It’ll be hard to prove that it was murder due to the fact that they’ll have to prove there was a malicious intent. The prosecutor will probably argue that him threatening to shoot her in the face is proof of malice, but his defense will argue that him threatening her before the shooting occurred was a an attempt to dissuade her from throwing the water. He will likely be found guilty on the lesser charges, but the murder charges will be significantly harder to prove.

And then she tried to use it (with one hand) to protect her head and face, I think she knew that he was determined to shoot her. Especially since he stated exactly where he was going to shoot her, when he was so far away at the time that he couldn't have possibly been threatened by any water. I didn't hear the part where the cop said "go mess with the water". What I heard was him telling his partner that they needed to turn that burner down because the last thing they needed was a fire. And even though she was seated in the couch looking for her I'd, or trying not to, she jumped up and hurried past the other cop. Then instead of just turning the burner off she grabbed the pot of boiling water and while walking towards the cop asked "why are you backing up? And "I rebuke you in the name of Jesus.
