Very helpful thank-you Mr. Abbott. I have said from the start with Progressive I am prepared to take this to trial which I am, the defendant has admitted 100% liability which I appreciate. The discussion is costs, after 2.5 years I have yet to reach maximum recovery. I am now interviewing lawyers whom are willing to take this to trial as you aptly noted. I find that the defendant's insurance carrier has to know that I am serious about trying the case to get the settlement to the maximum level. You also can't be afraid to try a good case.

Depending on your state, you have a limited time to file a claim, and an insurance company may deny the claim. Check with an attorney in your state for a clearer picture.

@@billyhorr7126 depends on the state but you could fight for more... It's way higher if the at fault driver was drunk. Better when at faults insurance takes responsibility.

I have a ? I had a slip and fall- liquid on the floor. Store attendant was told no one picked it up- no cones....i had just had kidney surgery. I couldnt get up physically, i then suffered extreme pain in my leg and spasms- i signed with a attorney. On my way to my to chiropractor a car hit me by behind, my attorney took that claim and put my slip in fall on the back burner. Its almost a year now since the slip and fall....will i beable to even have a case after a yr for the slip and fall? In CA? My attorney i got online- never sued before. Hes located in los angeles. Just a reminder that preparing a case for trial can be expensive, and there is no guarantee that the plaintiff will win. Moreover, there are some personal injury cases that just aren't worth taking to trial. For example, if you only have a soft tissue injury in a no-fault auto accident, probably the best you're going to do is push for the policy limits (which is why most personal injury lawyers won't take soft tissue injury auto accident cases). LOL
Right now my case officially closed 2 months ago so now I'm waiting on my settlement I was in a car accident I had whiplash and some kind of a disc injury worst then a slip disc in my back which required injection in my neck and had to see a therapist for months. Get a lawyer. The adjuster you are talking to probably has very little authority beyond a few thousand dollars. Hire someone who is recommended by family or friends. If you used a lawyer for something else like a will or a house closing, ask that lawyer. He or she will definitely have a recommendation.
how about if you ended up going through a crisis with a disabled condition couldn't go to the case, in my case it next to nothing for what I lost, 4 years later aftet fees 15k for a case worth millions in 2008, don't let this happen to you You get used to the pain so much you can't even tell when your coming down with the flu, I don't know if thats good or bad I guess because the FMS is worse than the flu so you just go about your day whereas before this condition if I got the same flu I would be bedridden for days. Constant pain becomes a part of your life, sure no more window shopping, working out, parties, hiking, biking skiing, hell I can barely walk, but one things for sure, you develop a massive tolerance to pain. FMS really is so much worse than FM its unbelievable. Can't sit too long, can't stand too long,, can't grip anything more than a couple minutes so walking cane no can do, can't raise your arms, can't eat crunchy things after 10 chews, oh yea good times, I must be the worst person in the world to have deserved this right after a life of dedicated selfless service and humanitarian work sheesh. Anyway, blessing in disguise, this is true. 5 million compensation for that mva injury leading to this and not my fault leaving a kushy and stable job on one of BC's biggest companies H.O. wouldn't be worth losing your youth and vitality at 30 years old and all opportunities for making it big getting married etc- but I got diddly squat and now here I am in public housing at least I guess. Oh the irony, but I'll handle myself thats my pride and happiness, when I'm 60 and not so sexy, change my diaper. The pain isn't limited to immobility, sometimes you can move more with less pain sometimes you can't at all and sometimes lying down feels better, but you still feel it. I don't get the menopause thing, you guys must be mixing up pins and needles with burning, that crawling prickly feeling on your skin. I suffered with that for four years as it got worse and more constant and after that was over was left with only pain, no more. Any limb or joint I use repetitively if overdone just completely stops moving. Talk about a gal who was never going to stop school and reading. Forget about sitting in a chair 8 hours or even 4 even just one day a week, my vision is still perfect but you read nothing goes in your head, its all fog, people keep talking I lose them after the first sentence, your talking about a person who had a photographic memory, oh and my music, all lost, cannot play the keys like I used to or sing with out blacking out because it takes so much energy, I took it so for granted, never imagined this, never, you have no idea
If you are not happy with your attorney, call his or her office and set up a meeting. Tell him or her why you are not happy, and I am sure the attorney will straighten it out with you.
@@nickkrikorian5780 Laws differ from State to State. In Utah, a first party insurer must respond within 30 days, so long as certain minimum information is provided by the claimant. The response could be a request for more information, a payment, a denial, etc.
My attorney whom I just met after dealing with the office for 2 years just released me because they are not willing to pursue my case any further. I sustained injury in a low impact car accident which for some reason in the beginning they assured me that they were qualified in handling cases such as this only to find out that, that wasn't the case. I was told by the a.ttorney I could settle on my own and accept the low offer that is currently on the table. I'm in the southern California area which I understand the laws are different. Yolanda Smith happens a lot unfortunately. I researched attorneys for my case and figured out which ones are full of crap and who is the real deal. I hired a trial lawyer that had no problem taking my case all the way to a jury trial. A lot of the personal injury attorneys have never even done a trial they just “negotiate” then drop you when it gets tough. Sorry your going through it
I know this much, if the attorney blow the 1, 2, year statue of limitation for filing your law suit in your state, you might be able to hold them liable for an act of legal malpractice.

