Here in Australia we are bringing in a "no body no parole" law and if you don't give up the body you serve your entire sentence. It should be everywhere for the poor families who don't have the bodies of their loved ones returned.
I love when people abroad talk about laws in their country. It *could* give lawmakers some ideas that should be done in their own country. That one in particular must be implemented everywhere. Hello from Canada.
While I get the idea having people get the bodies back which is a great idea personally, I think that's way too lenient for the crimes committed on the victims. But hey if it's choice the family wants who am I to stop them.
@@MichaelofWaves it happened after a POS eventually told the family where their son was in an agreement that he wouldn't get prosecuted ever for the crime and he never did. This law was created to stop that ever happening again, you need to be convicted of the murder for the law to take effect
How does someone who killed his sister and served only 10 years for that crime is some how let out to the public??? How does that happen?? The panel board who let him out should be convicted of stupidity and thrown in prison!!
because of 'qualified immunity' In the United States, qualified immunity is a legal principle that grants government officials performing discretionary functions immunity from lawsuits for damages. in the case of Judges,Parole Boards and such when they make a judgement or grant the release of someone and they then commit another crime they can't be held accountable unless mitigating factors are present. i am not sure if every state has this law.
Absolutely, those who let him fee should be hold accountable too. If he was punished by death penalty She would be alive. on the other hand if husband was good enough she wouldn't be on drugs or left to get drunk
Her daughter is so mature and absolutely beautiful. Your mother left you with everything you'll ever need. Stand by your step-father and step-sister. They lost that special person as well. You all share an unbreakable bond. Stay well.
This may sounds cold, but I really like it when the spouse/partner/boyfriend/girlfriend was not the killer. It means to me, that love might still exist and the children didn't lost both parents. When a spouse murdered their wife/husband, their kids lost both their parents, and that, IMO, is the saddest part of these crimes. RIP to the victim and my condolences to her beautiful daughter and husband...🙏
I completely agree with you. It's a odd good feeling like good people are out there. Then, a sad feeling that they lost their spouse/partner. I would be lost.
This case broke my heart. Her poor widower, daughters and other family members. And her remains were never located. Hell is *way* too good for that POS, especially after what he did to his own sister!
UPdate to this case: Smith did later confess to the murder and attempted to lead authorities to the body, but the search of the location he indicated was unsuccessful. He died by suicide in prison and to this day, she has not been found.
I'm completely disgusted that the bar allowed someone to just be passed out, possibly alcohol poisoned, in their place of business and didn't call an ambulance or a cab or something!
We usually ask the patron too leave and if we can call them a cab we will do it. Or get them some coffee. They wont let someone do this or take her keys frim him
I'm sure that Carolyn would be proud to see how well-adjusted and well-spoken her daughter has become despite the pain and grief that she's had to endure. RIP Carolyn.
They had to go to Alaska to find Carolyn's DNA? What about items from her home like her hairbrush, toothbrush, clothes, an unwashed drinking glass, coffee mug, cutlery, or for that matter anything that she'd touched around the home?
I thought about this too. The only thing I can think of is that back then DNA tech was not so advanced, so the personal hygiene items were more contaminated with living material or microorganisms which also have DNA and mitocondria, than the letter.
because they needed a specific type to compare. they were able to prove it was her DNA through saliva. there was no saliva or blood ro compare because there was no body.
Yup.. Why do people drink until they lose control over themselves? many people have marital problems. Unbearable some times. But a person with kids should put the kids first
There should be a law where if a killer is convicted and the body is missing, then the killer gets torture everyday until the body is found. That is going to change some minds real quick.
@@peytonmanning7326 It wouldn't be apply to cases where the conviction was not 100% the right person. We can easily tell which cases are and which cases aren't. Not to mention most of the wrongly convicted were cases of the past where new forensics science were not available. As times go, wrongful conviction would be a thing of the past especially when in the future or possibly even now we will have Artificial Intelligence with satellite surveillance that can track every individual in the entire planet. Whether you like it or not this is inevitable. As soon as any murder is committed, the killer will be caught within an hour because there will be images of his crime and where he is at all times. Of course by then, we wouldn't need this law we would know where the body is.
