9:54 If the client does not testify in these, especially if it is a he said/she said it will most likely be FATAL to their case not to (you have a right to silence yes but not a right to be not falsely convicted). Remember this if you are ever falsely accused, and no lawyer worth his or her salt should ever tell you otherwise.
@@anthonyayala2412 No, the defendant does not necessarily win if they testify. But if they don't testify in case where credibility is important, their lawyer needs to do a very good job in cross-examination, and/or the complainant needs to be a poor witness.
The percentage of people who lie about sexual is very low. U need hard evidence and proof. U cant speak on behalf of someone else. If they say they didn’t want it thats what goes!!!!!
Exactly right on the proof you need evidence and hard proof if they can just say your guilty and not have the proof and hard evidence it’s complete bull shit
He said 1000% right , a liar can seems very truthful on stand , and people who told the truth could look like a liar . The prosecutor would even lie on the stand and hide without evidence that’s good for you to make you look as bad as possible , they only want to win , they don’t care if you innocent. And if you have a public defender or a bad lawyer , May god help you out , because they won’t do shit for you . I have been through all those , I know exactly what happened .
A loved one that's going through a sexual assault case there's no physical evidence it's going against his word and her word there's no evidence all they have is the police video tape and cassette tape with a person confess that they did it and that's all they're going on they tried to give the person a plea bargain of a 4 years deferred but the person is going to take it to trial next week on the 24th and the person pleaded is not guilty
The question is even after no solid evidense still the judge make the person quilty then how to challenge the verdict that judge is wrong? And you know so many people are wrongly convicted due to judges wrong dicision and served long time for no reason. The question is can we do anything about judge wrong decision?
Do you ever feel like a shitty person for defending sexual offences that you know were true? I mean, getting a rapist off of a conviction? I know everyone is entitled to a fair trial, but if someone has raped and violated another and you KNOW they did it, how do you sleep knowing there is a victim of the worst kind of violation has been ripped to shreds so you can get their perpetrator off?
Because there's levels to want the truth is. That's why the government has to prove beyond a reasonable doubt that it was actually rape and not just a regret. I have a friend that got charged with R and at the end the video surfaced of the girl helping his drunk ass up the steps. The next morning he walked her out and they hugged and kissed and laughed and talked before she got in har car. That morning she went to the cops and told them he raped her and if course they found his DNA inside and all over her. How is he guilty?
@@Gabriel8415 that's awful for your friend. However, for the few men in his situation there are hundreds of thousands of men and women who HAVE been raped or sexually assaulted. They are treated appallingly during the court process and very often end up seeing their attacker walk free. In the UK, where I'm from, only 1% of reported rape cases in end in conviction. You can't honestly think 99% of these people have lied? If you honestly think that your friends experience is the norm you are completely delusional.

@@Gabriel8415 just because she looked happy and hugged him doesn't mean she wasn't R. There's a new word added to the "fight/flight, freeze" fear response and it's called *appease". For many women, our fear response is to appease the one hurting us. It's a survival technique. Instead of escalating the situation, they will do exactly what is asked of them. We appease the one who hurt us, so they won't see us as a threat .
So, "know is true" is the key words here. If the accused is denying it, then the lawyer doesn't know it's true. Sometimes it's more obvious than others, but there's strange things that happen in this world, and sometimes this is one of those strange cases. Most cases, there's nothing that makes it clear what really happened. Having said that, it does take a certain ability to isolate emotional and empathetic reactions to do that job. For some, it's being able to hang on to "everyone is entitled to a full and fair trial" as an absolute principle. Think of the ACLU defending terrible bigots, because they believe in the principles of free speech, free association, etc. However, there's a high degree of burnout and addiction in criminal lawyers, both defence and prosecution. That's likely a contributing factor.
False accusations are a national sport for women in Canada. Its absolutely insane that all it takes is a story and a pointed finger to destroy a man's life... all with government approval. #nomanissafe
@@swordsmith3785 going for preliminary hearing . They charged me for sexual assault with a weapon though there was no evidence neither any signs of assault on spouse body . But she said he threatened me with a knife to have forced sex .I got arrested ,got out on bail lost my job and now my life is on the line .
