Hi! I was hit by a commercial semi -truck this past 12 of December, The car was totaled, I had injuries in my wrist, back, neck and head. After many tests like x rays, MRI, CT scan, and concussion testing, they detected a mild TBI, post concussion, 2 bulging discs l4-5 and l5-s1, and a few other things. I don't have anything broken. My physiatrist referred me to a neurologist. I have attended 12 therapy sessions with the chiropractor so far, have had a sacroiliac injection, a lumbar trigger injection, and I am scheduled for an epidural as well this next week. I have not been able to work in almost 2 months since the accident. I’m not at fault (100%) My question is, how much could my case be worth more or less? Thank you!

Have you had a diffuse tensor imaging MRI on your brain, or a MRI that looks at neurons of the brain? The neurologist will say you have a mild TBI based on your symptoms, but if a neuro radiologist says you have a TBI, this gives your case more teeth. Insurance will try to brush off the TBI without objective findings. I've learned a lot from Attorney Arkady... you want objective TBI findings.... I'm going through the same thing currently. .. I had to push my doctors to get me my detailed imaging because I knew something was wrong.... push push push..
I was hit by a tow truck, and suffered a lateral meniscus tear on my knee. So far I've received two PRP injections which were painful. I don't want arthroscopic surgery is it possible to receive the policy limits without surgery?
Yes especially is the policy limits are low like 50k or 100k then for sure. If it’s in the millions may be tough without an explanation why you don’t want to do the surgery if doctors think that’s what will fix the injury. There is a duty for a plaintiff to lower or mitigate their damages
@injuryjustice I just got the word that I am recommended for surgery.I cannt afford to not work at this moment. What happens if situations like this or people don't want to get surgery Because because of the bills and rent need to be paid. I'm pretty much living Paycheck by paycheck.

I have a friend who moved to a unit with a missing piece of a concrete step and he never reported it to management for it to be fixed 8 ura later he tripped and fell hirt his shoulder with a partial tear of the supraspinatus , and reinjured his pre existing back condition. He doesnt know what to do he was planning on going back to work because he felt better after losing weight etc... is he eligible for any recovery if he gets an attorney even if he was at fault by not reporting that missing piece of the step .
Yes I think he can recover. Was this a step inside his apartment ? Because if it’s a concrete step in the common area there is no legal duty to report. I was inside my parked car in a grocery store parking lot in California when someone cutting across the parking lot to exit clipped my car in the process. I have $1k in car damages. Besides mental distress im obviously fine, but i was inside the car when it happened. What kind of settlement should I ultimately get? liability seems clear so the amount you get will depend on your injuries. Even if mild you would need to get medical care for about 3 months and do MRIs to get diagnosed. At least in NY where we have serious injury thresholds to overcome. In California it may be different but Im sure you need some medical evidence of injury to get any real $$$
