I'll refer to many Molotov cocktails launched at night and fine the HOA members who survived fines daily until all of the ashes are swept away. It's time everybody got that attitude and we do something about it. Something permanent.

Those people probably had notice after notice after notice after notice of fines and probably just did not care about them until it was too late. If you choose to move in to a neighborhood with an HOA you sign all the legal documents saying you understand how that works what the rules are and what the consequences are. This is a disciplinary action they are taking against these people because they did not listen time and time again just like a small child does not listen you discipline them. No one should step in and help them they are grown adults making adult decisions. If they did not like the rules they should have moved long before this ever happened to them after the hundreds of notices they probably have had in order to get those kinds of fines accumulated.

@@gsxr600rafii Your points are indeed probably all correct. Personally I would never purchase property where these guidelines existed. But 50 homes in one community all being foreclosed by the HOA seemed somewhat excessive to me. Hence my comment about the legislature looking in to the situation.

How about she pay her dues and stop doing the behavior she is getting fined for? How about making some good faith payments. I bet she has one hell of an attitude and has refused to pay anything, basically telling the HOA to f-off. There is always more to these stories and if you are getting foreclosed on by your HOA, it isn't the HOA's fault! She isn't a victim.

The legislators of that would be willing to stand up for us or outnumbered by all the socialists who don't believe in personal property rights so good luck trying to get them to fight for anything especially when one of them specifically said that they're going to rush in communism as quickly as they possibly can by any means necessary and the first thing that b**** did was built a red flag law the way to solve this is to sue the s*** out of those companies and then just sue the government that's the only way that you're going to get to what you want because otherwise they think they're above the law put these people in their f****** place they need to remember that they work for us it's time to remind them

Don't be a bad neighbor. Pay your fees on time and follow the rules. It's not that hard. Here's a better tip, try attending a HOA meeting before you buy. Read the newsletter, ask the neighbors.

I served on the board of an HOA for a number of years and although fines were given for violations, there was never a lien placed on a home nonetheless a foreclosure. And even the fines were severe violations and the board always volunteered to help any homeowner to correct the violation then forgave the fine. We cleaned up properties, mowed lawns, fixed fences, you name it. Maybe the difference is the HOA I was on were all home owners in that community.

I served on an HOA board for 18 years. Usually a reminder was sent, then if ignored, a notice of violation, then if ignored, a fine. But, all this, including all Covenants and Restricticions and Rules are presented to homeowners at closing, by the laws of my state. If a fee or fine is not paid, the first thing we did was determine if there was a financial difficulty such as a job loss, etc. Liens were only used rarely and only for flagrant violations and those who ignored all letters and attempts to contact. These were, of course, the first to complain, but never attended a meeting, never responded to surveys or newsletters, etc.. There are two sides to the HOA story. We usually only hear the bad ones.

Yes they do my first encounter with them was 35 years ago in California. I lived there for a brief time before moving back home. And then they started buying our state and spreading their rules. NEVER BUY A HOME TIED TO AN ASSOCIATION.

This is organized crime. The fines and fees are being levied with the sole intention to deprive people of their homes and equity. 1 or 2 homes every 10-15 years maybe, but 50 in one year? Which boards family members and close business associates are buying these homes? At this point just squat in your own house and force the new owners to rack up the fees and fines, if the police show up it's a civil matter.

I agree. If they are foreclosing on this lady for $8,000 in fees, then they technically own her home and can resell it at fair market value, which is considerably higher. It's a money-making racket for the HOA with their petty "violations" of by-laws. The problem is that basically all newer communities now have HOAs. It's getting very difficult to find properties that don't have them. They definitely need to have more limits put on them.

@@ForeverMPH then she should PAY the fees she legitimately owes. Well before foreclosure, she has had every day to pay her fees/fines. If you at least are trying to make some amount of payment, they wouldn't foreclose. This is nothing more than complete refusal to pay, which means the other home owners will have to carry her burden and have the nuisance of the crap she was getting fined for.

