@@GovKidMethod but if someone is working under you as an employee that doesn't go towards the 50% correct? so if there is 10 employees for a job and you hire 5 and subcontract 5 to another company but don't physically do any of the work yourself it would be legal or a passthrough?

jj b your employees DO count. You don’t have to do the work literally yourself. It’s your company that has to do the work. And your employee = your company. You don’t have to do anything literally yourself, but as an owner you do have to be the majority party involved in all the day-to-day business operations and management.

GovKidMethod , so im planning on creating a marketing business. Because I have a list of different businesses I market for as a freelancer, an each business i market for provide different recourses. One of the business i market for, has a certain recourse that I found out the government needs... so your saying I can send them a contract through a sub contract , but i will have to do the minimum work. What if it just supplies? How would doing the minimum work apply? To something as simple as providing 10,000 units to the government? But the sub contractor has the 10,0000 unit supply. Also i seen the video, if I negotiated the government contract or bid a contract to be 150k or less , then can I send the whole contract to the sub contractor to do the whole %100 an still get paid for a commission percent agreed with the subcontractor? Is that legal to do? Also thank you for replying!

Hi Jeanna. Thanks for allowing me to clarify. In my story I talk about my boss. I worked for a government contractor small business. I was on the business development team. This was the first contract I won. I won 32 contracts for the business by the end of my time there so I contributed to her wealth lol but all that money did not go to me.

No, we had plenty of markup. This was sole source since no one else could provide it so we had a nice margin in there. We went with our high number expecting to get beat down on the price but they didn’t beat us down.

May I ask what contracts they were or what for? I just can't imagine making that kind of money in one year let alone one month!

Trying to get into this business targeting South America. Did you procure oil or the machinery for the companies?

You can either negotiate paid-when-paid terms with the sub, take advantage of any financing or credit they offer, or you can pay up front. The government would pay net 30 to net 60 on a job like this so they will not pay you until the job is completed, approved, and then invoiced.

Good question! First off, most subs are not registered in SAM, so they are not even eligible to try to go direct to the government. Secondly, I don’t give the exact address until the contract is signed. If they need the address to give you a shipping quote, give them the zip code only. In my experience, most subs don’t want to do business directly with the government. They would prefer to work with a Prime contractor like you. Sometimes you will try to get a quote from a sub and they will tell you they are already bidding it. In this case, you might as well save your time because they are going to be a lower cost than you since they can self-perform the work. I don’t see a whole lot of the situation you describe happening for these reasons. It’s always possible, but not something to keep you from bidding work. Subs traditionally give their numbers out to as many prime contractors as possible to increase their chances of getting the work.

You can incorporate as an LLC or an S-corp most commonly. Wouldn't be bad to bounce the idea off a tax professional. The difference is how you get taxed as your company grows

Yes, you have to give them the information in the quote that they ask for. Breakouts, etc. Make sure the number you give is your TOTAL invoice price, not just your cost.

What are you suggesting?

You just need to make sure you have the NAICS code in your SAM profile when they go to award the contract. If you don’t they can’t award and worse case scenario you could lose it but usually they will let you quickly add it in.
