Great story. The thing that always sticks out when you hear these stories. The first one is "I was on the phone with 911...." meaning they aren't there when you need them. They are minutes away when seconds matter most. It's so important to realize that we are ALWAYS our best self-defense. PERIOD. I've been a USCCA member for a year now, and I'm very happy with them.
Moral of the story... have a dash cam. He wouldnt have been charged if he had a front and rear dash cam.... and if you carry a firearm or pepperspray you shoild have an interior camera too. It only costs around 300 for all that i said... people spend more on firearms than that... just buy a dash cam and have video proof. Everyone of their vidoes about people defending themselves in a car would have been 100% dropped right away if they had a dash cam...

YES. I worked for the Public Defender's office in Los Angeles in 1978-1979. I saw many public defenders, (pd) who are overwhelmed with caseloads that would make it unsafe to drive the loaded "truck" they were "driving". They are forced into quick deals with the prosecutors; get in--get out of a case as fast as possible; some were known as "dump trucks"; meaning get onto the next case ASAP and to hell with the current client (can't really call him or her a client because that type of pd is more a janitor cleaning toilets than an attorney); the only thing missing is the call, "Next." Plus you have to qualify for pd services, the folks in this video probably would not have qualified for public services. I joined the USCCA because of these issues and the risk of loss in a civil lawsuit post criminal trial. I applaude the protaganist here for using pepper spray instead of a firearm. All of the gun videos on self defense are more shoot out at the OK Corral than stopping a criminal assault by someone acting to hurt you and or your family. Staying in the car gave him some measure of safety until the perpetrator attempted to breach it. I carry a firearm and a canister of pepper spray as well. I can't run away from a perp as I am an amputee, but it's warn the perp, pepper spray them; fire arm as a last resort, while yelling for help to attract attention; witnesses. This sounds on the edge, hopefully the perp is armed and dangerous before using deadly force to defend yourself. Call 911 ASAP. Hopefully you have not been injured by the perp, if so ask 911 for medical help for yourself AND the perp, if you had to use deadly force in defense of life and limb. Describe yourself so the police have a notion of what you look like when they arrive; put your firearm away. NEVER use the word "gun" in such a case as that is a "trigger word" for the police; it is a firearm!

5:11 "there is nothing wrong with making mistakes." Well there sure is when the police make the wrong call and practically destroy your life. Where I live all you see are family attorneys (child support, custody, divorce etc.) and the endless amount of "ambulance chasers" listed in any phone book, as this has now become a cottage industry in our steadily culturally declining country. In other words: the easy money. I would have to seriously do some research to even locate any experienced criminal defense attorney that specialized in self-defense with firearms. And today many lawyers are anti-gun too.
I had no idea that the USCCA policy covered this. I just experienced a similar incident a few weeks ago. Altho the local police dept. contacted me immediately after the incident, I did not contact USCCA. Fortunately, it appears that the matter had been dropped.I already have a relationship with a highly skilled criminal law attorney (a former US Attorney), but it’s comforting to know that the fees would have been covered. I’m a true believer in the USCCA!
Even a push can turn fatal.. a while back, a schoolmate of mine was in his first year of college and was walking from one party to another with a group of friends. They were confronted by another group, things escalated and the guy was pushed. He fell backwards and hit his head on the pavement/curb. I forget weather it was immediate or not but he did not see the next day. Stay vigilant.
Best advice I can give is invest in a dash cam that records both front and back. I have one made by Cobra that has an HD forward facing camera that records audio and it also came with a back camera. Something you should have especially when you have a concealed carry license. I have it in case I get pulled over or if I get into an encounter and have to defend myself.
I live in New Jersey and I did sing up for Elite membership but being a New Jersey resident I DO understand that under N.J. State Law even a self defense home shooting for the one protecting his life, there are two things guaranteed when you shoot in self defense in New Jersey: 1. An attorney 2. A mandatory prison sentence for the victim because he used a firearm (AKA GUN)! The fact that he used it to save his life is irrelevant! That is New Jersey law period. I WISH I COULD AFFORD TO MOVE OUT OF NEW JERSEY!!!!
Try to evacuate that liberal state ASAP, I left another liberal state with $150 in my pocket, took a bus, came to Texas, haven't looked back, now I vote conservative, pay low taxes, and live in a large home due to living costs are so much lower, what ever you do get out, and support the state you move to by voting to keep it good like it is. It is not true what the liberals say about these southern conservatives, I am mixed race and they welcomed me with open arms, and grant me the basic rights all humans should have!
Probably nothing because government officials have qualified immunity which is basically "as long as you dont act completely negligent and clock in you are immune"...a neccessary evil but that doesn't mean there wasn't maybe a call from the Magistrate or the Prosecutor to the Sheriff telling the Sheriff to screw his head on straight. I've heard the back and forth between agencies when dumb stuff happens like this.

