am in uk and a crime / criminal offence here has a victim is it not the same over there...? a legislated offence with no corresponding offence under the law of england & wales here is a service offence applicable only to those they can deceive / force or coerce to consent to being in their service rather than them being our public servants...peace

They are allowed to mute while they talk strategy. I forget why. But, this isn’t the cop’s fault. They are supposed to mute, or the FOIA release would be muted later.

@@toribarron5700 I don't mind being muted after to protect some privacy, but the officer shouldn't get to choose what is recorded. In a perfect world they shouldn't be concerned about what is said because their actions should be honest in all circumstances. It's conspiracy. Police should be like robots, functioning with clear intent and unwavering commitment to excellence. Literally, every time it is done it is deprivation of rights or fraud. Cops have a type of authority which could still retain discretion in most cases but as an arm of the judicial system shouldn't conceal even those moments from the citizens. I dont know how to be more compelling than to emphasize just how wrong it is.

@@gmgunner I agree for the most part. I just see folks make that same comment on so many videos and AFAIK, cops are supposed to mute at certain times. So it is hard for me to be upset at them for following procedure. I agree, the procedure itself is fishy. Audio could be muted later for FOIA requests and it would be good to have uncensored video for all parties when things go wrong.

@@toribarron5700 That's completely untrue. Every public record is subject to FOIA, and the exceptions don't read like, "Uh we think it makes us look bad." Sure, pigs and their keepers TRY this stuff, but it never works. All body cam footage is a public record. Taking steps to keep the record from reaching the public, via muting and such, is at a minimum a violation of their policy, and in some states a crime of conspiracy.

I was a cop for almost 10 years and I've never heard of being able to arrest someone for failing to signal a lane change. That cop is absolutely ridiculous for arresting her. Especially when you can see she signaled in his bodycam footage.

I believe they are interpreting the law incorrectly in this video. Traffic violations are considered “infractions“ in Texas, and therefore are not crimes. All of the laws cited in this video specifically used the word “crime”, when referencing the ability for an officer to make an arrest.

Absolutely. Not just because of her gesture as she drove by, but for their history. This cop physically abused this woman at a storage facility, alleging trespassing, etc. He retaliated then because she challenged him. I'm trying to find the video and link of that encounter.

I mean even if he hadn't, the fact he mentioned the gesture to backup, and she admitted to it when he mentioned it, and then he chose to arrest over a traffic violation that frankly is common af says a lot. Texas and my state (GA) have similar laws regarding traffic infractions/violations. I've been caught speeding, that is considered a criminal offense in GA, only got a citation, and I was super speeding. State law may allow an arrest, no reasonable officer is gonna arrest solely over it though (barring like 20+ over with multiple violations that would become reckless driving). Plus he admitted he was treated her differently because she was who she was.

Yup, happened to my brother n I on the streets. He had a past case and was beefin with the corrupt dept. Alotta aryian brotherhood members were in there. The dept was investigated and a couple were put in jail I think. The rest were all fired. Went back through there a few years back n its all different officers.

'If you had not flicked him off' otherwise known as 'if you didnt choose to express youre freedom of speech' And 'if the officer had done anything wrong in the past he wouldnt be here' instead is 'everything hes done wrong in the past wasnt recorded by our body cameras because we turned them off prior to the wrong doing.' I can understand the audio being muted after the fact, if they are truly discussing something sensitive, but the cop on the scene shouldn't have the ability to mute their cameras. And the cops really shouldn't decide it anyways, even after the fact. It'd become a meme just like the "we've investigated ourselves, and determined we did no wrong" has become.

@@pharynx007maybe mute in the cases of minors, but everyone else should be recorded for their safety. If you’ve ever heard how cops talk when their mics are muted is definitely not professional. Common phrases are “how can we ruin this guys day” or “let’s f$*k him/her over”. At the very least, even more transparency is obviously needed due to the continued abuse of power that many officers continue show. An unmute law combined with the abolishing of qualified immunity would solve many problems

A cop interfering in any way with the function of their body cam should be fined or disciplined automatically, at this point. Unless it's the end of their shift or they're walking into a bathroom, there's zero excuse to shut it off. NOTHING a cop is doing during their shift should be incriminating, so there's zero excuse for them needing to have private conversations away from the eyes of their own auditors.

