I had cops stand on my porch once for over a hour while other officers were securing a search warrant . They finally arrived with the warrant and then destroyed my front door and roll up door on my garage. It was pretty destructive the way they entered and then placed me in cuffs at gunpoint and then started cutting open my gun safe as well as a floor safe in my bedroom. They were tearing my house up looking for drugs and cash as well as firearms. Finally they discovered they were at the wrong house. I tried to tell them they had the wrong house from the beginning. But they had no interest in the effort required to verify the addresses. I won a judgment of $71 ,891 for damages after a 5 year court battle

I wish law enforcement and the judges could get much more easily removed for this kind of cataclysmic failure. Qualified immunity .. most urgently needs to be significantly scaled back for the people.

Plead your 5 th and 6 th, don’t ask me any questions without my lawyer present. Consent to nothing, then go silent. At that point they have 20 minutes to fool you into talking. Just wait it out.

I was stopped on a highway for speeding and the state trooper asked if I minded if he searched my vehicle. "Of course I do !", I told him a bit resentfully. I think my answer sort of surprised him because I was assertive and didn't hem and haw about it (this was around 1982). When he asked why I minded so much I answered "Because this is America and we have a Constitution, and I swore an oath to protect and defend it (I was in the Army at the time). I was stopped for speeding and now you want to search my vehicle with no crime or warrant, so I do mind if you search it." I don't know how he felt about my words, but I was respectful overall, and didn't swear or cuss him out. He told me about drugs being shipped in cars with out of state plates and then handed me my ticket and I was on my way. He was smiling as he turned and walked away, so it didn't go too badly.

Back in the mid 70's. I did work at the border. I had no idea of protocol so I asked. They told me that I would have to leave my vehical and an agent would take me to the work location. When I got back to my vehical, doors wide open, tools scattered on the ground, pappers were blowing around in the wind, and my car seats were stacked up outside my vehical. I was in shock. They tore my car apart, they did not give explaniation and would not help me put it back together. I was furious. Im here doing work for you and you destroy my car ! I called my boss, he came to the site and said we will never be doing work for them again. He also paid me for the time and parts to put my car back together.

This man is 100% correct about them tearing your car up. When I was 17, I consented to a search, and the officer yanked wires out of my amplifier, breaking the terminals, ripping the wires and RCA cables, flipped my subwoofers over on their face, puncturing one of the foam surrounds on the subwoofer, ultimately ruining it. I called the police department and they asked "did you consent to the search?". That was the end of the it. I consented. I've never consented to another search since then.

Tru Dat. I worked with a guy who had his whole RV torn apart because he gave consent to a search. The cops pulled out everything, found nothing, then left him sitting on the side of the road with a big pile of a mess.

Same thing with a border search. They can tear your whole car up, pulling out seats, spare tire, wheels off, even pull the bumpers off and more. Even if they find nothing they have No Legal Responsibility to put Any of it back together and often just turn over the pile of parts to you with a smile and "you are free to go". Yea, in what now?

I was stopped while carrying here in NH and the officer asked if I was armed. I told him I was, what I was carrying and where, and told him I would comply with however he wanted to handle things. he smiled and said, "how about you don't show me yours and I won't have to show you mine?" I agreed. Verbal warning for speeding, no muss, no fuss.

Same. I work Search and Rescue and have a CCW permit, and if I'm working a crime scene or formally sanctioned search with law enforcement present, I just let them know I'm carrying for safety, and no one cares. Even if they did, I'm fine with showing my weapons. I train and handle working dogs, and those you can see plainly. I don't see the difference. In a traffic stop, the first thing I say is that the dog loose in the back end is trained to prevent him from reaching his arm into the vehicle, and then that I am carrying.

@@jason200912 I've yet to have anyone that actually asked. Like OP said, I tell them the type of weapon and where it's located on my body, and they don't follow through. Granted, I am a small woman, and I don't look like much of a threat. Also, I carry my revolver with me backpacking and on wilderness searches, so it's used to rain, ice, snow, etc exposure; I just maintain it accordingly. 😅

I was pulled over by a Missouri State Trooper because I was speeding. I had two 9MM with me one on the passenger seat and one in my cup holder in the center console. He never batted an eye, said I always encourage people to carry, then took my license registration and insurance to his car and never mentioned the pistols or asked me to get out but I just left my hands on the steering wheel. He returned my things, said have a nice day but please slow down. Had this happened in my home State on kommiefornia, I would have been arrested on the spot. I love rural Missouri.

Back in 86 , I was 16. I would drive 40 miles one way to work at night to work. This was in Harris county Texas. My oldest brother advised me to carry his 45acp. I was pulled over one night by Texas DPS trooper for a tail light that was going on and off. He saw the 1911 on my seat and asked to have a look at it. He cleared it, then felt the trigger pull weight ( obviously he was a 1911 enthusiast) he asked me why I carry it when I'm only 16. I told him how I have this long drive to Conroe to work and it's always at night. He wrote me a warning for the tail light, loaded my 45 back up handed it to me , and said be safe out there tonight. I❤️ Texas.

