@Adil Alfa If the husband got sole control over the house, he should also have been saddled with full responsibility. WV is a "no fault divorce" state (as most are these days), so issues of infidelity most likely didn't come up either way.

@@nickwilliams8302 actually infidelity does play a role in divorces... more so than you let on.. but not on whether the divorce happens or not.. yes most states are no faults.... meaning that regardless of what happened there will be a divorce... No faults were put in place so people did not feel like they were forced to stay married...now back to the point i was explaining... if she had indeed been caught cheating and if he had hard proof of it.. yes the assets and who gets them is then influenced by infidelity. Also if he was deemed as more capable of handling the debt or if he showed she was careless with her money the courts would most likely rule in his favor... now lets not forget that in courts the women are favored heavily... meaning she had to be really messed up to lose.. so that tells me the lady on this video is not telling everything at all.. in fact women are known to manipulate their circumstances to make themselves look like angels. So it is my belief that she is not being forthcoming of the facts.. and since she is not... you can't not take anything said here as advice to work with...

@@Shocke89 Okay, whatever. But the fact remains that in a no-fault divorce jurisdiction, "She cheated on me!" will not affect the settlement. It _may_ affect the child custody arrangements, but that can be a Pyrrhic victory (assuming you care about the emotional well-being of children). I do agree that we have to take anything said by one side in a divorce with a grain of salt (and that goes both ways). My point to Adil Alfa was only that it is preposterous to assert that this woman's outcome was due to any assumed infidelity on her part, due to the nature of the laws in her jurisdiction. No-fault divorce jurisdictions simply do not apply punitive sanctions to parties deemed "at fault". Due to their being "no-fault jurisdictions".

john smith , not so, the settlement was legally agreed upon and each party has the responsibility to get the retained property in their name or sell within a specified time. This does not involve the attorneys.

My mom was in a similar situation 35 years ago. Husband left her with a foreclosing house (and 5 children). Four years later, she had become a teacher and was buying her own house. Even though she had to explain the foreclosure, and had no other credit history (pay cash for everything!), she got the home loan. In the meantime, she has paid off two houses and has a comfortable retirement. These are hard times, but if you can keep your wits about you, work hard and be disciplined, you will be OK!!

I have been in this EXACT situation and went by Dave's advice in this video. Sold the house the day before is was to be auctioned. Praise the LORD for that. My ex abandoned the house and payment completely and I couldn't even find him to sue. I had to crawl, scratch, and bleed to get this house sold!!!!! Never agree to this in a divorce!!!

Once he got the house in the divorce, she should have either taken her name off of it but have them sell it and split the funds immediately. I wouldn’t have moved out of that house if my name was still on it. Period!

What funds? There is only 10k in equity now, less when got divorced. And that's not counting the sales commission you have to pay when you sell. If they wanted to sale house at divorce they would have had to write a check. So they kicked can down the road.

Did you listen to the call? There was an agreement to have her name removed from the mortgage or sell the house. The house won't sell. What else outside of refinancing could be done to remove her name from the mortgage?

"He should have been saddled"....true, and I agree. But her attorney was lazy and didn't do it right. Banks don't get involved in people's relationship problems: that's a psychologist's / therapist's job. Banks focus on getting repaid, and the "jointly and severally liable" clause in every mortgage contract means if you sign for a debt, you owe the debt, even if you give up your ownership rights. As Dave said, that was very foolish. I'm surprised more people aren't suing their divorce attorneys for giving such bad advice.

Always, always force a sale if you and your former partner are both still on the loan payments. If you loved each other enough that you want the other person to have the house, car, etc. then you shouldn't have gotten the divorce in the first place.

What? The house is on the market for 290 and they owe 280, but behind 10,000. the house is behind 150 days (est. 5 months), so about $2000 a month for the mortgage. Its been on the markrt for 8 months. Im assuming they divorced right after purchasing the house.

During my split, I had to refy, take her name off, & work her 1/2 of equity that I owed into the new loan. Fortunately our place isn't worth anywhere near what she's talking about! But still, that guy should've handled this asap!

Wow. We really do pay teachers so low. She teaches 1st graders all day everyday and makes 35k. I make 35k and I don't have a masters degree, which I think you need to teach in my state.

Cowboy, she still has to have a lesson plan every single day aligned with state standards. Anyone in education is not a glorified babysitter. There’s a reason they need a masters degree. And it isn’t to babysit. Teachers deserve a better living wage.

