I submitted my adjustment of status packet in early September 2022 and received an RFE the first week in October requesting joint sponsorship because like so many others I wasn’t aware of the importance of the most recent tax returns over current income status. Deadline to obtain a sponsor for me is the end of December so she is right you guys they are speeding up processing. It suck’s knowing your case is at a standstill but I’m working on resolving this ASAP 🙏🏾 Good luck to everyone going through this stressful process
Can i asked you about this RFE. If you have inadequate financial evidence and inable to get a strong sponsor. How long will uscis give time and will uscis deny your petition eventhough you are now married to your wife? Does she have to leave the US is you can’t provide the rfe in the time frame (usually a few weeks) of the rfe??
@@kemangraya2382 So when you get the RFE Letter it will state the time frame to acquire all evidence and if not they WILL DENY YOUR APPLICATION its a fact that stated on the RFE letter. In my case I received my letter on September 30th and my deadline is December 26th. I too am married to a US citizen but that along won’t prevent your case from being denied if you don’t submit the requested evidence. As for having to leave the county you should probably consult an attorney on that I can only speak from my current circumstance as I’m going through this adjustment of status process.
@@blessedchild1021 Yes I submitted my RFE documents on Dec 12th USCIS Received it on the 14th and approved it and notified me that they will begin working on my case again and mailed my work permit to me on Dec 22nd!!! It seems like even though the RFE halts your case status it doesn’t reset the amount of time your case has been processing. So in my case they literally picked up where they left off and sent my work permit since I had already reached the 60-90 day processing time by that point. Next is my travel document and then the interview! Keep pushing guys it’s a long process but we’ll get through it. Wishing everyone luck

This is totally true. I submitted the paperwork( I-485 Application for Adjustment of Status), for my parents at the end of September 2023. USCIS processed it on September 29,2023 and I received RFE on October 5,2023. Yes, I made some mistakes, which I could easily solve: such as my parent's Birth certificates, and Medical exam I-693. Also, I need to find a joint sponsor, because my income was a little bit above 125%. And USCIS requested to submit all information by December 31, 2023 (3 months to solve everything)
Can you please make a video on how to file I-864 as the primary/petitioner sponsor if unemployed and no past tax record? I know a joint sponsor would be required but what do you fill in the form if unemployed and have no current income?
I have received RFE to submit medical and w2 and 1099s of my spouse. Is it a green signal ? I had applied i-485 on may 10th 2023. And received RFE on 5th June 2023(after 25 days of submission of I-485). Received letter for biometrics as well.

Does anyone know if you need to meet income requirements for all 3 of the most recent years? For example if you meet for your current (pay stubs, letter of employment etc), most recent and 2nd most recent but not on the 3rd most recent would that result in an rfe?
While you’re not required to meet income requirements for all three years (only the most recent one), it still helps. You can provide additional evidence of current income to strengthen your case
Hi Kseniya! can my main sponsor resubmit an updated I-864 including a household member because our initial document that was submitted did not include a household member as we thought that the current annual income is the basis of the poverty guideline and not the most recent tax return.
My mother worked in the us about 20 years ago and earned her 40 credits. She was never a permanent resident. She went back to her country. Now that she gets her green card after I claim her, will she be able to receive medicare and retirement benefits since she has her 40 credit from the prior years she worked before?
Are you sure that income from the last year is the one that matters, not the current income? I'm reading a lot on the VisaJourney forum, and the most experienced users there say that it's the current income that matters the most, you don't have to meet the income requirement on your previous tax return, it's more to show the stability and trend of your income increase/decrease
Its really confusing because I sent the petitioner and joint sponsor I-864 because the petitioner didnt make enough in last tax returns but they sent an RFIE for paystubs and letter for petitioner cause the current income was enough, really dont get it and I sent the response RFIE but nothing yet

Hi Kseniya, we got an RFE because my husband Tax return did not meet the requirements. So, the RFE said joint sponsors or last 12months salary. I mean if we don’t do joint sponsor and send our 12months bank statement and pay stubs, would that be enough? Since, my husband is now making enough for this year.