@@walden6272 you are completely off base on how detectives close cases! In murder investigations most either confess, or someone tells on them. Only a small portion of cases are closed via forensics. So you thinking that just because DNA can be obtained and yada yada yada that is the bona fide go to is completely false. Even more so DNA isn't absolute! Your other comment about tracking and such has merit, but its not 💯 either! The #1 way for investigating etc is cops doing their thing with the other stuff sprinkled in. If a cop thinks a person is guilty they will pressure said person in attempts to obtain a confession. Some times people say anything out of fear or whatever
@@peytonmanning7326 As I said, my law only applies to cases where the killer is without a doubt the killer due to proven forensics, any case that base on simply confessions or circumstantial evidence do not apply. So not hard to understand. This case for example in the video, do you have any doubt he is the killer? No right? So it applies. Time to bring out the torture chamber.
Nowadays it is not good to go out alone … too many bad people out there … I rather be safe than sorry and avoid this type of situations… poor lady .. I hope she is at peace now
They’ll always be bad people waiting & watching for an opportunity to do you wrong. Too many individuals who get angry at their supposed loved ones leave the security of where their at to self sabotage. When your a parent of underage kids it’s not just you in this world anymore “it’s you & your children in this world” you need to be responsible & an example to & for the young people, that’s what you sign up for when you have them. R.I.P. poor lady. Blessings to her family.
this is exactly why if I'm ever gonna drink to excess like that I"LL DO IT AT HOME with my doors LOCKED or if I ABSOLUTELY feel I have to go out, I'll just go down three doors down the street. Don't have to worry about getting home safely if I never left to start with. Plus I can always count on being allowed to crash on the floor of my neighbor's for the night if that's where I happen to be.
I know the feeling when your hubby has a social life while you constantly have to stay home and mind the kids -resentment had set in so she stormed out , went to the bar and met her fate
I wish the family peace and hope they can find more and more healing. In her short time here Carolyn raised a child like Gina - that is a triumph. Can’t help but think she’d be proud.
I wonder if the family ever sued the bar for serving a visibly intoxicated person and allowing her to pass out on a table. That’s illegal in my state and the bartender and owner can be sued.
@@synergisticcollusion134 I was referring to suing back then. I’m 80yo and helped bartend for a friend who owned the bar. Here in Pennsylvania where I live, you’re not allow to serve a physically intoxicated person. Bars here have been sued and lost because of that law. We’re so strict that you can only by liquor in what’s called the State Liquor Store. In fact, we’re the only state in the United States to have such stores. Talk about a monopoly on booze. People keep trying to change the law but it always fails because it’s a money maker for the state since they tax the booze. And now they have closed circuit camera security to protect themselves from lawsuits.
Smith committed suicide in 2003, still without disclosing Carolyn’s body. I hate all the killers in this show, but there are at least some that have the guts to give up body dump sites to give the family closure. Smith is just another one of those meat sacks of wasted air. Gina’s final statement really hit me hard when I first watched it. I don’t cry anymore but I still have a pin in my heart when I hear her statement. No one deserves to go through what Carolyn and her family went through. Carolyn will always be with her children and Dan, and family in spirit.I hope that one day, Carolyn’s body will be recovered. Smith deserves “Dexter’s table”. R.I.P Carolyn Killaby, Patricia Anne Johnson, others who knew them that passed, and Peter Thomas
Maybe she should of stayed home and played mom instead of going out and getting wasted by 10:30pm at night and who goes to a bar alone? Someone looking for action. She is most at fault for this whole thing. Cause/effect
Kudos to the daughter for her comments. It is enough he was living at taxpayers expense. He didn't deserve that much. I hope she has found some comfort, yet the hole he put deep in her heart will always be there. So sad.
He screwed around with the authorities afterwards. Brought them to at least 2 places and nothing at all was found. I doubt he ever actually planned on giving that power up before he checked out.
So he was a convicted murderer and let out. Aaah well the American legal system works again. Unbelievable. Someone needs to be held accountable for this travesty of justice.
Yep I call it the injustice system. It's so unevenly applied and many murderers get out to do the same thing again. While people serve longer sentences for much lesser crimes. 🙄🤦♀️
He wants taco 🌮 bell burritos🌯 and 10 K to let family know where her body is that he killed. He's still calling the shots. I'm happy they didn't give him his way.
I see it the other way. If that's all he wanted then why not give it to him? What's he gonna do with 10K in prison? And it they find out he's lying, take the 10K back.
Of course, if this is a habit, she'll likely take anything you hand her. Vicodin is dangerous w alcohol, but the drunks don't consider death a bad thing. Tho, it's not uncommon for drunk people to be drugged on purpose.