Scott deserves a D. No way he gets a passing grade from me. a) He not only didn't stop the arrest he is the one who cuffed and stuffed her. b) He didn't discontinue the arrest because it was wrong. He did it to save his buddy. c) He turned off his camera to hide evidence. d) He lectured her at the end saying that exercising her rights will just keep getting her into these situations. Instead he should have lectured his buddy on restraint and professionalism. If he had not done ONE of these then I'd give him a C.

I said this in the original video and I'll say it again. This is the most clear 1A retaliation I've ever seen among thousands of hours of body-worn camera video. He admits multiple times, *and even writes in his report!,* that he arrested her for 'flicking [him] off'. He deserves to have his certification pulled and to never work as a LEO again. His actions were *criminal* in this encounter and he should have his qualified immunity stripped and all damages be paid by him personally.

Right? A LEO should be used to responding to minor insults like this one with indifference and any reasonable adult should be able to make a distinction between a personal grudge and an abuse of power. LEO are human beings, but just like teachers, doctors, judges, etc. they have to be able to separate their personal feelings for an individual with the exercise of their profession. I've seen people acting in offensive manners against nurses and doctors and still they were given proper medical care, although I'm certain there are lots of cases were they aren't.

She did signal, although briefly, when pulling into the right lane--but he was already chasing her by then 3. She did signal the right turn and her turn signal was still on during the altercation.

The Civil Rights Lawyer covered this story a little while ago. Her citation was dismissed, he posted the proof she had obtained. Also he had a copy of the dashboard cam and it clearly showed she DID signal the lane change. 100% retaliation! I want to see a lawsuit ma'am 😊

Right? You can see it briefly on the officer's bodycam near the beginning of this video too.(the dashcam version is much clearer though). This video also clips out the officer's reckless driving while chasing her down too. He did far worse things than "failing to signal" during his pursuit. Swerving into incoming traffic, speeding, illegal right turn from the left lane(while cutting someone off on the right lane too). All for a bogus made-up reason+his feelings getting hurt. This guy should be off the force.

She didn’t signal the lane change going into the left lane. He showed her signal the lane change from the left lane into the right to make it look like the officer was wrong. Not saying it’s something she should go to jail for, but she did commit the violation she was stopped for.

The Constitution does too, as highlighted in the video. Texas doesn't say it's prohibited, but for states that do, it's a state issue. A 4th amendment lawsuit could not be brought against police in any state for an arrest over a traffic ticket.

I remember I was passing my there and was pulled over for passing an emergency vehicle though I was with the flow of traffic, the officer pull out his gun and arrested me towing my truck and never returned my ID so I couldn’t get my truck, took me 2 hours walking to the station and getting the officer to return my ID and got my truck back. @@ChuckDanger What are you talking about? She was wrongly arrested for flipping the thin skinned chooch the bird and his sergeant ended releasing her with an admonishment... he knew the arrest was a blatant abuse of power and tried to mitigate it... not acceptable.

In Texas "cops" are Peace Officers. The main goal to not only keep the peace, but when possible help the peace. The officer, as mature adult, had the opportunity to make peace with this lady. Making peace with her was far more a priority than failing to signal a lane change.

And at the absolute most, the penalty for officers breaking the law and ruining a person's life, for speech, is a city payout. Which leaves you wondering, if this is a routine thing in America, do you even have rights? Seems to me they can circumvent every "right" you have, as often as they like, without penalty. Seems like the courts surreptitiously revoked the constitution LONG ago.

I was threatened with arrest after I had words with 2 cops about my son's death, (and how they were handling it) and the police chief yelled "Arrest Her!" To the other cop and after he snarkily and smugly told me to "Have a nice day," at which, my totally unplanned reaction was to say, "Fuck you!" I ignored him and walked out. The lower level cop followed me out, and i started making a scene while other people were around, saying, "For WHAT?!" "WHAT DID I DO?!" The lower level cop whimped out. He knew they had done me wrong. He knew (probably) that saying that was my freedom of speech.
