“What do you do with yourself all day long?” This is a question the Social Security judge will ask you at your hearing and you need to think about how to best answer this question.
You do not need to be bedridden to qualify for SSDI or SSI benefits, but if your daily activities are too robust, the judge may conclude that you have the capacity to perform the duties of a simple, entry-level job.

I had my final phone call interview with Social Security yesterday for SSI benefits.Everything went great and I was verified to collect benefits...I could barely control my emotions on the phone...Thank you My Ginsburg, because I watched a lot of your videos and they helped me..

@jfsfrnd Yes,I was watching your videos plus reading through their paperwork,etc. Since I don't have any bank accnts.,only a prepaid debit card,that's where they direct deposit the monthly payment. And that's what I use to pay my bills with. Its taking a little bit getting use to paying with a card for everything. Thanks for your advice.

This information is very useful. I am about to have my hearing and there are so many things wrong with me. I don't have many medical visits because blue cross blue shield insurance was scaming us out of money and there was a big lawsuit against them. But that lect me not being able to keep up with medical visits after my surgery. So I have to prove why I don't have many visits and how i deal with the pain for so long. But thank you for the information

Yeah i ended up with a 3 minute segment telling the judge the beginnings of what I do on any given day - before he cut me off and shut me down and I was no longer allowed to speak. So rude.

I cursed out an ALJ during a telephone hearing re: an unemployment claim once... I mean REALLY cursed her out... and still won on appeal! : ) It's a long story, but she was nasty to me the very first time I spoke to her via telephone pre-hearing re: some questions I had, she was nasty to my wife when she called the house (I'd called the ALJ trying to schedule the hearing while I was driving through some desolate mountains and the call dropped; she called my wife at home, bitching that I "needed to get a better phone", etc.), and she was nasty to and biased against me for about FIVE HOURS during the telephone hearing before I'd had enough. Note that I'd only arrived home from about a 40-hour trip for my new driving job at about 4am that morning, and the hearing probably started about 9am. My wife was close by when I went off, and she said that, all of a sudden, my ENTIRE FACE CHANGED... and she thought: "Oh, SHIT!" : )

Thank you for that. Very helpful. I've been fighting my case since 2012 finally hopeful about this go round. Had to start a new case 2015 because no lawyer would take it to higher court. I've been consistent and have now names to all my ailments. No longer doctors guessing. Its been a long journey but hopeful. age played a factor too they say.

Yes I agree that age has a whole lot to do if someone gets approved.....if you are under 50, it’s more likely that you will not get approved based on their rules and regulations unless it’s something almost deadly.

april red i had the same issue with finding a lawyer even though the advocate i originally had kept telling me to take it to the federal level. I had to reapply and just got another court date for February. I was shocked my court date is only 6 months from my appeal considering my last go around my court date was 18 months after my appeal.

I found this information to be very useful and thanks for educating me for these types of questions from the judge. Your video's in general are informative as it helps me to prepare for my hearing which had me doubtful and nervous.

@@carolynsmall2306 I'm no lawyer but usually they ask you how long you can sit, stand and walk at a time and when you walk how long and how often do you stop for a break. They ask you what you're normal day is like. They ask you to take them through basically a day of you're life what you do during the whole day. They ask you what kinds of medications that you're on. They ask you about you're previous education and work history and just different kinds of questions. I'm sure it's different for everyone but i found those are some that they asked and also what are you're health problems and conditions and what makes them better what makes them worse . Those types of things. But you should ask an attorney and they could give y you better detail. I do believe that Mr..Johnathan Ginsberg has a video on actually what you're asking because i ran across it i find myself making notes because he has so many many helpful vidoes and I'm forever grateful for him. I wish I had seen this way before my hearing that was conducted last year via screen and now because of the covid people are doing phone interviews and you're attorney should also prep you and let you know what to expect at the hearing and I'd rather have one over the phone because i encourage you to make notes so you don't forget things that you want to say to the judge and then it's to late after the hearing is over. So in my opinion making notes is very important because he has so many excellent vidoes that he is an amazing man for sharing and helping people thats a real blessing for real .