I used to work the night desk at a hotel. At around 2am one night, two guys came in with a young woman. She was from out of town, intoxicated and disoriented (though conscious and able to converse). They brought her in to ask us if she could wait in the safety of our lobby for a taxi. One of the guys had draped his jacket over her shoulders against the cold. This is how it always should be. Why do some men think that an intoxicated woman is pretty much fair game to do whatever they want?? 🤬 So many of these episodes invlove sexual assault. I'm so sick of toxic masculinity.
@@mrsblume3247 Yes its very sad. Some give up too easily and it breaks my heart to see not only the husband/wife broken up but the kids as well. Ecclesiastes 4:9-12 ESV - [9] Two are better than one, because they have a good reward for their toil. [10] For if they fall, one will lift up his fellow. But woe to him who is alone when he falls and has not another to lift him up! [11] Again, if two lie together, they keep warm, but how can one keep warm alone? [12] And though a man might prevail against one who is alone, two will withstand him-a threefold cord is not quickly broken.
I always pee myself a little when they mention "Unsolved Mysteries" in other crime shows, ESPECIALLY FF! Extra bonus for showing Robert Stack. This case was always amongst my top 50 favorite UM segments.
For once in all of the crime documentaries, this young daughter told the truth about jail. Yes it is true that the inmates get free food, clothing, shelter, security, medical facilities, entertainment and more without working a day in their lives. We being honest, humble and hard working people can hardly make the ends meet. So a criminal gets all the benefits for committing a crime.
i agree. there’s no justice in allowing violent criminals to continue to live their lives even in jail. i’m sure jail sucks but it’s still much better than the state they leave their victims in & it’s outrageous that we pay taxes towards caring for these monsters. not to mention we do that only for these idiotic people to parole or release these evil people back into society where they reoffend & cause more innocent lives to be ruined. you’d think the 63% rate of recidivism in violent criminals is enough to start keeping them locked up forever or start using the death penalty in a more effective way but apparently these judges don’t care.
If it was comfortable everyone would do that. You have that same option. If it’s sound good to you, I think you should try it. You may love it, who knows?
@@jordanbreemalloy3586 Does your comment make any sense at all. I am just stating the facts. A criminal gets to live his life for free. Do you know the number of people struggling to get a meal a day, let alone the rest of the necessities. Criminals need to be punished, not rejoiced. Probably you are well off, look from underprivileged people's pov. You will understand what I mean.
@@McBruce999Yes those are the facts. But in sure most people would rather not be in bondage to have those things. Those things are just what we provide human beings to maintain health and mental well being. They have done terrible things and are paying for their crimes.
Love forensic files because they show you what to look out for when a person like the ones in the show are around and tells you there are freak's, sicko's and psycho's around.
Never, ever go to a bar or leave a bar after getting in a fight with your husband/boyfriend/common law/best friends - i have seen multiple episodes where this did not end well.
SPOILER ALERT (I found on web) Post-episode notes: Dennis Smith committed suicide in 2001 after a failed attempt to show officers where her body was, which was never located. I always wonder about cases after watching this show.
😁 Nothing spoiled at all! It’s rather a lovely follow up to his crime spree… Murdering his sister and then murdering this woman. Taxpayers are relieved of his care and one less murderer to be worried about. Win-win for everybody!😻👍
What I meant by "spoiler alert" is that there might be something in my comment that may be giving away something in the video. So a person might want wait until after they watch the video before they read my comment.
The one thing I kept thinking about the whole show because if he didn’t cancel their plan she will still be alive. That’s probably why he didn’t participate in the interview. The guilt will always be with him.
Ladies please please don’t go to bars and make yourself more vulnerable to you already are. The heinous evil horrific killers are waiting in the bars ready to attack. They are merciless animals not humans. So watch out take care of yourself and your kids and value your life. You are leaving your kids to suffer the rest of their lives.
🌈 I will never understand why sodium pentothal is not used to interview convicted criminals. Second, the family never found the victim’s body, but if the killer did as he said, they can be glad that a tree is being nurtured by her body and that the tree is actually a sort of commemorative living monument to the victim. It might be considered a better way to deal with burying any person rather than putting up a big granite tombstone. They can always put a small plaque in the ground with the deceased’s info, if desired.😻
Kudos to the second half of your comments. But Truth Serum is a nasty business....it's not as easy as it looks... a person can simply drop dead or unconscious if the dose calculation isn't accurate or due to any other health issues.
