Hello, I have a first use common law trademark dating back to 2014. A fortune 500 company took my TM and filed a 'first to file' in 2019. I just found this as I was researching to file. I'm past the time to file a grievance. So, instead, I'd like to move forward to TM my brand so I can franchise and expand to other states without issue. The company in question offers a different product, but same category. If I move forward, I don't think they should have the right to block me a I am "first to use" with online proof. Had they researched this prior to filing, they would have found my product.
@@ElizabethPW Yes. I received my "The USPTO has published your trademark" email today. Apparently I can use the TM mark while they are investigating if I can have my mark.

I truly appreciate your content, it is delivered to perfection:) I just had a quick question: the class I am applying for my trademark is 003 which combines cosmetics, makeup & perfumes, thus my question is do I copy & paste the direct applicable statements that apply to my Co. into the form? (Let me know if I need to elucidate further?) Thank you in advance!
In the video at 8:45 you can see where I'm using the database for classes to select them. That's where you search for the statements that you want (cosmetics, etc.) and check the box and then add them to your application (by inserting checked entries).

You're welcome! Yes you can have multiple classes, but each class costs more money. You can't add classes after you file -- it would mean filing a new / additional trademark application. If you have not sold the product yet, then really it should be 1b -- but you can amend it to change that: tmep.uspto.gov/RDMS/TMEP/current#/current/TMEP-800d1e861.html
@@ElizabethPW Hi Elizabeth. Thank you for your great answer. I have one more question. Would it cost even when the class is similar? Eg. sticker, decal sticker, car sticker. If I ticked all three it would cost 3x the original?
It only costs more if they are in a different *numbered* class. In any numbered class there are multiple things - so yes you can have bumper stickers and wall stickers in the same numbered class (16). But some stickers are in another class, like nail stickers are class 3 and helmet stickers are class 9.
Hey there, thank you so much for this video. Such a life savor! I had a question about the “intent to use” vs “use in commerce” distinction. If I am starting a business and have had a website up, get nothing is actually for sale yet as it says coming soon, would the logo be eligible for “in use” or does that need to be an intent mark until I’m actually selling on my website?
Good question - you need to make a sale for it to be in use. Just one sale, but there needs to be one. It's confusing because they don't mean ordinary word "use" they mean "use in commerce" as in money has been exchanged.
@@ElizabethPW Would my logo be eligible as "in use" if I sold some of my products elsewhere outside my website before I created the logo? For reference, I am considering starting a publishing imprint or LLC.

Thank you so much!!! I trademarked my business name and logo in 2014. I just found out that I was cancelled because I did not renew it, I missed that email 😕😕Anyhow, I'm so thankful that you showed me how to file again on my own as the USPTO told me I had to refile all over again.

How long was the process, from the beginning when you started searching the trademark database to see if your name was already in use until finally getting the trademark?

This is was most helpful. Thank you so much for sharing. I initially hired a lawyer to do my initial 'supplemental registration' which was approved. It is now 6 years later and eligible for renewal. My attorney called to remind me of this. He have me his fee, and I thought, I could probably do this renewal easily myself for just the cost of the renewal fee. I should be able to claim the initial application he did for me, as my own via the USPTO website, and do this myself pretty easily correct? I already created an account and I can see all the documents he filed on my behalf online. Thank you again for sharing your knowledge on this.

Followed steps in this video & filed for trademark registration. Got the serial number from USPTO & based on the serial number applied for the Amazon Brand Registry, which got approved quickly. THANK YOU for making helpful content.