Good job .. teaching people how to get over on insurance companies. . Most people claim fake injuries. . If the injury is real and there is hard evidence / medical , impact of accident etc the insurance usually pays a fair amount. There are too many dishonest people out there now days who make fake claims and these lawyers show them the way so they can get that percentage from it. . I wonder what they will answer on judgement day.

Hell No! His assistant said I was disabled and wrote it down. Months later the original treating doctor writes to my lawyer that I’m all healed, without even looking at me, and says no disability at all. This is CRPS too. Terrible disease.
I had a Stryker implant in oct.11 2009 ,I been seeing a pain management for 9 years for pain in hip all the medical records are their if I need them ,can't walk right ,walk with a limp ,can't get hire for a job ,can't pass the drug test ,this Stryker implant has Fuck my whole LIFE , I retained this Attorney but he hasn't file my case in court ,what good is he then ,I need help ,thinking of looking for a real Attorney or just file the case myself in court ,
This video is somewhat misleading. Not all cases are candidates for trial and Nelson should know this. To perpetuate the notion that the refusal to take a case to trial is attributed to a defect in the representing attorney and not the case is simply bad information. I'm somewhat disappointed.
I disagree. I think you have to consider trying your good cases, and be serious about going to trial, or else the defense attorneys are unlikely to offer full value.
This is not true. Some insurance company delay the settlement to recover the supposedly injured person. Once the injured person recovered give them too little. This lawyer sounds like “Pay us until we win your case” “5,000 to 200’000 thousands” funny lawyer. We got public library where we can read about rant insurance.
Jeffrey Bustos have a actident on August 3 2012 on the freeway in rush hour traffic in Friday afternoon and low speed impact and it was a stop and go traffic.. I only got $15,000.00 check and the Medicaide pays the emergency room visit and I had to go to a chiropractor and 2 moths and then i got done with the chiropractor and then I didn't hear from my attorney until 4 moths and then he emailed me about it and asked if I wanted to $3400.00 I want to get at least 5000.00 and it took him 23 months and it 1 month before the deadline to get my settlement check of $5,019.62 after the Attorneys and chiropractor fees ? 💔💔😭😢😢 I have bills to pay and I have tried to call the "settlement funnding" so I can get my, " it's my money and I need it now" on the tv commercial and he said he doesn't do that? So Why did he wait until a month before the deadline to get my settlement check I'm 33 years old and disabled jobless carless I was a passenger in the van and I have a home care service staff and company name on the van and the staff was driving I don't Drive all my life I live in Columbus Ohio all my life and so I have to have a home care service company for my transportation to the day program and my grandma and the store etc.
WHY HIRE A ATTORNEY FOR A SMALL BACK AND NECK WHIPLASH, BY THE TIME Chiropractic , pain shots at 1k per shot , mri ,x-ray, and pain clinic ,maybe fake operation , plus 33% to the lawyers , after you sign all those contract , you might loose your house and car with 10 different liens against you and pain for life .it has happen in real life .
