He wasn't banned for long. Although the FIA did ban him, Briatore took them to court in 2009, and the french courts overturned the ban in early 2010. The FIA was going to appeal, but ultimately the matter was settled out of court. Technically he's been free to return to F1 for over a decade, however at the time he did state that he was unlikely to come back to F1.

That could be said for a lot of F1 drivers that have come n gone.... but we all know his downfall is his team play.... AND he's had chances (the way he hard raced Alonso after he help him towards his race win spoke volumes)... he's had his chances