The cop had no business issuing a citation without witnessing the alleged offense. If the guy had filed a report and sought a warrant it would've been different. The only charges in Alabama that can be made by officers on probable cause is felony offences , Domestic Violence offences , DUI on a wreck scene and issuing no proof of insurance citations not even suspended license tickets can be issued on wreck scenes unless you witness them driving on a wreck scene. That Citation makes absolutely no sense to me. I'm glad he had the coverage. Even though the other guy had a story first where the spray hit him and if there was splash on the passenger door should've been enough to determine what happened and kept that out of court not to mention what they pointed out the guy got out of his vehicle. I take peoples freedoms, rights, and rights to self defense very seriously. I have had many cases of people coming in and filing a report and they admitted to trespass and I had to break the peoples hearts and tell them you don't have an assault case the alleged suspect told them to leave under the self defense law in AL once your told to leave they have the right to remove them by force . The chief at the time said he had no business putting his hands on them and argued with me on it and I pulled out the law book and showed him.
I’ve been carrying for a few months now. Ever since taking the class, I always have pepper spray on me along with my sidearm. I really don’t want to shoot unless I absolutely have to, and I want a non lethal option for aggressive, unarmed people. I know you may be able to shoot someone unarmed in certain situations, but I imagine it ends up being a legal nightmare.
many times a person must win their own case. private attorneys get bought too, they have an office and more reasons to crave income... the truth is a person is basically on their own and just do right decisions,evidence cameras recording, witnesses, and have a program like this is essential... i hope dash cams become legal because some authorities make it illegal.

What you have done is sue the other guy and the cop, this forces law enforcement to do a better job. It also sends a message to the criminals/people that they could be sued for false or lying about what really happened.
Another situation that a $150 dash cam could have helped... get a dash cam people... you can get one installed for around 250 bucks if you know a good shop....
Fine. But my concern would be over the police officer's actions. Mistakes like that are not only detrimental to the victim but they cost organizations like USCCA money by having to respond to such actions. Responsibility is only defined by the accountability that comes with the job. I'd like to see a clearer strike-based system implemented in our law enforcement so it's more understood that negligence is never tolerated.
I don't want strike based system, who controls the strike? how severe mistake to have strike? I am not saying not to have officers accountable, but sometimes its due to lack of proper training. Which could be departmental issue too. Remember its easy to throw rocks at something you don't understand or not part of.
If it's due to lack of proper training then we know where to focus then, don't we? I'm never one to accept things 'as they are' when we have the ability to change them for the best. Remember that law enforcement is a branch of the government, which is controlled by the people as well. All problems have solutions and it's up to us - and only us - to find them.

"You have a story and they have a story and there was no witnesses so that's what I have to do" This is a wicked mentality to criminal activity. Basically the cop is saying, I'm going to assume YOU are guilty of using pepper spray on this guy for no reason while I'm not going to assume he approached your vehicle with intent to harm you at all. Seriously? People, pay attention to this.
So, was the other guy charged at that point? He should have been charged and a civil suit should have been filed against him. That is the only way to deal with idiots like that..
When I watch USCCA videos, a common theme is "conflict avoidance." With that in mind some questions come up. 1) If the suspect cut Brad off to get in front of him, how did Brad end up back in front of the suspect? 2) When the suspect was to Brad's right in stopped in traffic, why was his passenger window down and why was he verbally interacting with the suspect, keeping the incident active? In a brewing situation such as this, windows should be up, doors should be locked. If at all possible you should have 911 on the phone, describing the incident to them prior to being forced to use the pepper spray. 3) In Texas, the only offense eligible to be adjudicated with a citation is a Class C misdemeanor, the lowest class there is. This is equal to running a stop sign or red light, etc. Why in this story do they never disclose the actual charge on issuance of the citation?

This police officer was clearly LAZY in his duties. He didn’t want to deal with sorting through the facts and just wanted the easy way out. Absolutely disgusting! If you don’t want to get off your butt and do your job right, then don’t come to work!
Laws lean towards the side of the Criminal,training of any kind is not cheap, and often the criminal will get a free lawyer. Something needs to change,we need to make it easier for individuals to be able to legally defend themselves and loved ones.

As to the OP, one thing to consider on the USCCA, there insurance ONLY pays after you are cleared of criminal charges. That means you will have to come up with the money up front to retain your attorney and cover his bills, and then if you are aquitted, you will get the money from the USCCA policy.
I'm not on the "road rage" guys side that being said the left lane is called a PASSING lane for a reason!! Also, roll the window up. Don't say anything to him, that just gives the jerk a reason to keep running his mouth.

I still stand by what I said in the comments to the article; that there's more to the incident than USCCA revealed. Also that Brad could've avoided the situation by keeping his windows rolled up and not engaging the perp . All together: Conflict avoidance! Works like a charm at least 90% of the time. Last , there's the mysterious citation ...
Bottom line, USCCA defended him. IF he was in the wrong somehow (doesn't sound like it to me), that says even more good things about USCCA--if they defend you even when you didn't act perfectly!
I agree. It doesn’t quite add up and they don’t tell us what the other guy said. His remarks about being in a fight for his life every time he commutes is a little weird as well and might be a sign of an overly dramatic person.
That's nothing, I wouldn't doubt here in California they just let or expect you to get injured or kill just for it to be simple enough, people here know almost anything you do to defend yourself your gonna have some type of back lash like it's your fault, like you need to carry a camera around like a cop just to prove yourself right around here, my Friends little nephew who was only 15 at the time almost got Rob by an older man his height luckily he got the upper hand drop his ass and took his phone back didn't even bother to call the police right after, its sad when you realize you don't relie on the Law to protect or help serve justice You have to relie on yourself and pray for the best
I have been in that situation. I am doing waay over the speed limit in the left lane. Zero traffic in right lane. Buddy comes up behind doing waay waay over the limits and rather than blow by me in the right lane, tailgates and flashes his lights. Usually that is a good time to see if my brake lights work.....

Xavier S from what I've learned, if your current address includes immediate family(father, mother, brother, sister) they are covered if a self defense situation occurs on your property. If it is you're parents house it is still your property as long as you claim residency there legally.