You are a blessing. I'm 45 and have been fighting my case since 2012 been denied too many times to count now on a new case as of 2015 just denied again going for appeal. I have consistent doctors and documents to back up physical and mental health. Its insane how you have to darn near be in your death bed to get approved. Having spinal stenosis, fibromyalgia, degenerative disc disease, Sclerosis of the spine where pelvis and spine connect, depression and anxiety what more do they want. I'm praying that next appeal will be approved. Its been a long battle and giving up is not an option for me becuz of my chronic illnesses and ailments. In the denial they stated well you can make decisions fir yourself. Its known that delaware has the highest denial rate and its truly sad for those who genuinely are disabled. So thanks for sharing.

I had an attorney for a speeding ticket Mr Sonny Cochran of california.i asked him if he was really an attorney.he said some people say yes some say no.well who said no?the state of california.on other days he worked at Leo's barbeque.then he made me a custom tailored suit for 49.95 and he threw in a pair of white socks.

Weather the prosacuter and or alj is having a good day or a bad day has more to do with you getting disablty then weather or not you get it. the only factor is if they can find any far out remote reason not to give it to you. you being diabled as all most nothing to do with getting disabilty. they don't care at all about you at all.

I have been denied once and now going through the reconsideration appeal process. They sent me out another questionnaire asking about my daily activities and I never knew how to answer. Even I asked my lawyer and they acted just this dumbfound as me. I'm in Chicago. At times I wonder why do I have a lawyer

hello, I was wondering how to make my mom my live in helper after I recieve my social security because I do have short term memory and chronic pain and she helps me with things around my house and to remember things. I mentioned her in my hearing. so can I put her on my paperwork.?

I was denied for ALL conditions but SS said I could still work with my left arm 🤔. Since 8/18 Im currently in pre-hearing status after my lawyer filed for appeal. I pray Im approved without waiting for hearing. Does it look good for approval? And YES I submit uptodate medical evidence after every treatment

I got denied on my second filing at the end of August 2019. Just a few days ago i already got my court date of February 25th, so that is 6 months from my appeal. Last time around it took me 18 months for a court date from my appeal.

I told them all of that I can't sit or stand for more then an hour at a time without my back pain acting up I also have to go to bathroom often yet they still say I could do light work and that there are plenty of these jobs out there

Michael, SSA will not accept your assessment of your own limitations. These need to be identified and confirmed by a treating physician.

I told my Judge the truth. I said pain management and rest a lot. I dont know if I will win or not but that was my honest answer. Luckily I have money from other places and im not counting on this but again that was my honest answer.

I thought everything was looking good after the SS Dr`s visit and the last phone call with the SS determination women and said she was going to try to finish her part, until I get a letter from my local SS office telling me "this letter could affect whether you can get SSI income" That they will call me on 12/20 ..At the bottom of the letter it says "What We need"( Pay stubs since aug of 2018)..I` had been stating I haven`t been able to work for 19 months or so and that I worked on a cash on the spot basis...So I have no idea whats up now...

I'm not sure what you are asking. are you asking if notarized witness notes can be used as medical evidence for your case? the answer is no.

Hope you can answer this question. I live in Oklahoma and I've been told by social security that I have to use a certain ss office that is in a bad area for me to travel to, plus that particular office has given me incorrect information in the past. The office they assign to vou is determined you zip code. There is a closer office that I would rather use, but I've been told no because of my zip code. Do you know if I can use it somehow? Since ss is federal why can't I use the office closer to me? Thank you.

First of all I don't know why you would need to travel to your Social Security office. Most matters can be handled by mail or fax. In theory if you send something or go to another SSA office and give them a document they have to take it but you are taking a chance that SSA will lose your file if you go to a different office.

@@ssdattorney The reason I would like to go in person is because I will need to set up payments for Medicare since I'm turning 65 in 6 months and I don't plan on drawing my ss until I'm full retirement age. I don't feel comfortable setting payments up over the phone.

I have early onset Alzheimer’s and many other conditions that leave me unable to work why did I not get CAL what am I missing? Yes I have 3 different physical exams from 3 different doctors that all diagnosed me with same issues they are making me do video court May and from google info I got a bad judge

You only get 5 years to get benefits after you're no longer able to work. At least that's how long i have to get approved.

Let's see, I get up. I feed the cats who remind me. A nurse comes and shoots me up with prolixin. I check RT, comment a few times to be a pain in the butt to psych ops. Thanks for helping me--not. I ask Putin to pay me five million dollars (after taxes) and the house (after taxes), as we had a few run ins. No, I don't tell the doctors that because they are in bubbles. I take my pills and am in agony for an hour (no big deal--it's worth it), I read some more of RT. Putin hasn't been featured for a few days, which is disappointing. He's my hope. I make a plan of what I'm going to read that day while trying to not fall asleep, as my meds do that. Some days, I can't read, so I listen to trashy music and have various fantasies about saving the world. I'm too old for that, but it happens. Sometimes, I wear my pjs all day and walk the halls. I usually don't match because I don't care. I only dress properly when I'm going to the doctor.