I got a RFE. So you are saying my husband will need a joint sponsor even though his current income is much more than his previous income return. His current HR letter and 6 months pay stubs won’t help?

Does USCIS consider non-taxable Social Security benefits as qualified income toward 125% of federal poverty guideline? They ask for AGI income but SSI benefits isn't added to AGI line on 1040 tax returns. Would it be accepted if I added SSI benefits to AGI and put that into the 2021 income box. or also include real property equity just to have a stronger case?

2021 Income $48,000, 2022 income $52,460 and 2023 income less than $40,000 (out of country for more than 2 months) For household of 5, the current income is very good compared to last years. Does writing letter and explaining situation help or look for joint sponsor?

Dear Kseniya. If I filed in June 23 of this year, and nothing has happened. Meaning, I have gone through the process normally. I just got my work permit. But no RFE or anything from the other forms. Case (I-485) since I took biometrics on June 20 appears as actively reviewed. But no scheduled interview yet. Is that a good sign or not? We filed the 864 including the tax returns of the most recent year 2021 and 3 years back in time, with all supporting documents you mentioned in your 864 playlist.
Those who get the RFE are those who miss out on the instructions for I-485. If everyone follows the instructions(a separate document provided on USCIS website), there will not be an opportunity for them to send any RFE. There are required documents to attach. And the tax information of the one who filed I-130 is part of the instructions. Very simple lol. Congrats!
I did exactly the same in the video, sent a i-864 for a joint sponsor with tax returns w2s employer letter since the petitioner didnt met the necessary in last tax return and they sent me an RFIE for paystubs and letter again from the petitioner sponsor because the current income was the amount needed, why was what?
I'm sorry for bothering but what exactly the RFE letter said? We have the same problem. My husband's income from last year is a little less the the poverty guide line (the years before weren't good either). But this year the income is fine. We have letters from employers and paystubs for 6 months indicating that he already made the amount of money we need. I don't want to wait till February for a new Tax Return because my medical check up will expire in March. Co-sponsor is also not an option for us. So I'm trying to collect information to make the best decision. If it doesn't bother you too much, please tell what exactly RFE said so you figured it was about paystubs of petitioner sponsor?
@@ЭлинаХабибуллина-н9м I had an sponsor but they saw that my wife was making enough in the current income of this year (last 3 years didnt make enough and thats why I sent the form from sponsor) so the RFE was for proof of that current income so I sent the employer letter and 6 months paystubs(the paystubs show that she already made the necessary)

Hi kseniya, I uploaded and Submitted the I-864 but could not fix the number of household pdf error, so I submitted the document with this error to NVC and they approved it. At the embassy they told my wife to upload the I-864 with the corrected household number but when I went back to CEAC to upload, this was not available for the I-864 so I uploaded a corrected one but not in the section of the original one. My question is do I have to contact NVC or will the Embassy take that I-864 and send it back to NVC for correction?

Hi kseniya,i got RFE after 25 days of submission, my sponsor met the poverty guidlines. But on that notice they said to submit a complete copy if petitioning sponsors federal income tax return, does it mean that we should submit the most recent?like 2022? The problem is my spouse is still in the process of filing his 2022.

Is this still happening? Last year my tax return was just below the threshold but this year I'll prob make 5x as much from my work. And the sum of my assets are about 8x the minimum threshold.

I sent an application on September and got an RFIE, we knew the petitioner didnt qualified since tax returns werent enough but the current income it qualifies, so we sent petitioner and joint sponsor I-864 but got an RFIE for paystubs but for the Petitioner since the current income was met

@@francosuito3819 I submitted the forms on September 6 and RFE September 24 and October 3 fingerprints and I don’t remember the deadline I already responded and they got it October 13