If you want to make sure an HOA doesn't spring up in your neighborhood, start your own and make only one rule: there are no rules. This will prevent any future HOAs from being established.

The HOA's every where are CIA money laundering and dope house operations. When I lived in Arizona, the attorney of record for the operation is Maxwell & Morgan, in Mesa. We had a crack house in Citrus Point, and I went to the DEA in Phoenix and ORDERED them to move it some place else. In 2 weeks the Maricopa County Sheriff came and shut down the crack house. The next day, the PERSON who ran the HOA drove by my home and yelled "you F******. I guess he was unhappy he lost his monthly cut. A month later, he had a HEART ATTACK and died. If you need that sort of help with your HOA, contact me here, I can fix your trouble...I have clout and power...File a FOIA with the CIA about your HOA and the attorney for the HOA. It will come back classified by EXECUTIVE ORDER...

I own a house in GVR & Montbello ... I prefer Montbello per no HOA. My neighbors are great... everyone WORKS, so everyone treats their homes good. Home values carry more bc there is no HOA.... Great selling/renting point these days.

A family member bought a condo once in an H.O.A. and their personal HOA Karen cited them for everything under the sun until they started bribing her with gifts. "We had some extra shrimp from our trip." "Here's some lobsters we couldn't sell." (They were fishermen) When they finally sold it, we all celebrated that that woman was out of their hair. NEVER BUY IN AN HOA!!!

Request an audit of the HOA. Go back to the beginning, following transactions, including where fine money goes then proceed. I suspect upon a forensic audit, you will find embezzlement. File with County and State. Get State Attorney Offices involved. When IRS becomes involved upon discovery of embezzlement, bring feds into it.

My final straw with the HOA was that when I put the house on the market, finally got the buyer to sign it, only to find out that I'm required to get copies of HOA bylaws to the new buyer. The HOA stuck me with a $250 charge for a copy of the bylaws.

I used to work as a guard and Parking Enforcement in HOA neighborhoods. I decided I would NEVER live in a place with HOA and I eventually even quit the security company I was working with because the HOAs Parking Enforcement was so shady and I didn't wanna be apart of it. Bad enough , the residents blame the guards for the HOAs corruption.

I was VP of my HOA for 11 years. I wouldn't wish that on Adolph Hitler!! We weren't tyrants like this outfit, but the petty complaints we would get at all hours of the day/night finally had me sell and move. I will never live in an HOA again!!! No way.

I would never buy in an HOA. Never. I can't imagine someone telling me what color I can paint my house or what I can plant in my yard or anything. They get paid to clear the streets of snow and care for common areas. Nothing else should be allowed. I can see putting a lien on a property so you can't sell unless you pay, but to actually foreclose on your home, that's way beyond the power they should be allowed. I have to wonder though, why she racked up 8k in fines? If you are fool enough to buy in an HOA, you do have to obey the rules and pay the fines.

If the interest on her fine is at some usurious rate, she could rack up $8,000 quite quickly. Maybe she lives on her retirement. Maybe she has medical bills. HOAs don't care if you get old, sick, poor or disabled. Just move, die or something and hand them your house on the way out.

My thoughts exactly! And just exactly WHO polices the HOA? If they can shell out fines, where do you go to challenge their accusations? In other words, if they say your grass is too high and you dispute it, and they decide to fine you anyway with the potential to foreclose on your house, then that reeks of them being judge, jury, and prosecutor all in one. Did she say $8,000? How does that happen? The problem is for some a home outside an HOA is not feasible - aka can't afford a house but can afford an attached home - condo or townhome. I guess all you can do is make sure you don't have any violations and if you do, deal with them right away.

I would NEVER buy property that had a HOA, one of the reason people decide to buy & not rent is so they don’t have to deal with anyone telling them what can or can’t be done with their property. And on top of HOA telling you what you can’t do, you have monthly fees & fines. It makes no sense to buy in HOA community.