The point is a conspiracy against someone intentionally by the government is illegal and a violation o f rights. In the south they had whole towns ---business owners, sheriffs, judges, police, state and federal troopers that ALL BELIEVED in slavery from top to bottom of thought. That does not make them right and often you can find the wrong going way to far. It is a condition of people and just because their is more than 1 person or officer in their agreement does not make them right. You do have the right to speak ----and for it to be interpreted correctly and you also have the right to remain silent if you choose to for whatever reason including your own safety. From a deputy’s perspective, I really appreciate the way y’all give information. You’re not saying all officers are bad people and you always stress people stay calm and respectful. I know defense attorneys are not the most popular with a lot of officers but more of us are not threatened by this information because we respectfully do our jobs. I’m not in Texas but just like the manner in which you are giving information.

NOTE about CONSENTING to search your car: I’ve heard of case where owner sued Police for damaging his car while they were searching it. The judge responded with “You gave up your rights when you consented to the search of your vehicle so you can’t sue for damages”. So that's another reason not to give a consent.

And the Police are under no obligation to restore your vehicle to "pre-search" condition. They can, and do, leave it just like they made it, seats out, seat covers off, compartments emptied, etc.

Happened to a friend, friend got stopped supposedly for going a little fast, Officer asked where friend going in such a hurry, friend said I need to get my pot home, officer completely shut friend down from further explanation and commenced with a thorough search of vehicle , friend remained quiet 😂only to find NOTHING! Friend had potting soil! The Officer only heard pot! My friend is an Attorney!

Take me to Jail and I will have my case heard in Court. I will be found NOT GUILTY. That is the bottom line. Jeff makes excellent advice, be calm, cool and exercise your rights. It’s funny that this lawyer is educating people on their rights. When you should have learned that in school! I’m 72 years old and still remember lessons on US History. I also carry a pocket constitution in my car, containing the Declaration of Independence, the Constitution, and the bill of rights. I also have several copies of same at my home which I regularly pick up and read through. In addition to this I’ve spent the past 5 years studying Constitutional law, and court rulings on certain topics. I also research USC the most common ones that relates to criminal actions by government servants. Examples would be 18 USC 241 & 242 (under color of law and conspiracy under color of law). It’s been nearly 20 years since I was last stopped by police, guess I’m a better driver than I give myself credit for. However, if I am ever stopped for any reason I know my rights and can stand on them. If my rights are violated the officer will find himself facing me in court, I have no need for a lawyer as I’m quite capable of defending myself. Depending on the extent of the violation of my civil rights he will loose his qualified immunity and find himself in Federal court and facing a massive law suit. You violate my rights and I’ll take your cars, your 4 wheel drive pickup, your bass boat, and even your damn house. Where I will leave your wife and kids standing on the street homeless, and I won’t even shed a tear! It seems the only way police will learn to respect our Constitutional rights and express basic human decency is by taking everything they own and making it so their policing career is over. Then the lesson will be learned by his fellow officers.

That's a hard sell -- if door is open, they may present you from shutting it, and callng a Sherriff/Lawyer WHILE in a stop situation would only be an aggravation. I'd like to know what Esq. Jeff thinks about making declarations on 2A rights, even 6A rights, and asking for the officer to call for a Sherriff (or PD if the Sherriff conducted the stop). It's like I've seen many times, folks demand the officer to provide their name/badge, and request for a supervisor (makes sense if you're a woman and don't want to be searched by a man, etc.)

What you forgot to mention is the logic behind the "consent to search" question. If they ASK for consent to search it means they DO NOT have probable cause to search.

Being aware is the vital first step but being willing to stand up for them is the vital second step. Its one thing to know a cop is violating your rights, it's another to stand up to them. A comment above is from a guy that had his rights violated while he got some restitution in the end, it cost him five years of court and grief. In the states I travel to, as a CWP holder, I am required to state that I am carrying at the point he asks for ID. Never had a problem. Funny thing, a traffic stop in Florence, AZ, the cop stated that city policy required him to take my gun until the stop was over. I carried a 1911 cocked and locked. He struggled with it for 8 minutes before his supervisor showed up. He wrestled with it "trying to make it safe". When they finally got the actoin open, the chambered round fell onto the floor of the cruiser. After a warning for speeding, which I was doing, they returned the cleared gun and magazine. Several days later, I heard from a friend who lived there that the cop who stopped me was in trouble for having "unaccounted for ammo" in his car.

