Has to do with one of two reasons. First, the transfer of wealth from very rich individuals to their childrens or in general families all rich individuals would just transfer there assets with little cost to there family if your proposed rule was in place. Secondly, what determines a private sale? What if a person sells frequently are they still considered a private sale? We are talking about assets that well exceed the gift amount 13,000-14,000. I don't remember the exact figure it changes every year. But, that is the main reason why there is a sale tax on the private sale is to prevent individuals from just gifting it. I'm not here to argue the if the rich should be taxed more but the reasoning that is in place to justify it.
why would it matter if they sell their own property (that they've already paid taxes on) frequently? if they make a profit, then they're subject to short term capital gains (which are at income tax rates, iirc). your argument about the "wealthy" transferring wealth also have the same issues. taxes were already paid on that property at some point.
This has been a thing forever though, for almost every law lol. Look at the amount of minorities in prison. Its easier to go after the weakest link and work your way up.
Get taxed for earning a dollar. Get taxed for spending that dollar. Get taxed to buy a car with the money you earned that was already taxed. Get taxed for the fuel in the car that you've already been taxed for. Get taxed on the parts for the car that you've already been taxed on 3-4 times. Oh, you sold that car? Pay taxes on that too. 8n the meantime government departments like the one this guy works for gets to the end of the fiscal year and purposely burns through their budget so they get a budget increase next year even though they didnt need the whole budget anyway. All while having the mentality of "well it's not my money".

They need evidence. The files are at the dealership. They have the probable cause to think they are there. Yeah, a judge would sign that. Car (and other rolling stock) tax dodging has been going on in Georgia forever. Used to be you registered your expensive car in the county where the second home is. Tax might be a quarter of a metro county and you get out of the emissions check.
That is not how law is supposed to work, but it's a loophole he can abuse as he sees fit. But he won't get very far with that, because every single owner will go to court over this, and every single owner has a damn good lawyer. They sure will get some of them to pay the tax, but not even nearly enough to make an impact.
What about businesses headquartered in GA and incorporated in Delaware for tax purposes? Are they going to force Home Depot and Coca-Cola (both registered in DE with HQ in GA) to incorporate in GA or face a penalty or move their operations and thousands of employees to Delaware in order to be in compliance? This is considered standard business practice, and no one questions it or wonders how much tax revenue States are losing due to companies “circumventing the rules” and “defrauding the state”; to use the words of the investigator it should be “the cost of doing business in Georgia”. If you’re going to do this to private individuals then the same standard should be applied to businesses. This has nothing to do with tax dollars and everything to do with envy. The answer to this is the precedent set in Louisiana that states it is tax avoidance, not tax evasion.
In the car scenario, the person is reaping the befits and protections of the state without giving anything back. Home Depot, however, is creating jobs and taxpayers and employees and spending and sales tax. The state benefits, even if it’s doesn’t collect a corporate tax...although it would be more competitive if all companies were taxes the same (a local hardware store probably isn’t incorporated in Delaware and thus at a competitive advantage).

Everyone involved knows what they are doing. I don't know anyone in any state that doesn't know to operate a personally owned vehicle in a state where they reside they have 30 days to change the registration. It's almost universal to every state in this country and something many people learn before they even have a license. If you have the presence of mind to say well this belongs to a company it's not personally owned it means you've thought out every aspect of it and know exactly what you are doing. I could go register my car with an address that doesn't require emissions in my state and generally get away with it because it's a state tag, we don't have county markings on our tags. But anyone doing that knows they are doing something wrong. We pay taxes based on where we live which effects budget distribution. They assume if the car is registered there it used those roads a bit.
If the tax is so high is Georgia on supercars that people are registering them out of state *LEGALLY IN MONTANA* then maybe that should be a sign to Georgia that *THE TAX IS TOO DAMN HIGH*
its 7% of sales price once and no annual fee, but that is a good 30-40 grand on a supercar, however if you buy a half million dollar car i have no sympathy about that, its what you send on one years worth of racing repairs.

So you create a law that has a loophole. Smart people use the loophole to save money on an investment. Instead of fixing the law in working with Montana to change their view of sales tax you go after people that in essence are just smarter than you. That black plate is a specialty plate for a little town called miles city. You pay extra for it and the money is supposed to go for building new parks in the town
We do require a front plate here in Montana. I’ve been pulled over for having mine in the window and not properly displayed in the front of the car. Arizona does not do a front plate.
Here in South Carolina the max sales tax on vehicles is $500. We also don’t have inspections or smog checks, it’s a 2 hour drive from Georgia. Just an idea for anyone who doesn’t want to pay thousands in sales tax ☺️

I have a $500 sales tax win, followed by the over $3k a year property tax fail. Flip side to that, sales tax would be $14k on a $200k car so the property tax would take a few years to accumulate to the same amount as sales tax. But, sales tax can be rolled into financing where property taxes can't.

If the business is legal in Montana and the car is legally registered to it there is no crime being committed. Yet, Georgia wants to claim there is and charge people with felonies, all because it wants other people's money. I hope someone challenges this into the Federal Courts.
This is the issue I have. I buy a Honda for 20K I paid sales tax then it's sold 8 more times until its 30 years old for 1K still it keeps generating sales tax.

I agree. The reuse mentality should be encouraged, not penalized. Buying used means (usually) you can’t afford new. Used car, used furniture, used clothing. Make used things sales tax exempt please, give people a break, the government’s already got its cut. Maybe make a rule like cars under 30k are tax exempt when bought used or something. Very few normal cars will resale for more than 10-20k I imagine.

