The plaintiff claims the defendant illegally towed his vehicle, and he's suing for the value of the car. The defendant says he was called by the plaintiff's leasing office because the vehicle was parked in someone else's spot. Unfortunately, the car was sent to auction because the plaintiff didn't pay the fee to get it out, but that's not the defendant's fault.

I get why the vehicle was towed, but I do feel bad for the vehicle owner. If you are broke and don't have 500, you aren't going to have 600 the next day or 700 the day after.

Most apartments have signs or an addendum in the lease about getting towed if there’s assigned parking. Based on his inability to take accountability, I bet there were signs posted

Also, if they had the license plate since he is a resident, they should have reached out to him. That is what happens in my complex. They have our plate numbers.

The apartment should know who’s car it is by the permit. Courtesy, they could notify the tenant as easy as calling a tow.

I agree, I find it very petty...to know that's your tenant and he's using a parking spot of an *empty* unit. Noone else is using it so wtf is the problem, I think it's just greed and drama seeking~

It’s the storage fees that get the price up there only cuz tow yards make their money off of accidents and storing the totaled vehicles and the insurance are usually the ones who pay through bill so they do jack the prices up

Lol the defendants know they don’t feel sorry. Tow companies love when situations like this happens because when people can’t afford to pay to get their car back, they get to keep the car and make extra cash by selling the vehicle or auctioning it for parts. It’s their job and they love it. But I have to admit, $500 is a lot for 2 days only.

​, Yes, the tenant moved out, but that doesn't change the rules for him to park in the spot. Maybe the apartment had been rented out to a new tenant that he wasn't aware of. Apartment buildings have parking rules for a reason, it's like JM said. If you can't afford to pay the consequences, don't break the rules. Parking is a big deal in some places, and if he had to park in the street, possibly blocks away because someone was in his spot, he'd have done the same thing. He didn't think the rules applied to him.

I understand the tow but their fees should be criminal. Its ridiculous how much they charge even if it's "stored" for 1 day because they're closed. $370 for a tow is just not okay.

A little compassion goes a long way. The apartment complex should have started with a warning to the plaintiff. A phone call a text. Something on the windshield. Anything. That’s your tenant. Not a stranger. The tow company: take the $300 and move on. Good karma is a thing.

They're running a business. I literally just got my car towed From my apartment complex. We had all been parking wherever we wanted for ever. And as soon as a new tenant came in, he fucked up the whole system but at the end of the day I was parked in a spot that was not mine in. It cost me $730. Because my apartment complex doesn't give you notice. And they don't even have it posted what tow lot they take it to. And I'm literally on disability $600 a month. Still had to pay it still. My fault still can't blame anybody else.

Because the tow company has to follow the rules and law as well . Plaintiff had opportunity to make restitution , but instead he tried to get out of the problem he caused. Don’t like their practices don’t park illegally !

What deal would you suggest? The guy didn't have the money. If they released the car without being paid in full, odds are, they'd never see the remaining money owed. If they held the car until paid in full, they are still storing it for extra days, which equals more money owed. If they don't charge this man for storage, they'd have to accommodate everyone who wanted storage fees waived. They have a business to run. They have to go through tons of paperwork to sell a car that they towed. They sold it for $1,000. That's hardly worth the trouble they went through.

They don't "basically steal" shit. Follow the rules/laws just like eeeveryyybodyyyy else, and your car won't get towed. You realize businesses contract with towing companies and call them to remove the vehicle? So how are they "basically" stealing? Someone calls them for a service. They perform said service, they deserve to be paid. If it isn't paid, they have to sell the car. If people can't afford the tow & storage fees, they need to watch where they park at. This guy knew that exactly what he was doing was against the rules. He just didn't think he got caught. The leasing office caught it, called for a tow. The guy shows up days later and didn't have the money. They held the car for as long as they legally have to. He could've paid to get it out. He didn't. The tow company didn't steal this man's car.

Well, I'm only speaking for my apartment complex. But we don't even have a property manager on-site. But 2 days a week n basically, they just don't give a shit. My building doesn't even take a security deposit which is mine blowing and itself. But I think it's because they just keep expecting to flip Em. As soon as you default on your rent, they're quick to evict u and quick to move someone else in.

