood are destroyed. So, how does that make it a blessing or focal point for those families? It could make it a focal point for resentment, not appreciation (if it hasn't already). The area in report is also likely zoned rural to protect against light pollution. Light pollution is a real concern for a small town like Cody. Light pollution affects not only people, but threatens the health of nocturnal wildlife. Why would the Mormon church place a temple where it really would not serve the people it's meant for- active members who hold Temple Recommends? The current site is likely hours away from the members that would attend it the most frequently (1-3 counties away). Why would the Church continue to push to build a Temple on a building site where it's not wanted or needed?

On August 12th, the Cowboy State Daily newspaper has an article on the Cody temple... "Rowley said it was an eye-opening experience for him and the board to realize that “the process of what city code says in 2023 is different from what it said in 2014.” But he also had additional concerns about the Religious Land Use and Institutionalized Persons Act of 2000, a federal law frequently cited by those who support construction of the temple in Cody. This federal law protects people, houses of worship and other religious institutions from discrimination in zoning and landmarking laws and has been used in arguments by those who support the temple."

The Religious Land Use prohibits discrimination in building codes against churches however there are plenty of zoned areas in Cody where the temple could be built, the church chose to build in a residentially zoned area. The church does No get to ignore zoning rules they still have to follow the zoning for the area they choose to build.

We actually just talked to an architect about this who works on temples and he told us that there’s only one person who makes the Marone statues and with there being so many new temples announced he can’t keep up so they’ve had to get rid of the Moroni on many of the temples. He said there’s nothing more nefarious than that.

We were just relaying what the Cody citizens from Preserving Our Cody Neighborhood had conveyed to us. We would love to explore the LDS perspective too. If the majority of a town would welcome a temple built in a location zoned for a temple, what motivations are there for a group to push building it where it isn’t zoned correctly. Also why wouldn’t it be built in an area where more LDS people live. These are interesting perspectives to explore. Do you have insights into this? We’d love to understand more. Dark skies are a big issue too. We just went through that with the Heber Valley temple. I think many people feel it’s very sad to lose more and more dark sky. I live next door to a temple that is lit much of the night and shines in my windows, so I get it.. My hope is that the Cody temple can be built somewhere that the residents approve of that follows existing zoning and everything can be resolved peacefully.

3 to 1 opposition to temple siting in residential area in Cody says pro-temple folks are over represented. Town should fire planner for waiving height requirement on steeple contrary to code. Variances usually fall to councils not employee planners.

I used to pass through Afton Wyoming on my way home to Montana. Watching the temple being built was so sad . Oversized, ostentatious and overlit. Now another small town will suffer the same fate. IMO temples should be humble looking and appropriate for their surroundings. I’m sad but not surprised.
