The "you are trespassed" after they fired her showed they were nasty people. But she could have had some fun with them. Say come get your shirts because I am trespassed so you have to come to me. And no...They do not get to revoke it and then put it back on. There is no trade secrets at that place. Unless it is how they are cheating the books.
@@oldageisdumb My experience is you get what you set the standards at. Have you been to a Chick-fil-A? They hire the exact same "Minimum Wage" employees as Burger King but the employees act totally different, give superb service and seem to respect and enjoy their job at Chick-fil-A.

There’s a sprinkling of ppl in here talking about the ex employee, but most of us get it! Going through 12 ppl in 2 months is NO WAY only because you’re hiring bad employees. And to have that in the contract?! Yea they running that place crazy 😂
agreed!! going through that many employees in such a short time is absolutely the employer and the work environment. i worked all my life, being properly treated and appreciated makes for a good employee!!
Yeah I thought that was strange he didn't seem to have much enthusiasm or knowledge of the very product he was selling in a business he owned. I have also never heard of an employee being asked to sign an agreement BEFORE even taking a job that they would not bash them, that was a big red flag. It IS common for employers to ask employees to sign non-disclosure agreements when receiving severance packages upon termination.

The contract was a red flag and was made to incriminate and ensnare the poor, vulnerable, and uneducated. Once the victims are no longer employed the small business files a lawsuit to line their pockets with bogus complaints against the ex employees. Smh
If they have that much turnover in just a few months then the problem is them, not the employee's. It's amazing the plaintiffs have an NDA but they come to court on national TV to show how awful they are. It sounds like that's how that "business" makes money....not by selling product but by suing their ex-employee's. Maybe that's why the turnover rate is so high.
I've heard from my working grandchildren about how interviews get set up and people don't even show up for those interviews. People are sometimes required to apply for jobs because of benefits they receive or other reasons but they don't really want to work. People also decide to not show up to work or leave during work as they don't really want to be there. I've seen more and more of that the last several years and the lack of taking pride in working and doing their best.

Too many people don't want to have to work for a living and they want a hand out instead. The defendant in this case was out sitting in her car when she was supposed to be inside the store working.
When u have no employees its owners job to cover the store and keep it running you cant sue someone for quitting until you find a replacement thats crazy
If a business has lost 11 employees in a short span of time, it’s the management - not the employees. It doesn’t matter how desperate employees are to work. On the contrary. If you’re hiring folks that are desperate for work and have kids to feed, they’re probably going to work hard NOT to lose this job. It’s a little insulting on JM’s part to assume that it’s the “desperate” employees that are ruining their business. I wonder if she would assume that if this was a Fortune 500 company that lost 11 people in a short time. Come on JM!
Well, I think there's truth to the fact that some people who need a job - any job - ARE desperate, but they have poor employment histories, don't get a lot of offers (usually for a reason), and aren't necessarily a good fit for many environments. And, they've been problems elsewhere, so they'll probably continue to be problems in future employment, which is why you review resumes carefully and ask the right questions and don't ignore red flags when screening potential employees. These people as managers are clearly terrible and not good at selecting the right candidates for the environment, but let's also not pretend everyone's basically a great employee either, and that only bad managers make them bad employees. Some "employees" are toxic and chronically unemployed or underemployed for a reason. They need to hire people who are the right fit for get job - and also pay them enough that they get the quality they expect. I'd be interested to see what their pay scale is like as well as benefits, if any - my guess is it's not very attractive.
One side is a predatory owner who try to get employees to cover business losses. Other side is an employee who left a shift early and was fired 🤷🏾♀️. Doesn’t seem equally toxic
Their NDA is illegal. You can't control anyone's speech beyond them giving proprietary information on your product or business. That's what JM is supposed to be telling them, not rewarding them for their blatant & unconstitutional overreach.

An NDA with an employee is not an unreasonable or unheard of thing. It happens all the time. You can’t have an employee who gets mad at you and tells the future employer, possibly in the same industry, the secrets behind your success. Or, even worse, runs you down. I’m curious as to if you’ve ever actually owned your own business and you were in charge of signing not just the back of a paycheck but signing the front of one also.

