People are saying the witness can't remember what happened almost 5 years ago. But the defense attorney can't remember what the witness said 30 minutes prior had and had to be corrected by the court reporter.

I agree! I also noticed that while the witness was crying on stand, having to re-live what most human beings would recognize as a traumatic event, the defendant (murderer) had the same infuriating face as always and didn't seem concerned at all!

He's beyond incompetent and it's like he got his law degree in a raffle! The star witness of the prosecution blatantly lied in contrast to the other independent witnesses. Both were aggressive and Hannah was in majority of the wrong, but the guy rammed her after committing a hit and run, then grabbed a gun being waved around by an unstable idiot. 70% her, 30% him. The prosecution's star witness told ridiculous and obvious lies and the peanut gallery is praising her as credible lol.

The mere fact that she approached a vehicle with a gun in her hand as if she had some authority to stop him is one of several issues she needs to be held accountable for the death of this gentleman! The witness is awesome and and the defense is an AH!

Officers in the line of duty with the right to pull a trigger have shed tears over the fact that someone died due to their actions, no matter what the justification. This is someone with no authority who took a voluntary action, and now someone is dead because of her and she has never once she’d a tear, said sorry or even called his death a tragedy. I see people still haven’t learned from the Ahmaud Arbery case that you can’t take the law into your own hands without consequences. We all have the right to bear arms for our protection but you can’t start a gun fight with an unarmed person and yell self-defense when you’re the person seeking confrontation. She was told adamantly by the dispatcher not to follow him and she refused. In my opinion this is an open and closed case the trial is just a formality based on due process . Citizens arrest in Georgia was ruled unconstitutional after the Arbery case.

He did mischaracterize what Teauna previously said. I certainly caught it and it’s not my job as a casual listener to catch the attorney’s mistakes. But I think he’s just dumb and a terrible lawyer. Maybe it wasn’t tactic, maybe it was… but i don’t know how he would think others wouldn’t catch it and speak up, i.e. the prosecutors.

I hate to see it too. However, this is what a good defense attorney is supposed to do. Poke holes in the testimony and split hairs over the minute details, with the aim of tripping her up, hoping that she will start questioning even her own memory of events (it's a form of gaslighting if you really stop to think about it). Ultimately, his goal is try and poke so many holes that the witness testimony falls flat, thus giving his client the room needed to get a lesser charge, since the jury will likely doubt the witness's flawed version of events. And ultimately, juries make decisions on whether they believe 'without a doubt' witness testimony coupled with hard evidence.

I think the prosecutor mislead the court when in opening statements she said Hannah ran up on this guy for no reason at all. That wasn’t true. She followed him, ran up on him because he had just caused one accident, fled the scene of that accident and was showing signs of impairment which is why she followed him. Also, before he fled the scene of the accident he caused others agreed he was showing signs of some kind of impairment and confusion police taking over 20min to get there, he fled the scene.

I am just now rearing this, why did it take so long to get to trial? His client had a gun she refused to obey the 911 operator who told her not to follow the driver but she was going to do it because she had a gun. She basically was going to do it her way! She is guilty should minded her own business and there was never a reason to pull a gun he was not a threat to her or anyone. She took a man life over a car incident where no one was injured! Why this has taken this long to Make it to court is wrong. If I was his family I would be upset. I bet if the shoe was on the other foot wonder if the outcome would be different?

I watched this defense lawyer's closing argument... He tried to argue that his client was "just a simple, law abiding young woman; trying to 'do the right thing' in a very stressful situation". I just can't see the "simple young woman" described by the lawyer... when I look at Hannah's sullen, defient face. This young witness is far more 'law abiding' - simply stating the truth - in a pretty stressful situation. Kudos to this witness!

They never wavered from their stories, no matter how long they were "interrogated" by the defense💓 They truly are the heroes in this case... They were in the courtroom for Mr. Herring to tell the jury what he couldn't. On the contrary, I think he successfully poked holes in her testimony. Now whether it is significant enough to sway a jury remains to be seen, but every little bit counts. After all, aside from evidence a jury has to make decisions based on testimony and if he can successfully establish doubt as to the accuracy of her version of events then that's a huge win for the defense. Also, if you really peeped his line questioning, he is subtlety attempting to change the narrative from Hannah being the all out aggressor and cornering the victim to the victim having the potential to flee from the conflict or painting the possibility that the victim engaged Hannah even though he had the option to escape. The defense attorney's goal is to mitigate the harshest charge that the prosecution will ultimately ask for. So, reframing the narrative if only a little bit counts and if he can successfully do this, ultimately resulting in a lesser charge as determined by the jury then he's won.

His snide remark “you keep smiling-you find this comical?” We don’t hear the judge’s commentary to him but I’m sure she dressed him down for that comment. That’s why he came back with “no further questions”.

Defense misrepresented what she said over and over. I would have thought it was intentional had he not insisted she said the opposite of what she did - then had court reporter read it back. He lucked out that reporter didn't read back the truly pertinent portion. Witness handled herself with grace and dignity while being bullied and maligned for doing the right thing - bullied and maligned in an effort to protect a vile murderer from the consequences of her actions. I recognize how vital it is that everyone gets effective representation. Sometimes that means treating innocent 3rd parties in disgusting ways. I don't like it, but justice is more important than feelings. However, this is a perfect example of when the bullying itself renders the defense ineffective - thankfully not in a legal sense that could support an appeal. Defense did so much harm to their own case here.

The defense lawyer did a very good job discrediting this witness. He intelligently forced her to admit several lies and exposed her testimony to be unreliable. There was no bullying. It's called cross-examination. When the prosecutor cross-examines defense witnesses later in the trial will you call her aggressive questioning "bullying" too?

As a lawyer, I would say this defense was wholly ineffective with his cross. The witness did not lie. She filled in the things she remembered and credibly said she didn't remember when she was unsure. He got one point for making her walk back the jump the curb deal. However, she rehabbed that when she quite eloquently stated that the scene photos he produced were the aftermath and not to show the actual events. His misstatement about the decedent being able to leave or attempting to insinuate that he was able to position his car in a way that could have potentially hit Payne backfired spectacularly. When the court reporter reread and confirmed as the witness said she did not in fact say what he was mistating she had said, it revealed how desperate he was to muddy the activities of that day. He seems to have a narrative and is trying hard to make the witness facts fit that, but fails miserably. She stood her ground after realizing that he wanted to supplant her recollection with his own narrative. She was excellent. It's an uphill battle from here on in for him and his defendant.

Just look at Hannah's face from the start of trial untill now, doesn't she look like an angry person. A sure candidate for a person with an anger and entitled person.