7 minutes you talk about if her boyfriend finds out . My accuser went with her ex boyfriend to make report and got back together. I’m currently on bail . My paid attorney didn’t fight for dismissal
This is statistically incorrect. But, you don't want the facts that are right at your fingertips with a quick google search. You'd rather play victim and get in your feelings.
11:12 If you have one or two jury members who believe you are innocent, they will keep badgering (the other jurors) until they also say guilty even if the believe you are innocent.. The jurors cannot be dismissed until a verdic is found.
@@triplekmafia4932I have a trial coming up on the 21st judge alone summarily charged with sexual assault and sexual interference. Im hoping my lawyer can get these charges dismissed this has been the most stressful and depressing time in my life but im praying on the 21st my life will be wiped clean and i can move on with my life
I think I’m facing 50 years at the bare minimum for something that I really didn’t do. After watching this video I walked into my lawyers office like a boss and was firm and direct how I wanted to handle my case.
Im facing 50years as well 4felonies a male minor said i had vaginal sex with him and i literally got a letter from my hospital that states i could not have vaginal sex do to vaginal stenosis and 2 stitch. I hate kids they are liars and will say anything a parent tells them to say.
Excuse me, but win the case means to put the rapist to the jail, not to save them. So, it would be correct to name the video how to save a rapist from the law... Or if you would be an ethical lawyer, you would make the videos from the perspective of the victims, and you would call victory that scenario.
@@Honeyyumyum @alexandrepereira deivid @Jaime Bailey I understand all of this, however I am in an unfortunate situation... (if you know what I mean) and try to search for some information in RU-vid to at least have some clue how these cases look like, or to really find anything that can be useful for me, but it is a bit frustrating that every video connected to these cases are like "how to save the guys", and no one really talks about the other perspective.
My girl friend is going through a sexual case and it’s felony trial ptf but if theirs no truly evidence of what is getting falsely accused of her and they some how some say see her as guilty what can you do?
A wealth of well presented info. Ty I would be interested in your view/explanation of "qualified immunity " and siu. .supplemental immunity. Lol Topic suggestion. 👍for our understanding
Hold on....if your client says they did it, they sexually assaulted another person you just say ok, we are going to defend you the best way we can? What about human ethics? What kind of person defends a person that admitted to sexual assault? You are literally defending injustice and you are in the justice business? How does this make sense? can you please explain? This is not an emotional comment, I'm not trying to judge you as a person as I don't know you, I'm just trying to understand your logic.
I mean, that's their job. If the client is paying them, they are willing to take this case and the client wants to plead innocent they still have to defend them. On the other side what about all those people who are wrongfully imprisoned? I agree that it probably isn't "ethical" but if they choose to defend this person and they may be required to if they're employed by the government then they have to do their best to defend this person no matter what awful crime they commit. There's a reason that attorneys get a bad reputation, they both wrongfully convict the innocent and let murderers go for a living but without them there would be anarchy. It's like if you got paid as a taxi driver to take a person who was racist, homophobic, etc. You wouldn't want to but it's still a required part of the job, unless you wanted to completely refuse to do it entirely then it's what you're getting paid for.
If your client tells his lawyer he did it, the lawyer can't represent him unless he pleads guilty. Lawyers can't knowingly let their clients lie in court.
@@warlordprinny6407 there’s exceptions of the Privilege . And lawyer stilll can’t lie in the court even if is under privilege , if they will get caught there’s another story .
Thanks bro. I liked your vid. simply because good lawyers are a rarity. And by good I mean honest and ethical. Not saying you are or aren't lol, but I know that you are talking sense. Loved your vid. Btw I am NOT charged with a sexual offence but here in UKKK 🇬🇧 the principles that you elucidated apply just as well. And for the record, and with God as my witness, I am innocent of the stupid charges against me.
