This is the disgusting underbelly of our legal system. We cannot depend on lawyers to ethically stand against the abuses of the system of what should be there to protect people who are truly victims of violence. This is just a cash crop for Both systems and all the attorneys involved.
I'm watching this because I have been falsely accused of the vast majority of allegations in a protection order. Disgusting underbelly of our legal system #2: We can not depend on citizens to tell the truth all of the time, and can expect a certain amount of all protection orders to be a manipulation of the legal system to cause harm to someone they disagree with. This has been traumatizing and life changing for me. To be treated by many like a lepper, outcast. I was harassed by a police officer investigating a potential infraction of the contact order. (he asked if I wanted to know what he thought personally before he told me though, so I guess that's on me.) No one wants to accuse someone that claims they are a victim of domestic abuse a liar. Hell, 6 weeks ago I would have been one of the people in the courtroom mean mugging the respondent just like everyone did to me. I knew what they were thinking as the petitioner was bawling. and I had to just ask for a continuance and could not defend myself. I looked like such a peice of trash preparing to argue with a woman in tears with someone from the WCA to assist her. I've gone through a lot in my life and this is likely one of the most catastrophic changes of world view I have ever had. I was so confused and in such disbelief I legitimately thought maybe I was actually developing schitzophrenia for about a half a day. People with such high openness don't mix well with these situations. I'm far too gullible. I would have never thought though, especially THIS girl had such cruelty in her to not only cheat on me, lie to me, and tell her friends such terrible falsehoods of me, but to also tell me that she will do everything in her power to get me arrested when I tried to tell someone the truth, and open this P.O when I told her I would spread the truth if she doesn't. Wicked people exist! It's insane! No one would have ever suspected this girl. She even cheated on me with, and is now seeing a cop! And he is clueless! at this point though I almost feel bad for the wakeup call he will have if I can manage to get the right evidence in a week. But damn if I can beat this with out a lawyer (and I'm getting more confident everyday I can) I'd feel sooooo sick. And even better if she gets justice herself for manipulating everyone and the state to kick someone significantly less fortunate that her when he's down. phwew. :,)

If its not a conviction then it shouldnt be on our record. Thats ckearly a violation to treated fairly. There was NO proof in my case. It was clearly all stated and even after I gave evidence that she lied in her reason for the request, they still upheld it. In the end she still had provided no evidence.

I am the respondent of a DVP.. Its absurd given the circumstances and the COMPLETE bias of the justice system.. it was made from a complaint of a verbal argument by my GF whom I called the cops EVERY TIME!!.. Going thru this now...in CA. One phone call from me to her in June...got me a retaliatory visit from the sheriff 4 weeks later. Still dealing with it 2 court dates later. Hopefully thrown out at hearing in February 2023! For one phone call!

Keenly, OOPs are very serious business. Often given to defendants in stalking and domestic violence cases. OOPs are designed almost like bond conditions given to other criminal defendants. Often known as "no-contact orders", they demand the defendant not to have any contact with the victim or plaintiff on the order, whether manual (in-person contact), or electronically (phone or Internet), or otherwise, as long as that order is in effect. I live in Minnesota and I have been involved with a HRO as a respondent. This matter started in 2000 and I am still being forced to live in state facilities because of this court order. I don't know if you can tell me what I can do to get this matter resolved but I listened to your video and I have not had any contact with this person in over 20 years. Maybe contact someone at your local bar association for information. My ordeal had my wife of 27 years sweetalked by a destitute Metro Taxi driver. He was her doc appointment transport too & from. He stopped bringing her home, keeping her in the front seat as a passenger (uninsured this way). He saw her as a good candidate to live off of if he helped her, two against just me.. I had to file because he is Hiv positive, it was my attempt to get her away, send the message. Nothing worked, shes heavily medicated & he also was getting access to those. "He has a bad back" was her reason for giving them to him. He was her False Accuse witness. She was Awarded most of my lifes work, Entitlements was the reason for this. Shes now ove 10 years of Wont Pay ordered kid support. I have a police report of them xaught naked in that car,von it it spells out his disease & her vulnerability.
I just had a situation which a very crazy woman who lives six houses down was driving by and taking pictures of our house. She was also stalking my subtenant here. We went to the magistrates office and filed an emergency protective order, only to find out she had one against me. I was pretty shocked. But my EPO and my subtenants did get granted, and also a warrant was issued for her arrest for stalking. She has absconded and went to another state to hide out at her ex husband's house. Meanwhile, my subtenant and I went before a judge and told what happened and we got a preliminary protective order against her for fourteen days. The hearing for the Permanent Protective Order is in a week and the judge is very familiar with this person because many of my neighbors have also filed cases against her. Last weekend I spotted her and called the cops, so they could come and serve her the stalking warrant and the PPO, but she had someone pick her up and not sure where they went, but obviously she knew that she was wanted. Police did serve me with the EPO but by the time they did the 72 hours had expired, and she didn't try to get a PPO on us because if she went to the courthouse she would be arrested on the warrant. What happens if they can't locate her by the time we have our hearing next Thursday here in Virginia?
I’m being stalked and harassed by a former inmate who has served out. Who has a very violent past. Lucky I have have everything documented and more then enough proof. With letters he has written me along with call logs. I am in the process of getting a RO. The scary part is he’s NOT going to stop. He said “there’s nothing you can do to stop me no matter what you do, no matter what bullshit you throw at me. My love is yours and fuck you”. My husband is law enforcement and he’s scared for me because he’s seen this type of stuff happen where people get protective orders and the person who’s protected gets hurt or killed. Sad part is most of the them have those papers on their person
Protective order or not it sounds like he’s gonna get what he wants and it doesn’t sound good for your part. Just give him some pussy and/or leave the area and don’t post on social media
So I have an order of protection against someone for drugging my children. A state certified daycare. Today I was hit with a “retaliation” oop court date. Stating I drive past her home. I have LoJack that records ALL my travels and streets traveled on. Do I even need an attorney to fight this? 😂
Mother of my child took out a protective order, so should could go after full custody of our son. Only thing we have done is bicker and not get along. Never any stalking or harassment or threats. Can she get away with this?
The burden isn’t at all on the accuser. It’s on the accused as a sworn affidavit is all that’s needed. If you don’t respond and come forth with a greater degree of proof that you didn’t do what was alleged then you loose. So in short the burden of proof is on the accused to prove in many cases that something didn’t happen which didn’t actually happen. That’s not easy for obvious reasons, the main one being there isn’t much evidence available to bring forth for things that never happened. What usually happens is it’s their word against yours and judges will almost always side on the side of caution when the evidence is not clear. What’s worse if if the accused solicits friends and family to support their lies. Then it’s a game of who has the most support. Biggest scam about the whole thing is absolutely zero assumption of innocence.. and if kids and custody is involved which it usually is then you as the accused stand to loose a great deal.
A sworn affidavit is not proof of anything. People can lie under oath and it is called perjury. It is punishable by law. The burden of proof is always on the accuser. Hard evidence, witnesses etc. and witnesses can be cross examined. People can accuse anyone of any crime and just lie under oath. Thats why the law requires to bring proof to prove a crime actually happened. The consequences are severe.
This post is exactly spot on. And god forbid you are an accused man and the "victim" is a woman, and the judge is a woman. You WILL lose everything. And the only people getting rich are the lawyers.
Don't ever attempt to move out of an apartment ( even if your lease is up, unless or until any roommates have vacated first, because an order of protection won't hold up if you don't have personal items at that residence. And they are claiming all my big furniture is theirs.