Actually, it does in many instances. HOA's rules prevent people from destroying their own properties (and bringing down everyone else's values). My neighbor down the street has a ton of old furniture on his front porch and paint chipping on the house. An HOA would do something about that.

HOA can prevent homes being put on Airbnb and even put a cap on how many homes in neighborhood can rent out. I'm glad for that because renters most of the time don't care about anything and Airbnb's are becoming many people's neighborhood nightmares.

@@teebone2157 Actually, many of the those things can be dealt with by getting the city involved. I've done it before when one of my neighbors had abandoned cars in front of their houses. Nothing wrong with an HOA if you want to live in one, but many of the touted benefits are not worth the hassle, in my opinion.

My family and I have lived in this HOA for almost 18 years now I can say without a shadow of a doubt they are out of control the smallest things on your sidewalk other people's trash you get fines for big b**** about everything and I know they're just trying to keep stuff clean and keep it looking nice but literally every little thing it's ridiculous like I bet you anything this poor lady has like a trash can find and it just got so out of control that this is where it's at now

I live in a an HOA, we have monthly fees that take care of upkeep on the property and buildings, management, insurance, taxes, etc. Some people feel they should not have to pay the fees after agreeing they would when they purchased the property. They want to live off of the backs of the others that pay the fees. A lien can be placed on their property when the amount gets to a certain point as it should be.

I owned a brand new home in GVR, in the middle 90's, LOVE IT THERE, my house backed up to a open area, and a view of the mountains, and we had no HOA, but everyone took care of there property. Then moved to a condo, loved the condo, HATED THE HOA, moved to a new house, NEVER EVER EVER buy a condo or in a HOA area unless you like being a BULLY!!!

My sister use to live at GVR back in the 90s... she loved it. A few years after her divorce, she sold it and they bought a home in Parker... they love it. She said that the news that comes out of GVR is bad and she is so glad she got out when she did!!! Her front yard faced an open field and the mountain backdrop was beautiful.

When I bought my house #1 rule was not to buy one controlled by an HOA. #2 rule not to buy on leased land. #3 rule away from major byways. HOAs are run by people with nothing better to do. Rent can be raised on leased land. Major highways and byways bring in a lot of unsavory people.

Ok so I have a question on this.... How does the mortgage work with that? Is she still paying a mortgage on that house? If not, what happened to the proceeds of all the money she paid out on that house? This is prime example why I would never enter into an HOA... Especially if I own out right, there would be a pile of empty brass and body bag to rob me of my home that I PURCHASED. When you are buying a home, NEVER sign an HOA document.

A good news report would have examined how the homeowner's fines adding up to $8000, not just take her word that it was leaving trash can's outside. Also, a breakdown of why 50 homeowners were being evicted would make sense. Did 49 of these homeowners not pay their dues for the last several years? something that happened in the last year? This was a very incomplete news report--a failure of reporting.

Initiation of Process A director who was elected by the homeowners can only be removed by a vote of the homeowners. Therefore, if the recall and removal of a director is desired, a meeting of the homeowners must be called for the purpose of voting on the proposed removal of such director. Such vote typically occurs at a Special Meeting of the Members called for the purpose of voting on the removal of one or more directors. Pursuant to Section 308 of the Colorado Common Interest Ownership Act (“CCIOA”), a Special Meetings of the Members may be called at the direction of the Association’s President, a majority of the Board of Directors, or by homeowners holding 20% or more of the total votes in the Association (or any lower percentage specified in the Association’s Bylaws). It is important to note that any petition provided by homeowners desiring a recall should indicate that the purpose of the petition is not directly to vote on the removal of a director, but rather to demand that the Association call a Special Meeting for the purpose of allowing homeowners to vote on the proposed recall and removal of a director. Notice In the event a Special Meeting of the Members is called for recall purposes, the notice for such meeting should: Be mailed to all homeowners not less than 10 days or more than 50 days prior to the meeting, and in accordance with the Association’s Bylaws. Be physically posted in the community. Be posted on the Association’s website and emailed to all homeowners who have provided an email address to the Association and requested such electronic notice. Indicate that the purpose of the meeting is to vote upon the proposed recall and removal of the Board and clarify if the entire Board or only specific individual directors will be subject to the removal vote at the meeting. Include a proxy form. Include a clear agenda and outline the process that will occur at the meeting including the process to allow homeowners and directors to address the membership and how any vacancies will be filled if a director is removed. you may not want to dissolve the hoa, but you can put an end to foreclosures and liens and excessive fines. someone is profitting from the foreclosures and its not the people living in the hoa

