One of my favorite parts of gun law in Germany: a .22 lr pistol with a 5-round magazine, that's a dangerous semi-auto, you need a reason for it and it goes on the "bad boy" green permit. A .338 Lapua bolt action sniper rifle with a 30x scope, just buy it, it goes on your yellow permit with no further questions asked because it's obviously not dangerous.

@@TacticalTerry you can´t hunt bears in austria. they are protected. only the gouvernment can make special individuals fair game. And there are not that mutch bears in austria to begin with. the biggest game animal is the red deer stag. the biggest dangerous are wild boar.

Honestly doesn't even matter if you support civilian gun ownership, if the constitution says "shall not be infringed" any limitation on ownership is unconstitutional. If that's a good thing or not is a matter of opinion, but whether or not it's constitutional is a fact

12:00 There is one very important thing he missed in the heat of the moment about the category B license: Anyone who does not have a hunting license also needs to pass a psychological check by a psycho-doc who is certified to do that specific check. The intent behind this is to make as sure as possible that obvious (or even a little less obvious) psychos don't get a permit.

Yes, but it doesn't take a lot of effort. The test mainly consists of a few pages of paper with questions, which are then evaluated by the psychologist. The vast majority pass the test the first time.

Here in Switzerland every law abiding Swiss citizen who is at least 18yo has the right to own guns. Category C guns don't require a permit and category B guns are shall issue. We have no limit on how many guns or ammo we can own and we can also own category A stuff like FA guns as a collector and it's very easy to become a collector. FA guns are also cheaper than dirt and we can own modern FA guns too. I personally own a B&T MP9, Glock 18 and a Colt M16A1. 2 things I want to add: 1) Austria is great for bladed weapons, almost nothing is illegal. Love the automatic knives myself. 2) For cathegory C weapons there is a weird thing, if you don't have a "Waffenbesitzkarte" you can't get FMJ ammo for any militarily used calibre. You can't buy FMJ .308, but you could get 7x64 FMJ.

The funniest thing about Austria is you aren't allowed a telescoping baton with a metal tip. So they just make them with a very very hard plastic tip and that's totally legal to carry.

@@Snarlacc no they are exactly the same. All the do is take a normal mental baton, cut the last cm off the end and replace it with hard hard plastic. Typically when you buy one the shop gives you a little bit of paper that gives you the court case reference that says it's legal (that you can give to the police if you get stopped with it).

@@davedavids57 You just said that the tip is plastic instead of steel, so it would hit quite differently. The plasic tip having less mass will have less impact energy. To be clear, I am not defending the law, just saying it makes a lot of difference if there is a heavy metal weight at the tip or not.

@@Snarlacc The only way you are going to believe me is take a look at one next time you're in Austria. It's almost like a thick coat of paint over a hammer. Making the very very tip plastic reduces the mass by about 0.001% and given the plastic doesn't deform on impact it is pretty much exactly the same.

He agrees with many of these restrictions because they work and serve to protect the general public. I know this leads nowhere and telling you this is pointless because probably don't care and just want to own a semi or full auto AR 15 but just take a second and look at the amount of people killed by guns in europe and compare it to the USA. We have way more people and still the USA has a more deaths related to firearms. the nr 1 leading cause of child death in the USA were firearms in 2020. @@micaKTM1290

It’s very interesting that with some pressure of “common sense” reasoning, the authorities in Austria, were able to relatively quickly loosen or abolish most of the ridiculous regulations once pressured , whereas in the US, especially in states like California, New York, etc., the process to undue the tyrannical laws is excruciatingly slow AND we are the ones who have a constitutional right. Sounds like every US politician needs an Austrian course on how to govern…

