On a side note, I know Aina said she didn’t do anything with the application, but she actually filled out most of the actual I-485, I-765, and I-131. Mikey just helped where she got stuck. Aina also helped write all the cover letters included in the packet. And she of course read and signed everything. Mikey mostly brought all of the supporting documents together and organized everything.

Thank you, thank you, thank you so very, very much! This is really the only updated video I've seen for putting together the packet for the Adjustment of Status (I-485) documents. My hopes and prayers go with you both, as my husband and I are in the same situation right now. We've been working on putting our papers together, and keep finding more and more things we need to provide... it's been a little frustrating, but using this as our guide has helped tremendously. Excellent vid my friends .. some questions ... 1. The proof of relationship .. you did the same thing when applying for the K1 .. do you use the same pics?? Or you use pics to show proof of relationship of the marriage??

Extremely helpful video!! Thank you!! I have a question though. How did you find out that the fees for the work permit and advanced parole were waived? Did you also send in checks or money orders with the packet? If so, were did you put them?

Sorry for the late reply. I just did a bunch of googling and actually found on the USCIS website that the fee is waved. We used g-1450 authorization for credit card transactions for payment and included it as the first page in our packet. It's important to put it at the front so that they see you paid. That's most important for them anyway.

Very nice presentation, good to see up to date packet assembly instructions all the others I found are outdated from like 2016 or older. I'm preparing to file AOS-EAD-AP for my wife who came to the US on K1 fiance visa but keep finding more and more I need to include in the packet. I noticed on a lot of lawyer videos and service websites they instruct you to include Form I-130 Petition for Alien Relative and Supporting documents for Form I-130, I know form I-130 is an Immediate Relative visa petition, why would I need to include this if my wife is already in the US on a K1 fiance visa? Is I-130 even necessary to include with the I-485 AOS for K1 immigrants? If so, do we also need to include the I-130 filing fee? Seems silly to need to apply for IR1 Spouse visa for a spouse already in the US with a K1 Fiance visa.

alienistic I don’t see why you would need the I-130. If your wife came in on the K-1 visa then you’re in exactly the same boat as we are. Just include every thing we did and you should be fine!

Is it necessary to add one in all the different forms ? I-131, I-485 & I765 ? Thank's !

I think adding a scanned copy in each of the different applications is a good idea. All these forms don’t go to the same departments. Think of these forms as completely separate applications. That’s why you need to put multiple copies of documents such as marriage license in each application.

great video! I am in the middle of collecting my documents for I-485 and I-765. not sure if I should submit I-131 since the instructions of I-131 says you may submit for “urgent humanitarian reasons” and ''traveling for vacation'' would not be a reason? Is there a different form is I only plan to travel for vacation?

Mr2011TBrown As far as I know the I-131 is the only document you need in order to travel abroad. Aina received her green card so quickly that the I-131 never even finished processing, so she didn’t get a chance to test it out. But I’m confident the I-131 is the correct form you need to fill out in order to travel abroad for “vacation.” It’s basically a reentry permit.

Thank you for the detailed information. May I ask a question? How do deal with the non-english materials? I mean USCIS requires all the non-english documents are translated by a competent translator. Did you find a translation company to translate non-English materials? Besides, did you submit the original or photocopy of the English translation documents? Looking forward to your reply. liping liu USCIS requires a certified translator. Although we simply translated my wife’s birth certificate ourselves when she got her k-1 visa and it was fine. But we wanted to make sure we got a certified translator for the green card to not take any chances. We used a website called universal translators. It was pretty cheap and quick. I’m curious guys, I have a question where do I write my married name if I want my docs to come with my married name but on my marriage certificate has my maiden name😢. Should I add it on additional information page, or file on other names?

I have the following concern: I have been the wife of an American citizen for 14 years, I entered the United States 5 months ago with a tourist visa and we are going to process the I-130 together with the I-485, I want to know if to put together the package I must accompany it with a single cover letter indicating all Forms (I-130, I 130A, I 485, I 864, I 765, I 131) with their annexes or include a cover for each form? Can I use the I485 with the expiration date 09/30/21 if I’m sending my packet next week. The uscis website has another form with an updated edition date.

So if you are here with a Visa and have a sibling that is a citizen so you compete the I-130’and I-485 and will they get a green card??

fillsgarage I think so. Our situation was different so I’m not 100% sure. But the citizen has to be able to financially support the visa holder and fill out an affidavit of support.

rakibul islam hello, sorry for the late response. I’m not sure what you mean by addition info page. Every single document I included in the packet was highlighted in the cover pages, which is the first page I put at the top of each packet.

Yes we have! We applied in July, then went to the interview in November, and got approved that same day, and received the greencard in early December. The process went much faster than expected.

Kevin Everything I think you bring it along with you to the interview. In our case, Aina entered the states on a k1 visa, and they required her to complete the medical exam and bring proof to her k1 interview. Since she already had that, she only needed to provide proof she completed the medical in her application. When they sent her the notice for the interview they gave her a lot of things required to bring, and one of them was proof of medical. Hope that answers your question.

Hi! I sent my visa adjustment application last week. USPS tracked it until Chicago IL but never confirmed a "delivered' status on its website. I sent the application to a PO BOX according to the instructions given. Is sending to a PO BOX different to a business address in terms of tracking status updates? If anybody has an idea I would be glad to read you! I already open a case with USPS just in case haha, thank you!!!

I need help because USCIS rejected my form I765 (insufficient funds) and form I485 (insufficient funds and missing application type??) I fully completed it and combined both amounts of I765 and I 485 in one check in a total of $1720 idk what to do :( I just got married this July and now I’m stressedt

Wendy Gonzaless As long as you have every necessary item listed on the actual USCIS website, then you’re fine. The cover letters are so that they can understand whats in there and in what order it is in. It’s not required because USCIS doesn’t say it’s required.

Use your new married name. And fill out the entire application with your new name that you want, because that is what will be on the green card.

Manette Alido I find that it’s necessary to include a copy. Any proof that the marriage is legitimate helps your case.

Hi! The forms you need I-130 is the petitioner green card holder or us citizen, if you are spouse yes you have to file I-130A but that would be filed by you not the petitioner you mail or online together with all the requirements. If yours is US you can send all together or at the same time if it’s green card holder I believe you have to wait the approval of I-130. So Basically if you are currently filling for green card inside us with a US citizen you may do I-130/ I-130A/I-864 if your case apply (I-864A) and I-485 if applicable (I-485A) I-765 and I-131 and medical form I-693 add to the forms .

Hanah Detalla Aina came into the states on K-1 fiancé visa so the I-130 wasn’t necessary.

The I-130 form is a spouse visa. Aina came in on a I-129f K-1 Fiance visa, so she didn't need to apply for the I-130. But if you apply for the I-130, you can also apply for the I-485 form and put them in the same packet.

Just to be safe, I printed the entire 1040. It ended up being a lot of paper. It's better to include more than less in my opinion.

Stoyan Ivanov I helped my wife fill out the packet, but technically she is the petitioner since she’s the one that signed for everything and had to answer the questions on the application, so I put her name.
