Cake decorating is an art. It takes HOURS for people to decorate a cake. I mean, I can't be the only person to sit down for one How To Cake It video only to look up and realise it has been 5 hours, right? Well, that's not what today's episode is about. It is actually about Miley Cyrus and that time she stole a cake design. No really. It got me wondering if, like art of other forms, you can copyright a cake design. Such a bizarre part of the claim is that Miley used 'her handwriting' - can you claim copyright to a font that you used, when the font already existed? It's just capital letters printed - how is that part intellectual property?

Yes that's true but you really can't deny how similar it looked. I would have been on the Sweet Feminist's side if it weren't for the fact she asked for compensation only AFTER she sent her message and after Miley's apology. If she did put it in her first message then that would have been okay but now it seems like she just got greedy.

And the hand writing itself looks like a grade schooler did it on top of it. It isn't in any unique style say like how the Disney font is. It's not even in bold, italicized, or even in cursive. It's about as basic as basic a handwriting can get to be honest.

Although there are no laws against eating human parts itself, there is no way to get the body parts legally, as you would have to murder them before or while you are eating them. Therefore it is illegal to be a cannibal as you would have to commit a crime to eat the human. You might want to put research into what your saying before you say it.

9:16 There's a fourth caveat. *_Level of Uniqueness._* A lot of things that people think should/could be copyrighted are not unique enough to be copyrighted, and yeah, the cake in question is not even close. Anyone could emulate this relatively simply. Honestly, as much as copyright gets abused, anything I create goes public domain. Yeah. 'Nuff said.

There's a rule of thumb I used to hear from writing. How likely is it that in a room full of 100 people, 5 of them would be able to come up with the idea. If I wanted to copyright a book about noble space wizards using laser swords and magic to defeat an evil galaxy spanning empire, in 1920 that would be "the only one in the room" and probably copyrightable. After Starwars became a household name, I have to get a LOT deeper than that sentance to start copyrighting it. The point of copyright is supposed to be to protect ideas from being stolen long enough for them to succeed. The more people doing similar works, the more unique (and less protections) that I have get. Political message on cake, is NOT a very unique idea, it's centuries old.

What I love most about this drama is that it clearly shows that it's not about spreading the message, it's not about fighting for a good cause, it's not even for "empowerment". It's all about personal gain, the "feel good" and personal attention.

By contrast, marks & Spencer is currently suing aldi for copying their 'Colin the caterpillar' by claiming that the cake is protected under copyright as Colin is a recognisable character, they're not trying to claim the type of cake as their own, only the similarity of the toppings etc

Honestly kind of suprised Aldi hasn't gotten in trouble with this before since they have made some products that look really similar sometimes even having really similar cereal mascots. Though I do get why M and S went after Aldi for this since the character the cake design and the packaging was almost identical.

My dad had this happen to one of his cakes a few years ago. He made a cake sculpture of a lady with pink hair piled on top of her head that transitioned into a flamingo for a charity event. Two years later another cake artist sumited the exact same design to a competition and won. He rightly put her on blast. He made a FB post with side by side pictures and links to their respective original posts. My dad's friends in the cake art community gave her the stink eye, and when the judges found out, they made her give back the prize money.

Admittedly I've not finished this video yet, but already that sounds like a different set of circumstances. Your dad's cake sounds truly unique, not just use of common language. My friend who's working on the E-Sports team for the school had to change the color of the jerseys because the E-Sports team for the school isn't "official" or "under protection" by the school's trademarked color laws. Yeah, technically illegal but not for you - the store instead. That fanart is technically copyrighted and the original characters from the show are copyrighted. Since the store made money from it, that's infringing on the original creator's copyright.

Within the art world, it gets even more gray because of art appropriation, where the entire point is to use another's work within your own. Most of the time the og artist gets credited, but not always. (note, it is not art stealing, but the incorporation of an existing work into a new one)

Thanks for sharing this with us! ^_^ Have you ever done any videos that fully explain copyright, fair use, fan content, etc.? What sites do you usually look to for that sort of info? And how do you know what sources are most reliable? I've been curious about the topic for a while, but I'm wary of clicking on just any old website for answers.

Particularly when the celebrity probably had almost no involvement in the actual decision or design of the cake. So was probably genuinely surprised and apologetic for having to give credit. And as a result of the whole 'controversy' she got way more promotion anyway than just a mention in the caption.

This is just political propaganda, and as the video points out, the design isn't intricate or original enough to qualify as a piece of art (you may want to consider it art, and that is your interpretation, but legally, it's not an artpiece). Given the political nature of the cake, the message, and the fact you legally don't have any rights upon it (as much rights as you would have putting a BLM pin on your jacket) you would EXPECT the original artist to be happy the message is being shared by an artist with millions of fans all over the world... but apparently money is more important to her than her political ideology- which, when you're talking about how abortion should rightfully be free and available to all individuals, becomes a big fucking yikes.

Agreed. It’s totally reasonable to want credit, especially since the two cakes were so similar and carry a strong political statement. I can’t fault Miley too much because we don’t know how involved she was here. Someone on her team likely created the cake for the picture. She may not have been aware that the cake was inspired by thesweetfeminist, but once she found out, she gave credit where it was due.

To the people who think that they actually have a right to the letter M: in short, no they dont. When it comes to things like a colour palette or in this case a letter, it just means within that market (So with ups brown, another postal company cannot use that same shade of brown) it cannot be used - not that the letter m can't be used at all, but that you can't name YOUR candy ' M, ' 'M's [blank]' or such.