The outcome with the unaccounted for ammo is funny! That said, I am concerned about inquiries on guns, or weapons, when I am traveling about. I'm retired and accumulated various guns over the years, which a several ownerships prior to my possessions. I transport custom pistols and rifles of significant value and worry about any Officer ever stating, "well, I got to check these to see if they're stolen?" I;ve started carrying the purchase receipt for the very common pistol I now carry for self defense; that's how nervous Offical overstep concerns me!

A gun threat was reported at my daughter's elementary school. My daughter was named as part of the group walking during PE when this was "supposedly" said. The city police showed up at my house and demanded to see my guns and said that my daughter couldn't come back to school until they saw them. Turns out after speaking to all parties involved it never happened and was all over jealousy about a boy and my daughter had absolutely nothing to do with the conversation.

So this is a case of being "Swatted" right? Tell us more. I can see where the police could claim exigent circumstances to gain access but by the same token, the police visit is based on hearsay. So it comes down to whether the cops have the nerve to push it and possibly force the door. Very dangerous situation to be sure.

You give the officer your id and insurance and refuse any small talk with the officer. Be polite but you don't want to chit chat. Refuse to answer questions. Refuse searches. If they don't back off ask for an attorney. Once you request an attorney they legally cant continue questioning you until an attorney is privided.

It's very disturbing that in this country, after more than 250 years, it is very easy for any police officer to find a 'legal' way in which to physically assault any citizen and justify it in court. Unless you stand like a statue you are subject to any punishment they want to inflict on you. Scary.

I took a Criminal Justice class when I was in college, and the instructor was a Detective with the County Sheriff's Dept. He told us that if a person has a concealed handgun license and they're ever pulled over, the best course of action, roll down your window, put both hands out the window, and when the officer comes up to the window and asks for your license, insurance, registration, before you move your hands, you should tell that officer, "I have a concealed handgun license, and I do/don't have my gun with me," because when they run your name in their computer, it'll show you have one, and then they'll come back and ask if you're armed. Fortunately I've only been pulled over once and had to deal with this, and it was a VERY funny interaction with the cop.

Mr. Hampton, I wrote a comment earlier and I wish to apologize for that comment. As a retired LEO, I understand what you're saying and I agree. To many young officers let the badge go to their head, especially the federal officers. Common sense and being polite works wonders. Don't engage in small talk, but be firm in what you suggested, Be as professional as the office and things will go well. I never tried to intimidate an individual for any reason. However, I would let them set the "tone" of things and would react accordingly. 90% of the time everything went ok. Remember people, these officers are just doing their jobs the same as you would do yours. Give them a break when you can and remember they could be killed tomorrow protecting someone or trying to catch the really bad criminal. "Nuff" said.

