Thank you for this and the bivens case on oyez linked to. The bivens complaint form does not work. Do you have more cases or pdfs on compel/motion ect? Ever filed a bivens you have to wait after a court trial to file right?

There is no specified time for a judge to rule on a motion for summary judgment, absent an authority ordering otherwise. Have you read your local rules to determine if you are permitted to contact the judge, and if so, what is the process.

Generally, fired means the employee was involuntarily let go. What it means in the context of a federal employee getting fired or the employee voluntarily resigning during his or her probationary period, could vary based on the facts. Best.

Hi. The process is similar, except in a Section 1983 lawsuit the plaintiff sues a state, county, or local governmental official. In a Bivens claim, the plaintiff sues the individual federal official. A major difference is that under 42 USC 1983, a plaintiff can sue the individual state official and the entity (as long as the state entity consents to being sued (for money damages) because the state has sovereign immunity). In contrast, in a Bivens action, the plaintiff sues only the individual federal official.