I've never seen or heard of a contract written like that. It was super petty & actually sounded unenforceable. Crap talking can be very subjective. At the most I've seen back in my HR days was a contract about employees not sharing their salaries. After hearing that contract for a small biz, that it shows a toxic work environment. Seems like every employee issue that they ever had was updated into their contract. Why would they need to Mahe a rule about employees talking bad amongst each other? Lol. Affidavit is pure fiction. The replacement locks suit should be against Ashley (if at all). The defendant absolutely has an attitude and staying in the car is a reason to fire her, but the plaintiffs are not a victim in this and they can’t keep an employee long for some reason so need to look at themselves. PS why couldn’t the plaintiffs speak to the benefits of CBD oil, the product they’re selling ..curious. Like attracts like yet again
I could be wrong but I was under the impression that the show was no longer shooting new episodes. I'm pretty sure they are just gonna run the older episodes that even if you did watch them you wouldn't remember the specifics. Heck if you know it to be different I'd be happy to hear about it!😃
That’s a bogus azz contract! Why would anybody pay to have locks changed after they were fired? That is apart of the cost when you decide to fire someone.
The employers made a bad hire and it bit them in the ass. When you have employees with the attitude that the defendant has, you know they don't have your business's best interest.
I don't care how boring or slow the store is, no employee should be going to their car for anything other than an emergency. Not to look for money, grab a snack, or anything else. Also, leaving and locking up the business, because her child was ill, is also not acceptable. Someone took her child to the doctor/clinic they should be the one to watch her. She's calling them unprofessional? She left the keys to 2 businesses outside and quit. The Defendant didn't even quit in a half way decent manner. Then the Judge asks why they couldn't hire someone within THREE DAYS?!? What world is she living in? The Defendant is immature and a nightmare of an employee.
@jennifer_mertens Just a FYI. Pretty sure the defendent was NOT the one who left the keys outside. It was the other ex-employee, Ashley. Because they feel it was the defendents fault for Ashley quitting in that manner, she should absorb all the costs. Also plaintiff did admit that she was able to see the store from her car. I wouldn't want anyone to make it a habit their biz sounds very slow & pretty sure there were no customers waiting. Idk her specific issue but I have lost much needed money before therefore I somewhat empathize. BTW usually those types of jobs when you're working by yourself, you do not get a real break.
The defendant is not the one that left the keys outside. That was the second person that quit. And just because someone took her child to the clinic does not mean that they are willing to watch her child as well. She can’t force them to do that. And in those three days that they were without an employee why didn’t one of them go to the store and man it? I get that they have two stores but that’s what good management does when they don’t have enough employees. They don’t seem like they are good employers.
I was against both of them. The defendant mainly because she gave off "I'm a queen vibes" with her stroll in and flipping her hair. The plaintiff...That contract would have made me say no thanks. And it was so geared that they could easily claim all these charges by their saying what you did violated the agreement. And seriously? Trade secrets? I would believe more likely they are doing something shady and think that will protect them, which it won't. Cannot have someone sign an NDA to cover illegal doings...But 11 people? Well 13 now with those last 2. I am betting it is partly because they are hiring 20 somethings which really don't have any work etiquette...But also things they do. And I am definitely sure they are a nasty place to work for...There was no need to trespass her after firing. But then they said she needs to bring the shirts and things to them. Nope...She is trespassed. Tell them you will meet them in a location with people and make the exchange. If they are going to be nasty about a trespass filed...Not going to give them the opportunity to try and slip that in when I bring things to them. And they don't get to set the location. As long as it is a reasonable easily accessible location they would have to come to her to get the shirts...All because they were nasty people and trespassed her.
All this to work at a CBD store that probably doesn’t pay that well. Leave the NDA’s for jobs that pay “extremely well” that would hv been a red flag for me upfront
Considering they trespassed the other employer right after she quit, I'm guessing the reason she had to speak to Ashley was because they probably trespassed her too