I had a LEO situation about 40 years ago that still sticks with me. I felt I was having my rights abused, but it was really hard to say what I could have done differently. I was pulled over at night. I was with a friend, and we had been out shooting a modified M1 rifle that was modified to shoot 22LR shells. The rifle was in a guitar case in my trunk. I was being a jerk (young and stupid), and intentionally weaving on the road in town, and an officer going the other direction saw this and did a U-turn to come after me. I left the main road when I saw him make that turn a mile or so behind me, and I pulled over to the side thinking I was out of sight. I failed to get far enough off that road for him not to see me when he drove by on the main road. He quickly made the turn on the road I was on an pulled up behind me, lights a blaze. I wasn't 21, and my friend wasn't either, and we were stone cold sober...so nothing like that involved. The officer was angry since he felt I had been fleeing (and technically, I had), and he stomped up to my door and demanded I exit the vehicle. I asked him what the problem was, and he said my weaving lead him to believe I was drunk, and he was going to exercise a field sobriety test on me. I didn't see that I could refuse to get out of the car. When I stepped out, he saw what I had down along the side of my seat, just inside the door. It was actually a tool used to pick up trash that I had acquired some time ago. It had a ½" round wooden dowel handle on it that was about 5" long (fit your hand), and a 30" steel rod that was about ¼" wide at the handle and tapered down to a point at the end...for stabbing paper. I had it because the rod was flexible and made an unsettling noise when whipped around at night, meant to just keep the stupid away if I had any issues. When he saw it, he said "what do we have HERE?" and grabbed the handle. As he pulled the full 30" steel rod up and out of the car, he asked me why I had 'a sword' in the car. I told him it wasn't a sword. It was a tool for picking up paper. He said it was a concealed weapon. He put it on the roof of my car saying "I'm putting your sword up here, and now I have to see what other weapons you have concealed in here" and began rummaging through my car, on the seats, under the seats, etc. There wasn't anything else in there, but he was at it for a while. I don't know if I could have said "I do not consent to this search" since he had decided he'd already found a 'concealed weapon'. Could I have? After he'd been searching for a while, I asked him just what he was looking for, and what right did he have to keep me by the side of the road. He took his ID out, shoved it in my face, and said "see this? This is what gives me the right". Ok. Then he said "open the trunk". This is when I remembered the rifle and really didn't want to open the trunk as he was already suffering from too much attitude. I said I don't want to open the trunk, to which he replied "you don't have any choice, and your refusing now gives me probable cause to suspect you ARE hiding something illegal". I still refused, and he said "fine, then I'll confiscate your vehicle, take you to the station, take your car to the garage, drill out the lock and charge you for the cost of doing it and then I'll be able to see what you're hiding". At this point I knew my rights were being violated, but I really didn't know what to do. So I opened the trunk. He saw the guitar case and said "Open the case" I really didn't know how he'd react to seeing an M1, but I didn't expect it would be good. I opened the case, and he said 'take out what's inside'. I said, it's a weapon which is perfectly legal, so don't get stressed. He repeated, take it out. I reached in and with just two fingers, I removed the rifle. As it came into the light of the street lamp, damned if he didn't drop back on one leg in a defensive position and unflip the catch on his holster. I said "calm down. I told you it's a weapon" His actions pretty much told me he was being a clown, so I have to admit, I started getting a little snarky. He demanded I hand him the rifle, which I did, still using only two fingers. He took it and looked at the barrel and inspected the whole thing. As he was flipping it around and around, honestly, looking confused to me, I said "the bullets go there" and pointed to where the magazine would go. He said, "where are the bullets?" I responded "It's illegal to transport a loaded weapon (California). They are right here", and I handed him the magazine. He said "these aren't the bullets that go with this gun", and I told him this weapon had been modified (it was my friend's gun, and he had bought it that way), and those WERE the shells it used. You could tell that he was getting frustrated that I wasn't some wonton criminal, and I hadn't broken any laws. He wasn't done yet though. In my trunk (big trunk) there was also a large metal tool box, locked. He said "what's in the toolbox?". I responded 'tools', which I'll assume came across poorly since I was tired of this guy...we'd been at this for over 40 min now, I think. He said "open the box". I said "let me guess, same rights and privileges that I had with the trunk?" He told me to stop being a smart ass and open the box. I unlocked the toolbox, and stepped back indicating the box and said 'tools'... He said to take out the inner tray. I did and said 'more tools'. By this time, a second cop had come on scene, and now HE started rifling through my car as well. The first officer told him about my 'sword' and weaving, and resisting opening my trunk, the M1 in the guitar case, etc. I don't know what the next conversation they had was, but he told me he was going to 'let me off this time', gave me back my 'sword' and said I had to go home. I said I'm an adult, and there's no curfew which really made him mad. He was standing there waiting for me to leave, and I looked at my friend and said "are YOU tired?" He said he was, so I said, okay, then I guess we will go home now. Like I said, after I saw him take that defensive position when I pulled the M1 out of the case and up into the light, using just two fingers, I knew he wasn't particuarly smart. I had TOLD him it was a weapon. I took it out with zero aggressive movements, and yet he unclipped his holster. So Was there justification for him searching my car? I know there was no justification for forcing me to open my trunk or the locked toolbox, but by this time (and after having his ID 2" in front of my nose), it was clear I just needed to do what he asked, but I felt fully violated, and to this day, 40 years later, I still don't know what exactly I was justified in doing as I HAD broken no laws, and my 'sword', while 'concealed', wasn't sharp (except at the point, sort of), and I wasn't wielding it or anything else, he just saw it down along my seat when he demanded I exit my vehicle. Sorry for the long post, but it was a sort of complicated story, and I still don't know exactly what I could have done differently (other than not being a dick and weaving in the first place, but we all do dumb stuff in our 20's....). "Probably " LOL " I clocked you doing 72 in a 65" " I believe it, thats where I had the cruise control" LOL again...." just guve me your information please. How is your driving record?" " I havent had a ticket in over 10 years" He goes back to his car, comes back and says "Yiure right, you have VERY good driving record" (Im licensed in my state to drive any/all emergency vehicles and drive for a living) So, he hands me back my info and says " Im not even going to write a warning: just slow down a LITTLE bit, just a LITTLE " I Thanked him and told him to "be safe" Him "you too, have a nice day!"

Thank you. I live in Mississippi & have a advanced Conceal carry permit. I was not paying attention to the speed ( 45 in a 35 ) passed by a unmarked police vehicle. He lighted me, we knew why he stopped us, we were smiling, gave him my license which returned a 1023 meaning license to carry. This guy was cool, told me to be more careful & said he loved people who carried guns.

This only applies to voluntary interviews. Miranda still is required if there is coercion. And they can't compel you to speak, they can just comment on your silence at trial which is normally an absolute no go. Not legal advice but a simple primer.

Not accurate. You can just be silent. It can be considered 'suspicious' if you're talkative until they ask you about a specific thing and then you go silent, according to the Texas case that created that precedent.