Voting Requirements The Association’s governing documents, typically the Bylaws, should outline the vote required to recall and removal a director from office. Directors can be removed with or without cause. Section 303(8) of CCIOA provides that a director for a Post-CCIOA community may be removed by a vote of 67% of the homeowners present and voting at the meeting - assuming the Association’s quorum requirements are met. Documents for many Pre-CCIOA communities allow for the removal of directors by a majority vote of a quorum of homeowners. Next Steps After the vote, all parties should recognize that the homeowners have spoken and accept the results. If one or more of the directors are removed, a vote will typically be held at the meeting to elect a replacement director(s). However, as stated above, the replacement process should comply with the requirements of the Association’s Bylaws and be outlined on the agenda that is sent to homeowners along with the meeting notice. This will ensure that everyone is on the same page regarding the process to fill any vacancies resulting from the vote.

@@franke.3098 sometimes all it takes is removing the current board, then changing policies. dissolving an hoa takes steps as well and sometimes there is community property involved (rec centers, pools, etc) so have a plan before you start if your after just changing rules by removing current board or full dissolvement and talk with as many neighbors as you can to find out how many support what your plan is

Just makes everyone keep their front yard clean, also pay for all the landscaping in our master plan community. I was scared at first but our first house wasn’t in an HOA and that was THE WORST people don’t care about others so we made the decision to move somewhere with some type of enforcement plus, waaay safer with all the cameras we have. You really have to look and talk to residents to see if it’s worth it.

I was president of my condo HOA. 119 units. Typically 35% we're not paying their homeowner association fee. Typically leaving us short on our monthly bills. When I tried to straighten the mess out I was mutinied. Kicked off the board. The complex was 36 years old the road was worn out. The association can't take out a loan to fix the road with more than 10% not paying. The pipes under the road were bursting. 5000 10,000 per repair. We didn't have the money to pay. But boy did the residence screem cuz they're water was turned off. Never again, never ever again.

I was told that's my responsibility and I pay for it but they will send a representative to look over my patio before giving permission to replace. That doesn't make sense so I have contacted a attorney to see what my options are. I will never but any home with an hoa again.

Greedy and so wrong. People are struggling to even pay bills and house payments/rent, but HOAs, banks, and landlords are raising prices despite the hardship of covid on families. If I owned an apartment building, I still need to cover the monthly payments but I would cut rent in half, and still be able to pay for the building. People complain about homeless people camping out places, but do nothing to help people stay in their homes.

If you hire a company ro remodel your home and you fail to pay, they can place a lein against you so that when you sell the home, the contractor must be paid out of the proceeds of the sale. The same should apply to the homeowners association. It sounds like this organization is a racket and should be illegal. The fines seem outreagous but there's no way they should just be able to evict you from a home you've paid for.

I've had the misery of living next door to a filthy family whose dogs barked at all hours, weeds taller than 6 foot fence, rats, cock roaches, trash in yard, zero attempts to maintain the property. HOA made little impact. Meanwhile, I paid my monthly fees. When the bank finally took there property back it had to be gutted. When I moved, I went to a stronger HOA enforced community. It's sad that people can't be respectful of their neighbors and follow the rules they bought into. HOA rules are clearly provided prior to purchase. If you don't want to follow, live somewhere else. The fines are to push for compliance, hardly cover legal fees. If the neighbor wants to help out, she could haul her trash can to the back or cut her grass. Half of the story here.