If he's active duty military (since you said he's got a VA loan and making 70k a year, it's a guess), find his chain of command and inform his commander that your ex is failing to meet his financial obligations. Not paying your bills is punishable under The Uniformed Code of Military Justice.

Probonoman it’s very easy. I have my husbands commanders cell phone number for Pete’s sake. Unless she lived in a hole their entire marriage, she has the base numbers, any email will do, text... call.... heck she can even go to the gate and get her message across to the right person. It’s not hard.

They have salaries of 60k and 30k per year and still owe 280k on a house. The "my husband has a lot of debt" line doesn't pass muster. They both live too large. And the fact that she signed a quit claim indicates to me that she was the one who initiated the divorce. She might be justified in it, but she rushed through a process that needs a lot more scrutiny and consideration.

I am assuming there was no down payment. The house was underwater on day one. If you can't put down at least 20% plus closing costs, don't pay a house. Realtor's will say otherwise of course, but then they are commissioned salespeople.

That'd be tough to do. The ex-husband could request that the VA remove her name, but he'd be signing for it all by himself. And on $60k per year income, he probably wouldn't qualify for that big of a loan on his own.

A divorce decree doesn’t take you off the loan and relieve your responsibility. The lender doesn’t care about your divorce decree. Refi or Sell. Period. I used to see these Quit Claims all the time when I worked foreclosures, they are pretty much worthless

In my case, we were upside down and the real estate market was dead. We had a similar arrangement as the caller. I married a decent guy, fortunately, and once property values went up, we amended the divorce agreement to allow him to keep the house and he refinanced to take my name off the mortgage.

Quit claim doesn't take your name off the mortgage, it just takes your name off the deed. Banks won't take your name off the mortgage unless you refinance.

This is typical. Don't pay the mortgage. Send the divorce judgments to all three credit bureaus. You're not responsible for his debt.

She might also be able to go to the judge which signed off on the divorce. And ask him to amend the order so that her name comes off of the mortgage. Because it's his activity that is causing the issue. There are Judges who are perfectly willing to do that.

Give your attorney an option. Agree to do what they advise IF the attorney doesn't mind you going bankrupt and NOT paying them. Get them onboard with doing it the right way.

Dave, I am not sure you are correct. We have had two VA loans and I wasn't allowed to be in the loan portion be I was not the veteran. I could only have my name on the house.

My Florida short sale did not include a deficiency judgment but...wait for it...the bank put the *whole mtg amount* on my credit report, listed as in collections. They got the house back, perfect condition, and resold at a small profit. But then wanted me to pay again - they'd be doubly enriched. My credit is ruined. There is more havoc a bank can start without messing with a deficiency judgment. Be aware -

@P Maitra Amen to that! They are TOO BIG. I use to work for them (my bank was bought out by them). And as an employee trying to help customers with mtg issues, it was a NIGHTMARE. One customer I know of didn't have an escrow acct and was current on their property taxes and ins. They were behind on their mtg pmts. Next thing they know they are forced to pay an escrow pmt, nearly doubling their mtg pmt. BOA (constrictor) ensured the customer couldn't realistically get caught up. They attempted to foreclose on the property. But fortunately they got a good lawyer to help them file Chapter 13 bankruptcy to save their home. (Chapter 7 will NOT save your home in foreclosure, but Ch 13 does). Had more equity in the property than what they owed too. BOA would have made a nice profit off them . . .

@@timothygibney159 Fine print on the mortgage documents. Most people signing a mortgage don't think about the what-ifs so they don't read everything. Or think 'that'll never be an issue'. All the bank had to say is, well, we were concerned they might not keep the taxes and ins current. By forcing an escrow, the property taxes and homeowners ins are spread over 12 months. Which created another problem for the homeowner. The monthly payment kept changing and not just monthly. Sometimes during the month they'd get a new payment amount. And the bank's systems are not programmed to take anything different than the exact payment amount. If it's a penny under, it'll go into a "suspense" account until someone (the homeowner) notices there's an issue with a missing payment. The depts DON'T communicate with each other because the company is too big. My advice to anyone looking to get a mortgage - avoid getting one at all costs. But if you do find yourself going that route - run as fast as you can from the big banks. Go to a local credit union. They are invested in the local community. Big banks tell you they are too. That's why they have overseas call centers.

My ex left me with our 4 kids. I kept the house that we had just moved into 6 months prior. A couple of years later he pushed me into a refinance so that I could “get his name off the mortgage” claiming he wanted to buy a house. Thank God he did that because he had a judgement against him that I knew nothing about and they had put a lien on my home. Seven years later, we are still in a home that only in MY name and he’s still renting. 🤣

VA short sale (we bought one) took 5 months to approve and the loan wasn’t behind. The problem with VA loans is they do dollar down and finance even the closing costs. They are probably upside down.