@@riggamorrischan he may not have been illegally parked in this case (I was talking in general) but he KNEW HE COULDN'T PARK THERE. Maybe they stickered his car. He didn't check his car until Monday. However, it doesn't matter. He wasn't allowed to park there. All he had to do was talk to management to get a guest parking spot but he didn't want to. So why should they go out of their way but he can't even do the bare minimum?

As long as no one was in need of that spot, I probably would have let it go for as long as a week with a warning on his window to move it immediately. I probably wouldn't tow a car immediately unless a tenant needed that spot.

The plaintiff should’ve asked why the bill was $500 after only two days. If it’s $65/day for storage that accounts for $130, the tow was $370?? That sounds like they were overcharging him to make it where he wasn’t able to get his car back.

Even IF the tow was incorrect, the plaintiff sued the wrong people. The tow company was just doing their job - it was the appt. manager that made the decision to tow the car.

The first day is only 370!!! What why so much? A tow can be 75 to 150 but some states is more, depending on how far and 25 a day storage. Heck, no, they charge 65 a damn day, highway robbery for people like this man who can only afford 300, even if he made it the first day he still would not have afforded it.

I live in Missouri and there's an apartment complex. That's really close to a Starbucks. The Starbucks has like 6 parking spots and the apartment complex has hundreds. But they watch out the windows and wait for people to park in their parking spots and then call a tow truck. If you catch the tow truck before they drive off. You can pay $200 to have them drop it right then if they take it to the tow, what it's 350. I also recently got towed out of my apartment complex. Took me 6 days to figure out where it was, and it caused $730 to get it back. I swear if you can afford a tow truck. It's the best business to get into.😂

I feel for the plaintiff. One time my car for towed at my apartment complex and so did a lot of other cars because our office manager didn’t tell us they were changing our parking stickers. I was soo mad I had to come out of over $200 and I actually live there smh. I tried to reason w/ my office and they wasn’t going. I was pissed because I showed proof that I never got their email and they didn’t care. For this exact reason I’m going to try to move.

Nice scheme. Tow a car, charge storage fees that add up per day. Then seize the car and sell it for a nice profit. And for the slow ones in the room, they didn't actually loose any money by storing the car, so it is all profit. I'd never be able to sleep at night knowing the stress I am causing someone else.

I struggle to feel bad for him because he so freely admits he knew he was wrong and yet still feels entitled to not be in the situation he caused. Though the pricing structure of this tow company should be illegal. It feels more like extortion than a “storage fee” at that price. You can rent a storage place for a month for significantly cheaper than that. Still don’t feel bad for the guy though.

These situations are sort of like legalized extortion. They knew who owned the vehicle and could have contacted him. But that's not the point. The whole situation is designed for the tow company and the property owners to rake in profits. It's designed to allow the tow company to hold your vehicle for ransom. In many of these situations...(maybe not this one) I suspect that the property owners get a cut as well. It is a part of the tow industry that isn't regulated enough. There should be laws that would put a cap on storage fees and fees to release a vehicle. Property owners should also be required to either contact the owner if they are able, or post a 24hr or 48hr warning on the vehicle unless it is in a firelane, blocking traffic or it is in a handicap space.

I mean he supposedly was parked illegally but one should reference what the policy is in the lease about guest parking. I highly doubt it says anything about parking in a vacant apartments designsted place. Either way just way to many average Joes grasping at straws for power (HOA and Apartment Complex Management)

A lot of the times maintenance will park their work vehicles in empty spaces to work on the apartment tied to the empty space. If someone needed to park there to work on the apartment and couldn't then it would make sense why he was towed.

Cnt feel bad fa a grown man who didn't ask fa permission to park in someone else's parkin spot - should of parked it on the street period dot - the plaintiff also needs to lay off the snacks then maybe he'd hav monies needed - health is wealth free game no charge ✌🏾

This happened when new management started at my apartment there are no assigned parking but they made up nonsense reasons to the tow people’s it’s a shake down a scam!