Almost 10 months ago I had my court date,and i let the judge know about the chronic back pain(along with my lawyer),I was diagnosed later after I saw the judge with diabetes,arthritis,fibromalgia,carpal tunnel,anxiety,and depression.How will the judge know that I was just diagnosed with all of this.

I am assuming you have not received your decision. If 10 months has passed my guess is that the decision has already been made. In theory, your lawyer could write the judge and advise him of these significant new developments. The downside to this strategy is that the judge could decide that your impairments were not disabling until the date of the new diagnoses, which could cut most or all of your past due benefits. I would discuss this new development with your lawyer for specific advice about what to do, if anything.

Social Security Disability videos I also received 3 letters(while still awaiting the decision from the judge)from the judge herself letting my lawyer and i know that there has been 5 additional evidence that will be used for my case ex:15 My lawyer told me that she will send the judge a letter requesting for them to make a decision.Can the lawyer force the judge to hurry up and make a decision,and why would the judge take a long time to make a decision?

Social Security Disability videos Finally after waiting almost a year for the judges decision,the judge decided unfavorable,and that the judge has retired.Now they have diagnoised me with Bipolar(my anxiety since last summer had been high),depression,Type 2 Diabetes(a1 of 9.4),Carpal tunnel syndrome,Fibromalgia,Insomnia,and Osteoarthritis.Every day its so very hard having to deal with constant pain all over my body 24/7.Am on 13 different medications,and they give me 3 different physical therapies that helps a little.I an scared of bathrooms(only mine,my mom almost threw y brother,my sister and I out of our 13 floor living room window when I was about 7 years old.I don't like to travel alone because I get scared,and i don't like people.I've tried to ask for a service dog but the R.N phychatrist told me she didn't know how to request one.I feel soo helpless.My oldest attempted to commit suicide for the 3rd time while overdosing on Xanax(and is addicted to coke)

I applied in 2015 was denied 3 times I got a lawyer I've been diagnosed with lupus my body is completely stopped working shut down when I applied in 2015 they had me on the medication I got my body to work and then I started having Strokes three of them lawyer because I still wasn't able to do stand I spend most majority of my time in bed after 2016 in December are start having Strokes I have had three Strokes starting December 2016 on into May 2017 and I'm just now having my hearing in October 2018 but when we went for my hearing the judge would not let my lawyer speak would not let her talk but the person sitting off on the side also said that there was no jobs for me to do especially with my education level which is the eighth grade so what does that sound like to you?

Filed for SDI being seen by Mayo Clinic running tests etc to find out cause of not being able to swallow food. Lost 80lbs also have COPD. The loosing weight has made me weak living off Ensure Boost etc. Only liquids. Also have Bradycardia. I hear 80 pct of claims rejected at first stage. Do I have a shot?

You may not win at initial if you don't meet a listing (see www.meetalisting.com). But I am thinking that a judge at the hearing stage would likely consider such a condition disabling.

Attorney Ginsberg please help me with, my dilemma as irresponsible as it may sound I really need to know what my rights are as a disabled person. Unfortunately, I am disabled I've been on disability for three years now I am 55 years old. I have had several surgeries on my hands and my issues got worse not better. In this very moment I have to speak this message and or type very slowly, besides that I have a lot of feet, joint, spine and back issues. My question is this, as a creative person I developed my writing skills initially to help with my depression, but then I decided to put my feelings into a song which my family and some talented muscians heard it and they are of the mindset that if produced properly my song will be very helpful to other people and it might even garnish some monetary gain for me in the future if my song is picked up by someone in the creative world. Sir, since I am not dead but truly disabled can I pursue this. I know that it's presumptuous to even think that anyone would ever use my song but would I be kicked off of disability immediately if any money was made from it? I know this is probably out there but please answer me with legal truths. This writing ability is helping me feel alive again, I'm in constant pain and can write whenever I feel ok which is not that often. As a working professional person I have never been without an interesting project and now the I am disabled I am home all of the time trying my best not to give-in to my depression and feeling useless. Thank you in advance for your time while reading and answering my questions.