Tax accounts for about 20% of the cost of gas at the retail level - not counting what was collected upstream from oil producers and refiners. And not counting the cost of all the EPA regulations that are built into the price. Of course the Teslas get off not paying that at all - maybe they should be going after them for the money?
bubba99009 they don't pay that because they don't use that infrastructure at a consumer level, therefore to account for all the vehicles that use the road but don't use the oil/gasoline infrastructure, they tax the vehicles individually. The Gas tax does not account for all the necessary infrastructure at a consumer level, so the state simply taxes individual vehicles every year they intend to be on the roads. Some states tax more, some less. Not happy with high taxes, go to Florida where there is not even a yearly inspection on cars. Dont come crying to town hall after your Ferrari needs a few grand on suspension work after hitting a massive crack or pot hole in the road . Its the USA, you got options

Usually when it comes to taxes the government would rather get their money than put you in jail. Tax law is not typically enforced in the way that you think it is.
My question is what law in Georgia did they break? Uhaul registers all their vans in Arizona even though many of the vans have never visited Arizona. You may want to pass legislation that makes this illegal but many people and lawyers though this was legal. What are the rules for cars that are actually owned by an LLC in Montana but they are letting their employee who is stationed in Georgia us it?(is there any limit on time). I want a specific law that clarifies this so people can actually know if they are breaking the law.
U-Haul registerers their vehicles similar to semi trucks, on an apportioned plate so GA gets their cut for road use and so on. Kinda a funky system that I don’t know all the ins and outs of, but it keeps the tax nazis at bay all over the US and Canada.

In case you don't know, they are going to charge these owners the original sales tax on the car and again because the car will be transferred from the LLC to their personal name. The state will get to get paid twice on this.

And of the annual income to the state of georgia through taxes, less than 10% went to education, and less than 3% went to our roads. Another thing, what part of charging a sales tax percentage (which isn't actually the sales tax in GA, TAVT has its own fucked up "book value" that is normally WELL over the actual fair market value of the car) is fair? Bryan White they have plenty of money the DOT is allotted a fixed amount every year and that’s why gas tax fluctuates so much especially in small towns where not a lot of gas is sold because if not a lot of gas is sold in a county the gas tax rate for that county increases so the DOT gets their money. Just a bunch of money whores the state has more than enough money as a matter of fact every year the state comes in under budget so there is no shortage of money.
I'm sorry but last I checked, avoiding taxes was a part of American history, it's one of the reason we were so upset with the crown. I say more power to these people. Police officers are simply revenue machines for the state, if they aren't technically breaking any laws, ie it is legal to have an LLC in Montana and have a car registered to said LLC and legal to drive it in Georgia, I say oh well, they are just using a loophole. This doesn't bother me one but, do what you can to avoid paying taxes, just like everybody else around tax time. Also, taxes SHOULD NOT be applicable on a second hand car, it's taxes have been paid once already.
totally agree with you Richard, some of these cars can move hands dozen of times the states collect taxes on each time. for some cars probably not exotics but the states make more then the original value of the vehicle.
States like MO charge personal property tax. You pay tax on your cars, annually this is not vehicle tag that's another separate tax. In my experience MO is very tax heavy.
If Georgia is doing this for these cars. They need to go after shipping companies that register thier semis and trailers in other states but use them exclusively in Georgia.
Well that's a little different because commercial vehicles are DOT registered and for use by inter-state commerce. Doesn't matter what state they operate nor are registered in because they are held by federal DOT standards
They are registered on apportioned license plates, the semis carry a cab card which lists all the states and provinces they can operate in. They have to track their mileage and then they pay each state they operate in their share. U-Haul, Penske, and Budget rentals do the same thing. Keeps the state tax men at bay because they are getting something out of them.

Two really great videos from VinWiki discussing an important issue. I want highlight something however: throughout these videos, the interviewer in the previous video and this guy have used the word “Tax Evasion”, which is when you do not pay a tax liability. What these car owners are doing in my opinion is “Tax Avoidance”, which is simply tax planning to avoid paying a certain tax that depending on the structure is legally permissible. Based upon the information presented in these last two videos there is nothing that indicates to me that these car owners are invading taxes. They are properly setting up corporations in a foreign state (a state that is not your home state), and purchasing vehicles as an executive of that corporation for use in a trade or business which in this case is showing up to car meets. Does this mean that these car owners are morally in the right? Absolutely not. Taxes pay for various things in various states; I believe our ad valorem tax in MN goes to roads exclusively, but it could go to other things “for the children”. Both and interviewer in the last video and this guy have used ethos-based arguments, but that fact pattern is a slippery slope and I do not think would hold up in the courts. They easily could be owners of legitimate income producing LLCs in Montana. It's illegal to avoid tax. However, it's NOT illegal to register the car to your out-of-state LLC. And the latter is NOT always equate to the former.
I had a small business in Ga. Even setup a LLC there. The state taxes were awful. I closed it down in 2012. I titled my equipment in Ga. , but licensed them in another as I do interstate work. The Ga plates were cost prohibitive, versus the state I licensed in. Now the funny part. The semi truck was licensed in Mt. For several years.. Wonder if they will try and come after me now. Lol

If you want to be a citizen of the US, you pay your taxes for using the roads, the military, the schools, the water, etc. This shit didn't happen magically. It was paid for and it must continue to be paid for. That's the RESPONSIBILITY that comes with the right of being a citizen. Too many dipshits want the rights but not the responsibilities., Too bad. I think they just wanted to get the information out honestly. It seems like most if not all of the dislikes are because people disagree with this enforcement, not with VINwiki itself