Important note: in some states you have a "duty to inform" meaning that if you are carrying a concealed firearm on you when a police officer asks you for ID, you must also inform them that you are carrying and present your carry permit, if applicable. I don't think that gives them the right to search you, but check your local laws.

If they're NFA there's a form 4 with a tax stamp. And your local PD has a photocopy... because part of the process is local endorsement stating it doesn't violate any local laws to own said NFA gun...and for, air fingers quote, administrative purposes, most PD's keep a copy of all documents they endorse. So while it's NOT gun registration, it's "Gun Registration." Food for thought.

As a CCW holder in North Carolina I am required to hand over my DL, proof of insurance for the car and my CCW permit only. I have never been asked to show the firearm(s) only to let the officer know where it is either on my person or in my vehicle. That's it.

When you purchase a home - consider the porch area... My current home has a fully enclosed porch with its own set of exterior storm and inside doors which are always locked as is the inside door to the house proper. When I go to answer the door I close the inside door and never unlock the outside storm door. No foot in the door, no chance for home invasion, and no open area to see something suspicious to establish probable cause! If your home doesn't have the same arrangement consider adding the enclosed porch - at very least, install an exterior storm door that remains locked even if you open an inside door.

It's great advice - put as many barriers as possible between the inside of your home and the outside world. But unless I'm expecting someone or it's someone I recognize, I simply don't answer the door to strangers no matter what type of outfit they have on.

I dunno. Me I'm half arsed paranoid. I went for a home set well back off the only road into the area (only home on the street) stone and mortar fence line backed up by six acres of hedge maze, gate house with armed private security (all of whom I know and trust and pay well), private drive to main house, blast proof doors, bullet proof windows blast louvered shutters quarried limestone block walls, roof is gabled to a fare-thee-well with many covered hides along roof line. But I've been thinking lately, all that might not be enough. So I'm wondering if it might be worth it to install a murder-hole at the front entrance. Just in case. Thoughts?

As a police officer of 20 years I have only once asked to see a persons weapon. After a self defense incident and I knew some rather gun-ho newbies were on the way lights and sirens. I advised the person of this and said if you want you can place it in your vehicle or my patrol unit. I gave them the choice and they placed it in my unit freely. This way I could put out over the radio the weapon is secured making it a bit safer for all of us. What I will say is this. I patrol a rather rural small town area. My backup is usually a ways out, with that I consider the fellow citizens exercising their 2nd amendment rights as my closest backup. Our state has both constitutional concealed carry and open carry along with concealed weapons permits class 1&2. I encourage folks to carry and love having chats about the new handgun or rifle they got and even the in-depth conversations about why they chose it or the ammo they chose and why. I am the type of cop I am because I took to heart what the lead instructor said after we passed our tests and prepared for academy graduation. He said " Be the cop that gains the public's trust and respect to where you have five people jumping beside you to back you up instead of in front of you to take you on." I will say this as a peace officer I cannot give legal advice. With that if you ever have to use your firearm or even display it to diffuse a situation, PLEASE PLEASE call your attorney and don't say a damn thing even after given your Miranda rights. Here is why, our cameras will be on we put what is said in our reports and that all goes to the court. So in other words make it a clear as clean glass for your attorney to represent you. Stay strong ya all exercise your rights. Oh and if your ever in my neck of the woods feel free to pull up say hi and have a chat about the type of iron you like.

Excellent information. In my home State (N.C.), CCP holders are required to inform a traffic officer: "I am a CCP holder and I am/or am not exercising my right today" as soon as he approaches my vehicle." How do you (as an officer of the law) want that reply issued.

To answer your question. You stated it perfectly. You stated you have a permit along with exercising your right. The only thing I would say or add is the location of the weapon. Reason being you will be reaching for license, registration, and proof of insurance. By giving location of weapon this can ease the situation on the officers side. Especially if you get a jumpy young pup.

The sad part is there are many of us out here who stay true to the aspects of law enforcement and what our duty is to the public, but are put in the same category as those that have done the public wrong.

And I think it's important that the public knows their rights. Or should I say they're constitutional rights most importantly. And I respect an officer who abides their oath to the Constitution. And that is not cowardice to stand up for the fact even in his own fellow officers. God bless you sir. It's nice to have someone with integrity to wear the uniform.

Fun story. Years ago I read the police reports in a newspaper and there was a DWI stop by a guy with the same name as a violent nut from my high school. I was surprised that a small town had another guy with that same first and last name because I knew no one was foolish enough to give the one I know a gun and a car with lights on top. A few months later he pulled an on-duty burglary on me so it turns out someone was that foolish. One of the ever-changing cartoonish lies he told me was that random anonymous people were worried about all the guns I was stockpiling. ...zero. Anyway, he became a felon a bit after that and is currently in county jail on gun charges after trying to M someone with an AW, years after losing his legal access to bang sticks. How you get 6 mos for 5 felonies after trying to violently use the thing the law says it's another felony for you to touch (as commented on just before the 7 min mark, he should be in prison for decades) ....