I think it's part due to the availability. Here in Austria, seeing more than bolt actions, or bolt action rifles is relatively uncommon, because the gun culture here is a lot different and there aren't any really spicy guns on the (legal) market. (There are quite a few fudd type characters who always have all sorts of crazy weaponry locked up in their basements) Whereas in the US I feel like every 4th dude with an FFL has a machine gun or some crazy shit (which is based) so they kinda have to keep the pressure up They should just stop infringing on the 2A though, greetings from across the pond 🇦🇹

@@comradeurod9805 I believe you're a bit confused about what an FFL is. That's the license for firearms stores and manufacturers. It's outside the topic of this video. In some ways the US is actually more restrictive. For example, you might have hear of the $250 tax stamp per item required to buy a silencer. Over a century ago that was effectively "ban", but inflation has changed things. There are also crazy things like where a pistol with a stock, like a Luger, also require that tax stamp. The current time for the government to process the paperwork is about a year. The largest difference is that the way "grandfathered in" items are handled. Outright preventing the sale of any property by an individual is both vastly unpopular and potentially unconstitutional without the government paying for the item. I'm simplifying, but while individuals can own fully automatic firearms, the gun must have been registered with the government before 1986,and they must get one of those tax stamps. They're rare enough that we're talking thousands of dollars for the crappiest fully automatic you have ever seen.

@@comradeurod9805 Considering that the 2A never had anything to do with private citizens having firearms it is a revisionist argument the firearm regulation infringes on the 2A. And we do have quite a bit of the spicy stuff floating around, we just have a far more reasonable attitude when it comes to firearms. (Ich brauch 18 jährige die mit ar-15 ohne jede Ausbildung krieger im wald spielen ungefähr so sehr wie 16 jährige Autofahrer mit einem halben tag training und einem auto ohne pickerl brauch)

Thank god the EU streamlined the process for middle easteners to get the EU citizenship easier in other countries. Now they can easily arm themselves here and destroy Europe faster. "Fellow citizens" my ah. Europe never operated on calling anyone "a citizen" only.

Fun fact about the pump-gun ban: when it was introduced there was a date by which all owners had to surrender their affected guns. One guy turned his gun in late and was promptly punished, you can guess how many people returned their remaining ones after that.

I am a neurosurgeon in Austria and glad to report that in 15 years of practice I never once had to treat a gunshot wound inflicted by other than self in my career. So even without knowing a lot about regulations and laws, it seems to work for the general population here. I always hear dreadful stories when talking to my American or South African colleagues. Heartbreaking, especially when children are involved. Thank you for your clear explanations.

The best thing about Austria is we have far far far less import restrictions than you do in the US. Namely no 922r which means many types of guns never make it to the US. Also you don't have the fantastic Chinese stuff which is super cheap. Also we don't have the NFA so no silly SBR rules for us.

Thank you for an informative review of Austrian gun laws. Really wished that silencers would not be as difficult to acquire. See no need for a wait time of a year, extra costs just to protect your and others hearing while hunting etc.

@@JS-bv9nm Interestingly, that type of thing varies greatly in the US. Being friendly and white in a rural state I'd generally agree with you. However, the police are granted many powers and afforded ludicrous leeway by the court despite there being no national certification or similar. Meaning it's a common career for bullies. It's to the point where our courts have held that police are allowed to administer IQ tests and not hire anyone who scores too high. Plus they're often rewarded for making "busts" and many departments are found to have illegal quotas.

I enjoyed this discussion. The fact that in some ways, Austria has better gun laws than Massachusetts is deeply concerning and really highlights the need to overturn all of this unconstitutional garbage ASAP.

B2w the punishments vor violations of the austrian gun laws, for things like carrying without a license or illegal posession of a gun are pretty mild compared to the US. The maximum prison sentence is either one or two years but if you have no other offences you could get away with a fine or a suspended sentence in most cases. But you can lose your gun rights and it is difficult and takes many years to get them back in such a case.

