​@@chaosclgSure they did...but a class-action suit would prompt 'discovery' which would issue in a forensic audit of these sleezballs books, revealing just how underhanded and contrived the 'accounting' has been, and how it was designed to NEVER benefit the creators of the product. A contract that was designed to STEAL from its signee can be deemed illegitimate by any corporate lawyer worth her paycheck!

No doubt, and it’s amazing when a label tries to run from their own contract. Usually the other way around if you don’t fulfill it. I hope he gets his money, as it also breaks doors down for other bands as well.

Never been a limp bizkit fan but I’m 100% on Fred’s side. You know it’s serious when Fred is taking action. Labels are always trying to screw artists. They deserve what’s theirs or at the very least UMG should be 100% transparent with everything going on. This just shows they are hiding something

Just like when record company pushing for streaming services and wants physical records to disappear. With streaming artist gets even smaller royalties and the way they count the sales is even more shady and confusing. Its been discussed by Rick Beato .

@@bigjermboktown6976 it's more like they kept telling him this and that and kicking the can, and in the grand scheme of things most acts make their money on the tours over the albums, so it's not usually something they'd put a lot of thought into. Plus 20 years ago artists still kinda needed labels, these days if you have enough stacked you can do everything independent. It's probably not even about the raw cash as it is getting control back over all of the catalog.

I was never into them until a month ago. Saw a live video . “ limp biscuit Maxwell”. Fred was singing and reads a sign a kid was holding. Fred invited him on stage. And Fred somehow orchestrated a rap thing between them. That kept amping and amping up to one of the best performances . It’s odd I can’t stand rap type music But It was his way of on the spot arranging and directing a kid and the band that got that rocked the stadium. He made a dream come true for a kid . And at the end of the Fred. Gives the kids dad a nod. You got to watch it . Let me know what u think. It was the ultimate combo for fans kid Fred band and dad

It's kind of pathetic. The record industry has always been the biggest scam business in the world. Steven Tyler said he never made any money until doing American Idol. Then when MP3's killed the record industry, they started negotiating recording deals where they wanted to take cuts of bands live performance and merch. If any businesses deserve to go out of business it's these huge record companies.

It's true! The "360 deals" where the label gets a cut from EVERYTHING the band makes: ticket sales, merch, etc... I remember a documentary where different artists/bands talked about the contract they signed with their label. Before the digital age, the labels paid (and charged the band) for the CD production but also for shipping. Some CDs always got damaged during shipping, so they also accounted for that loss. Even though they no longer make CDs, a lot of labels still charge the bands for shipping and for "product loss during shipping"! Can you believe that?! This is just one example that I remember but they mentioned a lot of shady things like that. They make a 100 page long contract and somewhere in the middle, they add these clauses, hoping they'll get away with it if no one notices...

Greed destroyed the music industry. Bands like Limp Bizkit were able to become millionaires but they still haven't gotten paid what they earned/deserved. Today great bands, who sell a ton of music and sell out tours need to break up because they can't afford to remain working musicians. Unless you are at the top of the food chain, you can't make a comfortable living as a musician. I'm not really a Limp Bizkit fan (loved the first album, but that's it) but I'm rooting for them. They were the most popular band in the world at one point, there is zero chance they haven't cleared their advance.

I hope Metallica, U2, Linkin Park, and every other superstar artist joins Limp Bizkit or at least watches very closely to what pans out from this lawsuit. If a judge rules in the band's favor it'll open the floodgates to other huge rock and pop acts to have their royalty statements from UMG scrutinized.

I turned down a decent sized record deal with an UMG sub-label after I found out that I would only receive 10% of all my royalties. I said no and 2 weeks later they gave me a counter-offer - 12% of royalties. 😂 The A&R guy who tried to sign me was PISSED when I laughed in his face. 🤷

@@Scyber_Official I have several times in the comments. Scroll. It’s not “10% of your royalties”. They were offering you a royalty rate of 10%. A typical deal back in the day was 13% (13 points) based on wholesale price less returns, free goods, etc. producers usually got 1 of those points Artists get an advance inclusive of the recording budget, which is recoupable out of artist’s share of royalties (not off the top). Tour support, video budget, outside radio promo, etc. were also advanced by the label and recoupable. Bands almost never recouped. If they weren’t successful they couldn’t sell enough records to pay back the advance. If they were successful the label would keep spending more on marketing to push sales… and if it really broke then the artist would renegotiate their advance for the next record. Royalty reporting is always 2 quarters behind, so as a practical matter the label is always advancing successful artists money whether cash advances, renting houses, cars, private jets, etc. pushing back recoupment. Even as the royalty rate was negotiated upwards, the advance cash always outpaced royalties. Royalties really only mattered for heritage/catalog artists that consistently sold back catalog and weren’t making new records. Of course rock bands usually wrote their own songs so they also received their mechanical royalties of approx. $1 per record (75% controlled comp. rate) paid to writer and publisher… how much the artist kept depended on how big of an advance they took on their publishing deal. With Bizkit, Interscope spent huge sums breaking them and gave them an enormous advance ($7M) after their 3 record was a hit… and then they had 3 massively expensive records flop and they were dropped in 2011. They didn’t sell a whole lot of records or rack up a lot of streams for 11 years after later after they did the Lollapalooza reunion show. It’s not like they were ripped off. They were paid a lot of money. It’s also more complicated because they weren’t signed to Interscope… they were signed to Fred’s imprint so there was probably cross collaboration with the other bands - winners and losers - on their imprint.