I was speeding (60 in a 30) and got pulled over. The officer walks up and I had my license, insurance, and registration ready to give to him. Conversation: Him: Do you know how fast you were going? Me: Yes, however, I was speeding because of.... ( I don't remember the reason anymore) Him: License, proof of insur... oh, thank you. Wait one moment. He comes back. Him: Im just going to let you off with a warning, no ticket, but please watch your speed. Me: I have a question. I have my CCL (Concealed Carry Permit), but I don't have my firearm on me. If I am carrying, how do I handle the encounter? Him: Just do what you did with me. Tell them you have a CCL, you have your firearm on you, and slowly get your license and insurance out. Tell him what you're doing the whole time. Most of our guys are supportive of the 2nd, but we do have some new guys on the force who are a little jumpy. Me: Thanks. Him: Have a nice day, and watch your speed.

Yes, thank you very much for the information! I have only been stopped by officers three times in my lifetime (I'm in my 60s). Once for a headlamp out (actually just very dim) and that officer was very polite and professional and let me off with a verbal warning. I replaced it the very next day. Don't ask for trouble! Once I was stopped in New Mexico and they said I was speeding, which I was not. I didn't argue, I looked over the ticket and it said that if I didn't sign the ticket that I would be taken into custody. I was passing thru that state with my cousin on the way to get some of his belongings. The last thing I wanted (or needed) was to go to jail on a three-day weekend trip! Did my out-of-state license plate encourage the LEOs to enrich their county at my expense? I think so but it would have cost me a lot more time and money to fight it in court so needless to say I found another route back! So I've gotten only two tickets, one for the New Mexico speeding ticket (undeserved) and the other was for parking on the wrong side of the road which is ridiculous since that is why a vehicle has rear-view mirrors. County governments are always finding ways to enrich their coffers as well as their pocket books, I have no doubt!

@@tomnisen3358 Yes it's true that if you don't already have a lawyer or can't afford one then you can get assigned a public defender, however you should know that public defenders are often fresh out of law school with little experience and its pretty certain they didn't graduate anywhere near the top ot their class. Technically you'll have legal counsel, but the real question is how competent and committed they are to aggressively defend your rights. This is the unfortuate reality that folks who aren't well to do will face when they go to court.

In the state of Oklahoma if you are carrying a firearm you are only required to inform the officer if they ask and it is illegal for them to disarm you unless you are committing a crime. The law is Title 21 Section 1290.1.

I got pulled over in calif. around 11pm on a fri night for not wearing a seat belt(i was), then he said i had a light out(i didn't), then he said he smelled alcohol( i dont drink), then the cop asked to search my car. i politely refused his request saying i had people to meet and didn't have the time, and he said my refusal gave him probable cause to searched the car anyway. he kept me on sitting on the sidewalk handcuffed in the rain "not under arrest but for MY safety" for well over an hour while he called in backup(6 cars, 8 more cops and a drug dog). They destroyed my car(all while laughing and joking about it and me getting soaked). They caused over $2000 in damages found nothing, and let me go with a ticket for a bald tire(the flat spare in the trunk they cut open looking for drugs.) They left all my belongings( a coat i wasnt allowed to put on, a sub woofer box and amp with wires ripped out, an opened and scattered tool box and all the paperwork from the glovebox on the sidewalk in the rain for me to pickup. I ended up getting sick from being wet and cold (add the cost of the dr's visit and meds). i tried to sue, and the judge just told me i should have given consent and got what i deserved. The unwritten town motto is come on vacation, leave on probation, come back on violation, and the cops are proud of this. My advice is yes Shasta Lake is beautiful, but dont go to Redding. it's not worth it, and yes, they have been sued many times for shooting and/or killing out of "fear for their safety." With zero repercussions or accountability.

Many places in Michigan if you say you don't consent, they will bring in a dog and say it hit. This has been done to me several times. I do not use or transport drugs and have never had anything found during a search. It felt as though by denying consent many officers get upset because how dare you deny them.

Someone I know wink wink and his friend got pulled over just as his buddy lit up the blunt. His friend freaked out and put it out and threw it under the seat. The cop walked up and wanted to search. He denied and they brought the dog. Dog somehow didn’t hit on anything 😂. Someone I know got lucky that night.

That can be used as a defense in and of itself. If they make you wait for a K9 unit, unless it's nearby, that is unreasonable extension of the traffic stop. This does have some precedent, but can go either way based on the circumstances.

@@GReaper if you watch On Patrol Live, they make people wait on K9s all of the time. A few weeks back they walked a dog around a man who had been riding a bike. Not the bike, the man. I had never seen anything like it until then. It was pouring rain and even though the dog did not alert, the cop lied and searched the guy anyway. They found nothing at all. It's interesting how many laws the cops will break on live TV.

