Her first mistake was taking on 2nd & 3rd jobs, that's when the courts up your Child Support payments. I commend her for trying to pay-off debts, but her case is proof sometimes it is more beneficial to declare Bankruptcy over taking on additional jobs to pay down debts.

The breakup of family structure is bad enough but the courts just make it impossible for people to proceed. I had a coworker who had to pay child support to his ex who had primary custody. He had to pay 25% of his gross salary to them and then all payroll deductions and taxes were taken form his 75%. How is that fair at all?

Its not a one size fits all. Is the ex working? Did you have a good lawyer? Was the judge having a bad day? Did his income increase over the years? Does he receive quarterly raises, side income? How many kids? So many factors. Justice is never “fair”

You didn't say how much your co-worker made. Most states have a minimum that must be paid on the 1st child, then a smaller amount for each additional child. For example: if he made $1K/month and the state's minimum for 1st child is $250/month, then that would work out to 25% of his gross monthly income.

The attorney should know that there’s a limit to how much of her paycheck can be garnished and if child support is already being garnished, what more does he think he’s gonna get? Doesn’t sound like he’s a very good attorney or very bright! I once had an attorney bill me for more hours in one day than most people are awake and he told me he woke up in the middle of the night thinking about my case. I’m not paying for your insomnia!

I know this video has probably posted after the fact but I would suggest that you file the bankruptcy before you go to court tomorrow, because I guarantee he already has the paperwork drawn up to act on it and he will serve you notice that same day and possibly take anything you have in the bank.

That's not how it works. With 50/50, child support is usually computed on contributions by both parents. Each parent is assigned a percentage. It appears the mom has more to pay because she is a higher earner. It has nothing to do with her being a bad mother.

This is usually how it is working for the fathers. It's interesting seeing the genders reversed. Usually when a father who owes child support to a mother who does not work and keeps taking him to court files for bankruptcy, the world calls him a dead beat dad.

These type of child support cases are so sad to me. If the custody is split 50/50 then no one should be paying child support. Why should she pay child support for a child she is already supporting 50% of the time. Why should he not have to support his own child? He only has her 50% of the time and then he's getting money for that time. It's such a messed up system.

It was better to be honest from the beginning!!!! She should have told the lawyer from the start my situation is X. People I lived with were not able to pay for s**t and they were going to try to get access but refused to leave when they did not have to money. Imagine if the law had to pay every time everyone ran up bills they could not pay knowing they did not have it to begin with.

She's not going to qualify for a chapter 7 making 65k owing $25k. She will fail the means test and end up on a payment plan. He knows she doesn't qualify for a chapter 7. That's why he's suing her.

I can explain this. My kids mom and I are not together (she is an excellent mom though), so we do 50-50. I make more than she does by a decent amount, so when that happens you need to pay a difference of income to that person. It was kinda hard to get used to, because your financial situation is tied to another person to some degree, but thems the brakes.

Income differences. The parent earning more has the pay the parent earning less. If enough time passes without you paying things don’t go well.

Dave she need to despite the lawyers fee with the bar. Lay her case to the bar they may decide to stop the large fee. I did it won because they saw the lawyerbilled to much and remove the fees

How was he negative with this caller? He treated her with the usual “woman can do no wrong” attitude; if a man called in the same situation, he would never have suggested bankruptcy.

If she from California? Sounds like all the attorneys out here, lol. Between filing for bankruptcy (10k) and paying this attorney (25k), child support would have been way less.

It's a game women usually play... full time student as a career choice. Always stay registered for enough classes and get a check. They don't have to pass the classes... they don't have to ever get a degree. Claim emotional damage as the reason they never graduate.
