I tried this technique too, but kept eating the chocolates before I got to the bank. Probably wouldn't have worked anyway, as I'd like to think my bank aren't a bunch of absolute muppets who could be outsmarted by a moderately bright cat like these clowns were.
Convicting someone in absentia, especially when you don't even have their identity, seems like it wouldn't hold up in court even if you did find them. Although it's highly likely they are the ones who stole the diamonds, they don't even have security camera's in the vaults. So unless they caught him with the diamonds, there'd be no way to prove that he was the one who stole them, especially since he wasn't the only one with access. They basically screwed up soo bad, I'd find it hard to believe that insurance would want to cover it even a fraction of the losses, and they'd probably have a good case to not cover the losses at all due to the lack of proper security.