I'm so glad, once again, to be a country boy, who lives in a lowly populated, rural area. Most of us never purchase our guns through this background system. We've all been very suspicious of these background checks, and putting our names into any systems that we can avoid from the start. Most of our firearms, on average, are a decade old, or older. Everyone I know has baught theirs second hand, and many of them have been sold and traded second hand over and over again. I wish them luck trying to track everyone's guns out here in country places like Kentucky where I live, or West Virginia, Ohio, Tennessee, North and South Carolina, Florida, Georgia, Alabama, Mississippi, Texas, Arkansas, Louisiana, Oaklahoma, Kansas, Nebraska and several others. Not one single firearm ever manufactured can be tracked to my name, and I plan on keeping it that way to. Also, Im sure law enforcement works completely different in big cities, and large metropolitan areas, but here in the country, these feds are going to find it hard to find any police, city or county, who are going to just willy nilly infringe on their citizens rights. I know for a fact, the Sheriff in my County, here in Kentucky, has said publicly he will not do anything that isn't supported under the constitution , regardless of who shows up and trying to order him, or pressure him. This Sheriff is a good, Godly man, who cares about freedom, country, constitution and would rather be fired then do anything he feels is wrong, or un American.

What concerns me is that, with all of these liberal fools coming in droves from New York, Illinois, California, Oregon, and Washington and invading conservative states, we are one election away from a bad sheriff, congressman, and governor. They’ve wasted no time gaining city and county council seats and working their agendas into local matters, and I see gangs of them on social media attacking our state congressmen and governors trying to influence future elections. He askedvwhere it was, i told him. He told me hevwas goingbto verify location. He opened my door and took his flashlight and lifted my shirt. He ran me & said, GO GET YOUR GRANDSON!! I’m lucky to have retired in Polk County Florida. Where our Sheriff Grady Judd, is a staunch 2nd Amendment supporter, who has told me personally in conversations, that if any federal officers who inform his agency they intend to come in and investigate any law abiding citizen, they will actually be told to LEAVE NOW! Unless they have something in writing on a Federal form or Search Warrant! That even if they do they will be required to be escorted by a Deputy. If I should encounter one at my door and he/she has no warrant, first thing to do is dial 911, informing them what’s going on, then call Sheriff Judd on his cell phone!

@@JJHoover70 yea but that was actually in reaction with the terrible sooting at the Marjory Stoneham Douglas HS, that left 17 dead. Back in 2018, when legislators in all their wisdom had never had a law on the books to prevent that awful crime. So like they alway are prone to do, they went TOO FAR! With a Sheriff showing them how far they went. That has since corrected the situation. But there are folks out there that need to be protected from themselves, for our sake. That’s still better than any blue state refusing your Second Amendment entirely.

Gun in a car is a different issue than in a home. In New Hampshire we have no duty to inform the police there’s a gun in the car. In Florida, there is a duty to inform police.

Good stuff! We had a local sheriff's deputy here that was doing consensual searches in traffic stops and he was planting drugs in the vehicles of the folks he stopped. He was ultimately discovered by a sharp-eyed Assistant State Attorney that took the time to carefully review his body cam videos. The case is State of Florida v. Zachary Wester. #Subscribed

If I’m in my home and he doesn’t have a warrant tell them they are trespassing. If you get pulled over by a cop do the following: 1st Invoke your 1st Amendment Right to Film as a member of the press. 2nd Invoke your 5th Amendment to answer any questions without the presence of your attorney. 3rd Invoke your 4th Amendment to inform the cops that you refuse any and all searches. At age 66, I've done the exact opposite as you recommend my whole life. I first roll my window all the way down, warmly greet the officer then thank him at length for his service to the community. This has ALWAYS diffused the situation and any thought of him giving me a moving violation instantly evaporates. Also, I possess a lifetime permit for concealed carry and always have one on my hip. They never ask to see the weapon and I never bring it up either. Surely they know before I get pulled over. Haven't been cited for speeding in over 30 years.

When you remind them they need a signed warrant to enter your home the cops get pissed and force their way in and arrest you for obstruction for not complying for letting them to come in to beat the shit out of you and to violate your rights.

I was out fishing one day and pulling my kayak out of the water. I had my Glock on me and the officer clearly saw it. He pulled up asked me how the fishing, not so good I said. Packing up and heading some place else. Never once asked me about my gun. Very professional

Many States require you to notify a Police Officer ASAP that they have a firearm either upon you or in your car. I was once stopped by a Dep. Sheriff in Colorado and I notified him that I was a CCW permit holder and that I was armed. He asked me where my Gun was and then asked me to hand it to him, which I did. He went back to his car with my firearm, but did not give me a Ticket. He let me go with a warning.