Regarding the slots, there is a way to kinda legally cheat the system, multiplying your slots by 3. First of all, in Austria, unlike in America, the gun is not the lower receiver. Lower receivers/grips etc are completely unregulated. Barrels, Slides, bolts however, so the parts which withstand pressure are the gun hence regulated. Having that in mind, per slot you have 2 extra slots for extra barrels, extra uppers etc (also known as Wechselsystem=swapping system). So for example you have a 16'' Ar15 taking up one slot buuuut you can have 2 extra uppers for this gun. HERE COMES THE FUN PART: these extra slots are no longer bound to any specific gun. So you can buy any gun where the barrel/slide can be easily taken off and register it on one of those extra slots. So instead of 5 slots, in reality you really have 15. There is a big BUT: those guns on those extra slots must always be taken apart (since they are not registered as full guns). Except at the range where you take your slide and you so happen to have a fitting grip (unregulated, anyone can have it) aaaand you slide it on.

It's similar in Germany where you can have as many barrels/slides as you want for one gun, as long as they are the same, or a smaller caliber as the originally registered gun. So i.e. you have a Sig X5 in .45 ACP and you can get a 9x19 and a .22 lr exchange barrel/slide for that gun as "accessories". They need to be registered, but they don't take up a slot on your permit. Or you can get a 10" Norlite pcc system for a Glock and it still counts as just one Glock pistol. We can't get additional lowers/grips just like that though. They have to be registered, too (although still not as a "gun" but as an essential part of a gun).

Awesome job James, super gemacht Herr Wagner! What a great way to educate people and show the world that Austria is at least somewhat reasonable when it comes to gun laws. Not everything makes sense and is perfect, but we are still fairly fortunate compared to some of our neighbours.

Another thing I might add: no barrel length laws for rifles/pistols. A long gun is defined as a weapon longer than 60cm and a pistol under 60cm. My WBP Jack Mini Wood has a barrel length of like 10'', no problem. A short AR9 pistol with buttstock is just a pistol

Dr. Raoul Wagner is a cool guy. He's intelligent, honest and realistic. Great guy to interview. It would be nice to see him out of the range with James and crew. Great job getting the off-duty police officers the off-duty carry permit. Police officers deal with violent criminals and have run into them when they are off-duty with their families and loved ones. Also, having off-duty police officers take police action if/when there are no on-duty officers around, especially if it is a life threatening situation, is extremely important. It also makes criminals think twice if they know there could be an off-duty officer around that's carrying a firearm.

Great video. Having previously lived in Germany for 16 years, most with the DoD, and 5 years with Frankonia Jagd, and a licensed sport shooter, and reloader. Interesting as to what is going on in the EU today. As far as the US, I do hold a CCW, hunter license, and a C&R FFL. As I started shooting really in Germany, only previous connection was hunter safety class in High School. I only took the CCW as at the time NC required a Pistole purchase Permit, or you needed a CCW, now that I have one I just keep it up to date. As far as the Blaser rifle, Frankonia was one of the major retailers of Blaser when I worked there, it is a fine tool.

Here in Switzerland every law abiding Swiss citizen who is at least 18yo has the right to own guns. Category C guns don't require a permit and category B guns are shall issue. We have no limit on how many guns or ammo we can own and we can also own category A stuff like FA guns as a collector and it's very easy to become a collector. FA guns are also cheaper than dirt and we can own modern FA guns too. I personally own a B&T MP9, Glock 18 and a Colt M16A1. Fun fact: You need a category B license for a 6" revolver but you get a 12" revolver carbine as category C weapon at 18 without any license. Even a version without a buttstock...but that one got a metal bar sticking out at the bottom of the grip to increase total length to 60cm. There is also no SBR BS. You can get the 13" X95 with a category B license and it's considered to be a "pistol" as it is 58.5cm long. That means 20 rounds but I'm not sure whether some bureaucrat checking your guns still might object to that.