This happened to a dear friend of mine. Ex didn't refinance to get her name off the mortgage. People...please understand that court decrees mean nothing to your creditors. If your name is on a loan or credit card...stay up to date with it. You can take the offending spouse to court later, but don't go through the hassle of damaging your credit and dealing with this.

How’s the house on the market for 8 months? The usual time it’s takes is about four weeks.. either something else is going on or the house isn’t worth 290k

VA loans defaulted upon simply means you can't get another va loan until the portion they insured is paid back. I can find nothing documented that they ever "Go after you."

This is interesting. My wife has divorce paperwork that says that she is not liable for her former home any more. If it affects her credit, a mortgage company comes after her for money for the house, or she wants to buy a home, she can use the paperwork to remove the negative credit marks, stop the mortgage company in their tracks, or remove the old mortgage from her debt considerations with the new mortgage company.

Well, I suppose that the parties can write into their divorce papers that water flows up hill, but that won't make it happen. All of this is nonsense, as the divorce court has no legal power to effect the rights of the parties' creditors.

My husband & I purchased our home in San Diego before we got married. Bought the house for $160k it's now worth $600K we now can pay cash for houses if we want to, but of course we wouldn't creating wealth is all about leveraging your money. One of the best things we purchased besides the other 2 San Diego properties that we own. We've been married for 24 years. Every case & marriage is different.

Marriage is the only way I would sign any loan with another person. But you have to make sure your marriage is solid. So many people don’t take it seriously or marry for the wrong reasons. You must be willing to commit to that person and that person must be willing to commit to you.

King Koopa. The salary is divided over 12 months. Most teachers take classes or a work an extra job ie house painting. I come from a family of teachers and it is no financial bonanza.

I got a very similar issue with my soon to be ex-wife, we had a LOC on a rental property that has expired, the bank was willing to renew the LOC, but my wife won't sign the documents for the loan, and with the fact we live in Ohio a Dower state, she has too, so the property is delinquent now and killing my credit.

Just sell it if it's that financially draining. Honestly, if I was her, I wouldn't sign a new legally binding contract (most LOCs are usually 15 years) with my soon to be ex either since you are in the process of getting divorced. Who will be getting the rental property? Or will it be sold? Her attorney may have advised her against this for many good reasons. She will be liable if you get the property and were to default on the loan. Even if you get the property in the divorce and never default, it will still show on her credit report as a liability owed. It will still affect her credit score. Being divorced doesn't change that.

@@hildadimarco8154 All good points! Only a fool would refinance a realty mortgage when about to divorce. In most situations it is better to sell the realty, short sale if necessary, and deal with any deficiency debt as an unsecured debt in the divorce distribution. However,they must also look at the tax implications of a sale to make sure all of the potential debt related to the realty is covered in the divorce.

I also don’t feel bad for that family because military loans are at 0 percent and 5 percent down payments. They get a steal for a house up to their entitlement worth. Civilians have to get stuck paying 20 percent down or 10 percent on absurd instances and circumstances. That’s why the VA, is relentless and it is fair the way they handle debt because you get to save tens of thousands up front that no civilian can save.

Medical Opinions don’t be a hater! 🤣🤣🤣 You should have joined the military to get our benefits. Free school while you’re in, using Tuition Assistance. Get paid to go to school, using the GI Bill. Get a VA loan with a lot of breaks and able to use the loan 3 times. Travel for free! Free housing if you live on base or extra money for housing to live off base. Money to eat every month. Then we have sacrifices like deployments. You had your choices in life and we had our choices in life.

I believe there is a VA fee that is tacked into the loan... That 0% down payment is not free.. also they had to serve.

Yup, that Funding Fee of about 2%. Used the va loan twice now.

It's not 0% interest. It's 0 down and you are charged thousands as a fee for the loan. Have had two. The main benefit is being able to get into a house when you don't have a down payment or work history and can't get financed by other means.

Divorce is not up to you. It is up to the person who initiates the divorce, and they can do so for ANY reason or no reason at all. You could objectively be the perfect spouse, and still get divorced.

Divorce attorneys can cost you around $40-100k easy. I’m not sure how someone making 35k gross income per year could afford a legal attorney for divorce. Makes 0 sense.

The problem is the house probably won't sell for what's owed on it so someone either has to come up with the difference or convince the lender to do a short sale. And probably neither party has the income/credit to do a refinance.
