Freedom Under Law Challenges Dr. John Hlophe's Nomination. 

The issue of ethics when it comes to Dr J. Hlophe must be weighed against the following to be fair: Is it ethical to have former apartheid MPs serving in the democratic parliament? Is it ethical that Pres Cr17 continues to serve with a cloud of Phalaphala on his head? Is it ethical that State Capture accused MPs continue to serve as MPs despite the SC findings? Is it ethical that MPs serve in portfolios they have no clue about with some of them having no post matric education? Is it ethical for a former convict to serve as an MP? Just asking for a friend.

On what basis do these NGOs think they can override the will of the 14 percent of citizens who voted for the MK to represent them in a constitutional parliament.He is protected by the very same constitution which they purport to safeguard.these hypocrits should be ashamed of themselves.

You are absolutely right about the hypocrisy, but what aboutism is no justification for defence of Hlophe . the fundamental foundation of democracy is the independence of the judiciary and surely any violation of that principle counts as gross misconduct. His impressive academic qualifications are no argument in his defence. In fact they aggravate the position as he should have known better.

President Jacob Zuma makes an accusation against the judiciary of this country, he claims that the law in South Africa has eyes, the laws are applied differently when it is Zuma. Now the DA and those aligned and funded by the Billionaires in this country, these people want us to now operate by subjective morality and opinions. They clearly say the constitution or the rules of parliament do not prevent Dr Hlophe from being an MP and serve in these portfolio committee. However even if that is the case we must now treat Dr Hlophe differently because the white people don't want him to serve. We have people who supported and served in the apartheid government in parliament today, apartheid was declared a crime against humanity by the UN, meaning those who supported it and served in the government which perpetrated it are criminals. However these people some of them arw ministers of correctional services today and no one says its immoral for them to serve in parliament and the executive. The minister of Sports arts and cultur was convicted of breaking the laws of this country and the constitution that he now vowed to protect and serve and he is rightly serving as an MP and a member of the executive because some of the people of this country voted for him to represent their interests and serve the country. But when it come to some people especially those associated with the left and Zuma different rules must apply. It seems true that the law and justice in this country has eyes. We are told by the DA that some NGO will take this matter to court, so NGOs and courts can undermine the will of the electorate? Is this democracy or something else? For the DA it seems like it is democracy and constitutionalism when the outcomes favors them but if the results of a democratic process don't favor them then we change from rule by the people to rule by the markets through the courts. The people are watching and day by day people are beginning to see clearly what is going on here.

He was found guilty of gross misconduct by a competent tribunal. Optics alone he needs to go - it's morally wrong for him to be in there. I'm sure we can find other black people who are very qualified to do the job. We can't be so desperate as to put up with tainted people especially in such important and powerful positions in our country.

A judge should be above such things. So he's as untrustworthy as his master Zuma who ducks and dives at every turn instead of facing the music and trying to prove his own innocence. Talk is cheap - why keep running away? Too many other acting judges don't appear beyond reproach either... who knows? But the people who've voted these guys into our government don't seem to care, and neither do the parties they belong to. I don't approve of unethical people in any form of authority but such are politics eh? This government is SO liberally sprinkled with unethical, even downright criminal individuals, sigh.