Fun fact 2: You need a category B license for a 10/22 but you could pick up a Cheytac M-200 (if it were available) three days after your 18th birthday as a category C gun. If I'm not mistaken, .408 CT is the upper caliber limit (after somebody filed a lawsuit). .50 BMG is category A since it is considered to be "armor piercing".

FYI The pump action shot gun was banned in 1994 after a couple of family tragedies involving this kind of gun. Before it was available without a permit. Interestingly it is now much more easy to obtain a semi automatic shotgun with a gun permit

It's the same in Austria. Just really hard to get. Strangely enough virtually every European nation has some exceptions that allow collectors to have full auto stuff. With very very strict rules though.

The ATF is actively going after privately made receivers and require gunsmiths to etch serial numbers on receivers without serial numbers. Not to mention the online searchable "database" they have and the scanning of paper copies in FFLs. Do you believe there is not a registry in the US?

Yes, every legal firearm is registered, and we're fine with it. Our country wasn't built under the sole premise that the government might try to take our guns (again), so there's no fear of the government trying to take the guns.

A lot of "thank God for the US freedom" people in the comments, criticising Austrian gun law. IT'S YOUR FAULT, TOO, damnit! We had to claw back the rights we have now little by little, since the allied forces who occupied us wouldn't let us have anything at all. And again, it was all because of _that one_ guy who f'd it up for everybody else. So, yeah, thanks for that. Considering from where we started, I think we did a decent job with the current gun law, especially in recent years. So please don't lecture us on freedom, while yours still includes SBRs, 922r compliance, and paying for a tax stamp + waiting for weeks to get permission for every individual suppressor. 😉

2 corrections: minimum length for category C is 92cm. and there were multiple incidents with pumpguns in the mid 90s. till 2019 all shotguns were category D that was combined with C.

Regarding the hunting topic: It does make sense that hunting in central Europe is somewhat limited (at least compared to the US). We don't have those types of wildernesses with tons of free roaming game to hunt. It has to be limited in order not to diminish their numbers too much, as their natural habitat (i.e. 'wilderness') is already so limited.

fun fact about Category A: If a Gun is classified as Category A, all of its parts are classified so. In contrast, for category b and c guns, e.g. the shaft, stock or grip are not restricted. This lead to a friend of mine who owns a deactivated WW1 machine gun (MG07 Schwarzlose) to have to apply for a category A permit for the tripod of the machine MG, as for those old water jacketed guns, the tripod is considered an integral part of the gun itself, while beeing able to freely acquire the deactivated gun itself.

Insurance part is quite interesting. In France it's the same, there's an insurance included in your shooting licence's fee. Even if you reload and you stick varget in your lapua case and you blow your weapon up and injure some guy around you, you won't have any legal repercussions. You're basically covered by the same insurance the other dude is so it will just be insurance paperwork.

It's fascinating to see every different state laws about guns and then you go to other countries. I have a friend from Switzerland and gun laws just be crazy different everywhere. I have another friend from Serbia andthey get wild out there.

Here in Switzerland every law abiding Swiss citizen who is at least 18yo has the right to own guns. Category C guns don't require a permit and category B guns are shall issue. We have no limit on how many guns or ammo we can own and we can also own category A stuff like FA guns as a collector and it's very easy to become a collector. FA guns are also cheaper than dirt and we can own modern FA guns too. I personally own a B&T MP9, Glock 18 and a Colt M16A1. Even as a 2A supporter, I have to admit that some of these laws sound sane and helpful. I can tell with most of them that they have a point beyond pricing out the poor or punishing self-defense. In California or New York, you very well might go to jail for more time than the person who attacked you if you defend yourself. We could reach a good compromise here if the anti-gunners actually wanted safer communities. Instead, they just want to be safe from the people when they abuse their power.

Please do more of these. Excellent work here. Thank you 🙏. It’s nice to connect the culture behind the Glock. For me it was a treat as I was privileged to have served alongside some Austrian soldiers. I had a blast with them, and they made so much fun of our M9’s as they bragged about their Glocks.