I wish I'd have known about you a couple weeks ago. I just lost a case v my own mother. . . I did not expect it to extend a year and hold up because of how silly it was, but I got railroaded by my older, mentally ill brother and elderly mom. No more CCW and it's on my record. A protective order was granted by a judge against me because my daughter's mom said I called her phone to speak with my daughter. Is that a valid reason? I have no history of family abuse no criminal history of any kind when the judge asked her why she requested the protective order she said because it aggravates her when I call her phone
Seems no judge would sign off on that silly BS, but a judge McMillan here in Tennessee signed one against my husband & myself for what a lying pos alcoholic old man wrote ver batim, "because I saw he had a shot gun & I didn't like it." It was never pointed at him, or even threatened to be & he never even tried to claim anything more than seeing it in our belongings & not liking it. He shot at us, & hit my little brother with a pellet gun, through the wall multiple times. I suppose judges here in East Tennessee sign off on them.
I know this is probably too late to help you personally, but maybe someone else will see this. The petitioner can make a motion to withdraw the petition for an order for protection. It should include an affidavit stating as such and make clear that you are doing so freely and voluntarily (i.e. make clear the respondent is not pressuring/harassing you to do so. Still, the court may refuse to withdraw the P.O. If that does not work, you can appear at the P.O. hearing and let the court know that you no longer wish to have a protective order granted. Although the judge may be a little grumpy if he feels that you have wasted judicial time and resources asking for a PO that you never had grounds for. If you don’t show up to the PO hearing, but the respondent does, it is possible that the petition for order of protection won’t be granted. But that is not a guarantee. None of the above is legal advice. You should speak to an attorney if you need help withdrawing/amending an order for protection. And before withdrawing your PO, you should consider your situation and ensure that there really is no threat of danger to yourself or members of your household.

I was served an order of protection. On the order, it said to stay away from the plaintiff's or petitioner's place of residence. When the plaintiff relocates their residence where they live while an order of protection is in effect, do you stay away from the plaintiff's old former residence or the new current residence where they now reside or living at?
I am in stlawrence county NY state I broke my gf tail light on her car. I had a temporary order of protection while I’m in the same home with my childrens mother. She never came to court and I won the case, the order was dismissed and my charge was dropped to an acd. She is no longer allowed at my Home and In fact there is an order against her now in my favor. What if people have restraining orders and send other people or agencies and chruch groups to your home and children that are in the order to stalk and harass, spy so they don't get caught because they know about the order but the other person doesn't but has a idea can you call the police if they keep coming to the door?

Now waiting for custody hearing because they stalled the progress by making me do a paternity test. 99.99 the dad so I basically won she can't keep my son away anymore

How long do they have to serve you with said papers. Because I had an incident Sunday where my daughter is in another county and I pay for her cell phone bill and her cell phone and her phone was taken by that said guardian of where she was at the time and I said I wanted to know why her phone was taken and was not given an explanation but just a few words and then I was hung up on so I get mad and tell them that I’m coming to get my property and my daughter if she wants to come with me. She is 13 and I was just given no explanation as to why my property was being held hostage and then I get a text from the aunt saying they took out an order of no contact mind you while all this is going on I called the county police department that they were in and they showed up and when I was calling my daughters phone they answered her phone FaceTime and would not talk to me like a respectable officer of the law nor would they give me any answers or even show me my child so that being said I have not been harassing stocking etc. I got a little upset because my property was taken from my child with little to no explanation as to why and all I said was I’m coming to get it and then I was informed that the no contact order was taken out. So I want to know how long they have to serve me and I want to know if it is not served in a certain amount of time because I plan on going to court but I’m not going to call or ask for the paper because it’s my understanding that they have to bring them to me or it’s void. Because honestly this is such a stupid thing anyways.Any advice would be great