There is money in it in some respect I'm sure, but to be honest I haven't paid for an album in at least 5 years because I can just watch any of the music I'm into for free on YT. I know a few people who have Spotify subscriptions and buy stuff from Apple Music and whatever, but not many. I suppose they make money from YT views/ads, but I doubt most of them are making a whole lot from that. They probably made a lot more back in the day when people had to actually buy the physical album, but it seems like everyone who signs with a label is getting screwed over. There are independent musicians who are doing great without labels as well. Ryan Upchurch is a good example.

I don’t even understand how any artist post 2010 could sign deals to record labels with the resources available now. Prince has been warning everybody since the 80’s. Hope lots of older bands follow suit with LB and bring the record labels down along with the rest of Hollywood.

The sad part is Fred has always been a champion for people without a voice, the kids who got bullied, the outcasts, and losers. He leaned into that douchebag/frat boy label he was given as part of the act to throw everyone off the fact he's a genuinely cool dude, and just doesn't care what you think of him, but he never deserved all those years of hate. So glad to see them finally getting some true recognition for who they really are. Which is really just a bunch of cool dudes who make awesome music.

@@fleatactical7390 Bands get money in advance, so they can record their albums, make videos and so on. And the artists get royalties after the initial investments the lables made are payed back. So they have money from the advances, merch, tours and such, but they never got any royalties.

They sold millions of records up until 2003. They also took enormous advances after that huge success. Then they had 3 very expensive bombs, were dropped by 2011, and haven’t sold anywhere near enough records in the decade after to come close to recouping. It’s only after the success following Lollapalooza 2 years ago that they’ve had the kind of streaming activity to recoup… and that’s why no one was paying much attention until now. This is a routine audit dispute that will be settled.

The unfortunate reality is that if you try to do anything creative in this world, shitty, talentless, uncreative people will try to take it from you. There is no career in it, the real career is in "managing" it. The salary job with a business degree that leeches everything it can from the contract artists. Bunch of do nothing never beens.

I would gladly pay $20 for a CD again, so the band can make a little money and then when they come into town, I could pay $50 for a ticket. All of these bands want $200 plus for a live show now. It’s just not worth it

Live shows are the only way bands can make a buck nowadays, they also have to pay for the venue, crew, and set out of pocket. The labels no longer put up funds for tours now

I really recommend everyone to watch the documentary *"Artifact"* made by 30 Seconds to Mars. Whether or not you like the band, this is a very interesting documentary that shows what's going on behind the scenes. They show how the label gave the band an advance to record an album, make a few videos, etc... but it's just an advance that the band needs to pay back. Even after selling tons of albums without getting paid a penny, they still owe millions to the label. Then, they get another advance for the next album and afterwards, no matter how well the album sells, now they owe the label even more money and this never ends.

btw, Lars Ulrich did this over 20 years ago, and he was lambasted for having the gall to expect compensation and protection from piracy for music. He was made public enemy #1 for daring to say musician's should get paid for their music - yet, here we are. No one feels they should pay for music today - paying a subscription SERVICE for their music though? That somehow makes more sense. Get'em Fred.

I left the music business after 3 years on the L.A. club circuit back in the early '80s. My band had finally played The Whiskey and was poised to be signed. But rather than approach the band through our manager a certain VIP (and I mean a BIGGIE) in that arena contacted me through the manager. He was offering to be our conduit to (and I quote: "As many offers as you can turn down." But there was a price... Yes. What you are now hearing about the music industry is all true. I was being "courted" which as we now know is a metaphor for "groomed". Yes. It almost happened to me. Getting out of the music business with my sphincter intact is still the best decision I've ever made in my life.

This is why we’re in a stage in life where so many artist are independent now. A lot of these artists don’t need record labels to make a great living off their music. Social media has good and bad things but it’s definitely good for musical artists. People been saying this for years about these record labels and companies like UMG. It’s not always about being famous which is what a lot of these record labels think is we made you famous so we shouldn’t have to pay out what you are actually owed.

Royalties do not bear any expenses, hence the name! The royalties are an agreed upon percentage and it comes right off the top of the gross sales of the product! Prince told the entire music industry at an awards show that they were being scammed by the music elites and he died very shortly afterwards..... The artist does 95% of the work and the record label keeps 95% of the money. Most musicians are not intelligent enough to understand the business and the simple math involved. Prince was smart enough to understand these basic principles and told his fellow musicians in a speech while receiving an award many years ago, I suppose none of them listened. The money is gone...spent on jets, yachts, hookers and blow.....good luck recovering. One of Universals top execs was involved with Diddy!

i'm a bartender. next time i open, i'm leaving the jukebox turned off. $1 for 3 credits, and most songs are 2 credits. they also have lawyers, and scabs that harass small businesses like bars , to get more money for the music industry. groups like ASCAP make small businesses kick up to the music industry, even if you just have some guy with a guitar, doing totally original music. the rabbit hole goes deeper.

Pretty sure you are supposed to get a statement of account if you are in the RED lol This sounds like they are trying to avoid a fraud lawsuit. Most contracts have clauses that allow you to request an audit within a certain timeframe. If that timeframe passes the only reason you would deny a request like this is to cover up fraud.

They (the record companies) do that because when that $1,000,000 is sitting their bank account it's collecting interest and they're making money on it. So the courts make them pay LB the million and they've probably made 10 times that investing, and collecting interest. LB needs to ask for that money too. As the Maxim of Law reminds us: "The money you make using my money is MY money." $200,000,000 is too lenient. I'd go $500,000,000 in a heart beat.

Aspiring bands and musicians literally have a record studio's processing power in a laptop. Most bands know how to mic up their instruments. Record a cut on the laptop. Edit and mix in Pro-tools. Release online through youtube, Amazon and Apple Music.
