How do employers REALLY feel about their employees taking FMLA leave?
The truth is employers HATE workers taking leave under the Family Medical Leave Act.
Covered employees have a legal right to take leave under FMLA for a serious medical condition, but employers are generally not to happy about it.
Actions taken at work against an employee in order to encourage the person not to exercise their right to do so is known as FMLA interference.
Actions taken to discourage the employee from exercising their rights under the FMLA are unlawful, but because employers so dislike employees taking intermittent or continuous medical leave, it happens all the time.
So what should you do as an employee if you are experiencing FMLA interference from your employer?
Document, document, document...
Document everything. Create a written record by emailing HR of the interference actions experienced.
It may resolve the situation, or the situation may escalate.
It's not uncommon to then lose your job over raising the issue and standing up for what you are entitled.
The matter has now escalated from interference to FMLA retaliation.
Your company has taken a negative action in retaliation over your exercising of your medical leave rights under federal law.
If eligible for qualifying medical leave, you are entitled to take it under the law. When your employer interferes with or retaliates against you for doing so, it may be time to take legal action to see justice done.

If I was injured at and fired due to requesting accommodation and workers' compensation, do I have a case for retaliation.

Took FMLA - had extenuating health complications that required longer leave - asked for accommodations - gave me word salad back - then asked my diagnosis’s - and suddenly I was terminated…. Again, terminated with word salad that made it sound immediate but now they claim it was “effective end of this school year” suddenly. I need a freaking tiger that won’t back down from our corrupt surrounding nine county courts but also someone to navigate thru all the complaint filing etc. However, I’m now on month 9 of no income - as a single mom - and have had to live off my grad school loans to make it this long. Been talking with Equipped for Equality and they said I should def do an IDHR complaint but also that I may have more. I see retaliation bc I called out all the falsifications that my HR director made - and I sent it that email to o superintendent which she didn’t like. Denial of accommodations. Wrongful and/or discriminatory termination. And soooo many more! They def screwed up bc I have it all in emails that they sent. E4E agreed. Do you do any cases on pro bono, if they seem winnable? The documentation I am working on gathering is going to become a BIble of their screwups. I’d like to do complaints on sch district and I’d also like to sue/take some form od action against HR Director for her falsifications.

@@Floridaovertimelawyer I mean when an employer hires a firm in my case it’s work partners and they don’t process paperwork, or say they didn’t get it , avoid phone calls . Things like that .