Every state is different. Wisconsin you don't need to notify unless asked. I was not asked. I didn't mention it.

Most do not know their rights, rather just enough to know that they need to consult someone that they does. So, invoking your right to remain silent and then speaking to your lawyer is generally wise!!!

People who watch too much Law & Order are probably very familiar with the idea -- I personally hear this in Detective Briscoe's voice -- that "when the police ask to see your registered firearm, you don't get to say 'No'." Well, now we know we **do** "get to say 'No'." I am always prepared to say, "I decline to answer questions. Let's focus on the task at hand, please."

There is no provision in the 2nd Amendment for classes that are to be denied their right to keep and bear arms. It does not say "shall not be infringed unless you committed a felony"

I can consider it to a search of my truck one time. They pulled the plastic armrest off the passenger side door. Was never able to get it stay back home until I super glued it back on. The only thing they found was 1/2 bucket of 22 ammo I told him I didn't have any guns in the truck. They stop me because I was a white guy in a predominantly black neighborhood. Just got to fixing the trailer roof of a woman That lived there.

I love that you cover topics that other attorneys rarely cover... Rarely hear about invoking your 6th amendment rights as important as they are. By refusing to answer questions and asking for an atty, it puts you at a great advantage (as long as you remain quiet after.) It's Very important that you remain quiet, bc once you start talking again, they can ask questions which if answered, most likely will be admissible in court. I've even seen cops talk "amongst each other" close enough to the suspect for him to overhear (on purpose of course) in order to invoke a response so that the suspect starts talking again. They normally say something along the lines of hey, this is the same guy that did XYZ on abc st last week, or that's a lot of dope in the trunk, etc... since they're just talking amongst each other, when the suspect interrupts and says "no I wasn't", or "there's no drugs in the car", they can ask questions again, so stay quiet, as hard as it can be... I was pulled over several yrs ago en route to purchase baby formula. I realized rather quickly the direction the stop was going in (asking if anything illegal was in the car, etc), I invoked both my 5th and 6th, which REALLY pissed them off. I was illegally detained/searched and ultimately arrested after 3 officers falsified evidence. I didn't beat the ride, but I did in fact beat the case and now I'm suing the department with help from one of the best civil rights attnys in the country! (just turned down a 40k settlement offer last week) REMEMBER... YOU CANT BEAT THE RIDE, BUT YOU CAN BEAT THE CASE! And a bonus is getting to see them play defense while your attorney deposes them... Funny how much they squirm/throw each other under the bus while being questioned under oath.

You can in Commierado (Colorado) because you are now required to run a background check on any potential buyer and of course you have to involve the police to get that done! However, if I sell a gun when I'm out-of-state there's nothing they can legally do except harass you!@@gerihemby1451

You can invoke your right to not speak and have an attorney even after you start talking. Yes, of course cops use trick and maneuvers to get you to talk! It has been held constitutional to flat out lie to you. Hence, most suggest that you zippit and contact a good lawyer.

Have you noticed how many cops are being criminally convicted for their frivolous usurpation of The People Rights recently? The numbers are steadily compounding. A decent lawyer is more than competent to beat them on this in court. I had a small town cop lie in court saying I was uncooperative.When that was the furthest thing from the truth. And it was a small town, so I couldn't say he had another person that was uncooperative, and he got us mixed up. Needless to say, he no longer worked for that department a year later. There were many other complaints about him. It doesn't change the fact that it affected my life.Pretty bad for 3 months.

PS: I taught my sons from a young age to only say, "I want my lawyer." And then shut up. Little did I know how much advice like yours would save my sons future. 3 months before he leaves for college he's arrested. Thanks to him following advice like yours, and even though the cops were pissed, he did what he was told. My attorney got the case dismissed in 10 mins and credits my son's silence for killing his charges. My son left for college the next day. I was so proud of him

If you are legally carrying concealed some states have a "must notify" law that requires you to advise the officer at first contact that you are carrying a firearm. In some other states you are only required to advise the officer if he/she asks you if you have a firearm.

Not to sound unjust but the introduction to the traffic stop segment really needs to be spread throughout the country (U.S.A.) to help combat cases of "police brutality" against various minorities. When you enter an encounter with ANY law enforcement officer with the attitude they are wrong, your speech will reflect that and your anger will manefest, which an officer can interpret as aggression or resistance, which will escalate the encounter.

I've been pulled over 4 times since January of 2020. Every single time, I've notified the officer/deputy/trooper (yes, all three have pulled me over) that I am a CCP holder, and I am carrying. I was told that this will always put the LEO on edge and make them suspicious of you. That has never happened. The trooper asked if he could disarm me, and I agreed. The other three times, the LEOs said, "Don't show me yours, and I won't show you mine." I am always polite and treat them with respect. And I haven't been ticketed at all.