Awe what a sweet daughter you are … Your mama would be so proud of the woman you have become … Even though I do not know you I can just see the kind sensitive person that you are … I’m so sorry for your loss … I am 58 years old and my mom died when I was 23 … although she did not die a violent death and I’m sure there is a big difference between losing someone due to violence over cancer …. It is always such a massive loss to be so young and to lose who in my case was my best friend … I was 23 when she died … at that time I had a 3 year old son … However in my mid 30s I had 2 more kids who she would never get to know and kids who would never know the amazing person she was … I feel your pain my dear not being able to have the love and support of your mom while raising your kids … I can only tell them so much about her but to not have known her it’s hard to truly get across to them the wonderful things about her … like her laugh … her fun and cheeky nature and just the “loving person” she was .. Just how much she would have loved and enjoyed being their grandma … I hope your life has turned out the way you deserved … I am sure your mom has been watching over you all these years … and like I said I’m sure she is so proud of the person you have become …. 🤗 and many blessings from 🇨🇦
give him the burritos for the info but tell him that he'll get the money ONLY after her body's been returned to her family. And then don't give him the $$.
Something they have always been wrong about is how she got from the bar to his truck. It was the bouncer who carried her to his truck for the Dennis guy. They were obviously friends and the bouncer was helping him. I know this because I was there in that parking lot and was talking to that Dennis guy when the bouncer came out with her. I was 15yo and was skateboarding with my friend in the parking lot late that night when I was confronted by the Dennis guy. He was standing in the parking lot and told us we had to leave cause we shouldn't be there skateboarding. I told him no and asked him what he was doing standing around and he said "waiting for his friend" then he starts talking to me about his truck and that's when the bouncer came outside with her and she looked right at me crying and trying to talk. I then said to him is she OK and he said she was just drunk and he was taking her home. The bouncer took her to his truck and Dennis and her left (bouncer went back into omars). She appeared to have been given some sort of drug because she was more than drunk. I remember omars closed shortly after but never heard about her missing and not until I seen this show a few years ago didn't even know all of it. There was no social media and being 15yo I wasn't reading the newspapers. I still remember everything like how that Dennis guy looked and his truck with the writing on the bug guard and the bouncer and her crying trying to talk. I hope he burns in hell for all of the pain he caused her family.
"backbone of the family" addicted to painkillers, going out to a bar alone, getting drunk, damaging her health, risking her life, and depriving her child of a mother.
The writing on the screen doesn't match the video. Obviously it's from another similar program. It's hugely distracting to read one thing and see another. Edit the video and insert the correct text
Its so sad that reward is required. What has the world come to that a simple missing poster doesn't make everyone keep a look out and report what they see. Sad indictment of humanity. 😔
Fyi...cable in prison is not free. You have to pay out your commissary money. There is no pay per view. Lol I wouldnt give him a penny either. I feel bad for the daughter. Shes a cute kid
The killer committed suicide in 2004 so the location of the body will never be reveal. Hopefully the family stay strong. Glad to know the daughter doing better now.
Some Forensic Files just have me shaking my head in disgust at the evil in some people. This was one. I want to tell that sweet daughter that her mom is OKAY. She will never suffer again. She is OKAY.
I found my Mom when I was 14, she committed suicide by drinking pesticide, we lived on a fruit farm. I can honestly feel this young ladies pain she holds.. you will find peace dear
I wonder why people running after committing such horrible crimes. If your bold enough to do so why not be bold enough to face the law as well. Be bold to the end and will salute you.
It's a crying shame that someone could be that drunk and the bar staff didn't do anything to help her they just let her walk away the person that did this should pay but put the blame on the bar STAFF also they should of CUT HER OFF IF SHE WAS THAT DRUNK OR CALLED A TAXI CAB FOR HER SAFETY I'VE BEEN TO LOTS OF BARS THAT CARE ENOUGH TO HELP THOSE WHO GET SO DRUNK THAT THEY CANT HELP THEMSELVES
I know it's "just" an attempt to explain away evidence of sexual assault, but it makes me cringe whenever the murderer insists it was consensual sex. It always comes off like a creepy brag, dragging the victim's name through the mud and claiming her as a conquest when she's no longer able to refuse.
She is passed out and this guy takes her to her car to drive? Then he has consensual sex with this drunk women? Say BS! With morals like Dennis I wouldn’t believe a word he says.
Can only imagine what I would do if someone said they'd tell me where my loved one was for taco bell burritos and money if law enforcement wasn't around.
