Hi, I'm currently on a trip for 6 months August - Feb. (5 months and a day before the 6 month period to be exact) and I'm planning to stay for 1-2 more months (so 7-8 months overall if possible). I'm a permanent resident in the US and already completed my 5 year statutory in 2020. I'm planning to apply for my citizenship when I get back to the US this year. My question is, will my 5 year period reset back to 0 and have to redo my 5 years before I can apply for my citizenship again? I have proof that I'm still a resident and I've been and still living in the same house for 5-6 years, have a US bank account, drivers license and will pay my tax when W2 becomes available. Please advise.

Although it doesn't happen very often; The process of renewing a "GREEN CARD" is not an automatic guarantee. Meaning the process can, will and has on various occasion's been denied. In addition, again though it doesn't happen very often. Anyone obtaining U.S.A. citizenship thus becoming naturalized and not being natural citizen of the U.S.A. Is at the discretion of U.S.A. various government agencies, subject to having their status of Naturalization reversed.

You say family re unification especially for spouses is a priority? As things are right now it is not established in fact. In the case of a long time married, yes a distinction should be made for those that have been married 5, 10, 20, 30 years or more and have already u.s. citizen children or adult children, clearly it is a bonafide marriage. In those cases, there is not a need for any interview at all. Many countries allow a spouse of their citizen to enter with a marriage certificate. The marriage is respected and the family is not distressed. There is no waiting or interview. It is an aknowledgement that their citizen has the right to abode with their spouse. If a background check is deemed necessary, I remind you that gun purchase background checks are instantaneous in many cases. All of those administrative barriers that are now present should not apply to u.s. citizens that have obviously a bonafide marriage with a non citizen. What is obvious? They have children together that are u.s. citizens! Hello? And they have been married many many years already . What are the administrative barriers for? It just wastes government time i.e. salaries, paperwork, needless computer records, etc. etc. etc. Time is money and gov. wastes a lot of it in these cases. Some of these very long time marriages, the non u.s. citizen already has been a LPR (long time permanent resident) for many years, has a u.s. issued marriage certificate from many years ago, and has been out of the u.s. more than a few years with their spouse, and simply want to return with their u.s. citizen spouses, children, and family, to their homeland, but noooooo, they have to go through the 'process' as if they had never been to the states, and don't have a bona fine marriage. So again, the distiction is if one has no u.s. citizen children and has not even been married a year or two. These cases may want to treat differently .

When you join the Armed forces with a Green card, you would need to apply for Citizenship as soon as you join in, the Armed forces pay for it and it would take you less than 3 months to get it. However, you must fulfill your contract with the Armed forces and not get expel from them; once they expel you the USCIS will revoke your citizenship due to unable to complete contract. This process was approved by then President George W. Bush through the Executive Order Expedited Naturalization of Aliens and Non-citizen Nationals Serving in An Active-Duty Status During the War on Terrorism in July 2002. I believe there is no problem in getting your pension living outside the US but the problem is you have to live in the US as a green card. if not you will loose your GC and charged you as abandoning it. Then your pension is affected once your GC is revoked. In this case, you can no longer enter the US without a valid green card. Better to be a citizen than a green card because you can live outside the US as you can.

Thank you for the video, it is very useful to me. I have a question. My green card had a typo error made by USCIS and I filled I-90 and applied for replacement of green card. However, after one year, I am still waiting. Online says "please wait" as there are so many applicants. I want to travel during this time urgently to visit a sick relative. I cannot even get an appointment to visit them even though I tried. They keep saying please "wait" for some more time. Do you have any other suggestions please? Is there a way to walk-in and explain?

You're welcome! I am actually not an attorney myself, but I run askellis.com which connects people to experienced immigration lawyers. Take a look at their profiles and feel free to connect with one of them, they would be happy to help you!

Depends if your country accepts dual citizenship or not. If not you remain a green card holder if it does you go for US citizenship
@mnz6324ify
@mnz6324ify 3 года назад
Their is no benefit for having dual citizenship because you can always renounce your US citizenship at the consulate that a person is from, you have to declare any foreign money that you make to the IRS regardless.

Please confirm, can I as permanent resident sponsor my wife to get green card in usa?
@maneeshamukhi
@maneeshamukhi Год назад
Yes, you can, but it takes longer than if you were a U.S. citizen. I did this for my husband many years ago and it took 2 years (may take longer at the moment, processing times change all the time - timeline also depends on her country of birth).

Romanian passport can visit 174 countries without visa. All countries in EU + all Schengen countries not in the EU. But still, Romanians cannot buy apartments on the corner of a table, on a napkin, in a foreign country. Americans can do that. That's a major advantage. Want an apartment (house) in Katanga ? You can buy it. Romanians never even heard about the concept.

Hi Mam. We have completed 5 years as permanent residents in MD, United States. Can you be our mentor to guide us through Naturalization process? I don’t know how difficult it is.

I had a Indian who became a US citizen narrated this news to me re. Green card misuse. An Indian guy, got his US Green Card, due to his brother who became US citizen. Now, this Indian, was least bit interested in working in US & pay taxes. So, every year he used to visit US for 3 months & return back to India. This went on for 3-4 years & 1 fine day, when I arrived in US, the US immigration authorities questioned him, why is he out of US most of the time. He just said " As long as I come back before the deadline date & fulfill my Green Card resident status, there's no issue". The US CBP immediately tore up that US Green card visa on his Indian passport & gave him a 10 yr US visit visa. That Indian guy was stunned! So, anyone thinking of cheating the system, think 10 times.

Maneesha, I am a green card holder and I have been outside the USA for 5 months due to the COVID-19 pandemic. It's unlikely I will be able to return any time soon, what are my options?
@maneeshamukhi
@maneeshamukhi 4 года назад
If it ends up being greater than 6 months but less than a year and you can show the border official you had intent to return or could not return due to extreme circumstances (like no flights from your country to the US), you should be ok. However, I would recommend calling an immigration lawyer to talk through all your options. Check out avvo.com (I am not affiliated with them in any way) - if you need a free consult, you can check the box to see which lawyers offer free consults. Good luck!
