Hi Humberto, I have a few questions. 1) If you have a B-2 Tourist visa extension pending, is it true that you can stay in the USA while it's being processed for up to 240 days? And does this mean that once you leave, you can't re-enter? 2) When applying for a work visa (obviously not on a b2 visa), can you apply any time of the year or does it have to be during a time frame to successfully get one?
My mom who’s a citizen applied for my green card in Oct 2017, I came to the U.S. on a student visa, finished my masters last year and am currently on STEM OPT for another year and a half. I was hoping that during this time my priority date to file for Adjustment of Status would come but it’s been stuck at Aug 2016 for months now. Could you explain why it’s taking them so long to start processing these please?
@ernas, how old were you in 2017? If under 21, you could have filed an adjustment? If you were over 21, then it is first preference. See my video on the visa bulletin for explanation.
@@GrayLawTV I was already over 21. I've been looking at the visa bulletin for years now but it's been just stuck, I don't know what alternative I'll have if it doesn't get to my priority date by the time my F1 visa runs out.
Hello Humberto I Bien living in the U.S for 20Y years here in New York but I entered tue MEXICO and I had a diportetion Order but we been going to Court and now my diportetion Case is Closed I don't have to go to Court anymore and now I have to go to my Country for a few minutes I nterviw at the American Consulate could I get my green card here with out going to my Country thank you 🙏

First of all, I want to thank you for such a great RU-vid channel. On November 29, 2020 I received TL from NVC that a Visa number was available but if I don’t pursue within a year, they would begin process of termination. This letter also contained a form with boxes whether I like to pursue the case or not, that I had to sign and submit. This letter did not ask for any statement or explanation, only asked to submit the form to reinstate the case. I checked the box that I wish to continue, signed it and sent it online on November 26 of 2021. Then on November 30, 2021 they still sent TL -1 for no contact in one year and asked for an explanation as to “circumstances beyond my control”. Now I have two questions: 1. Do I hand write my explanation as to why I could not submit the visa application, sign and scan it or do I just type it on Word document, then print, sign and scan it? 2. If they still don’t reinstate the case, can I start a new application for immigrant visa or does it permanently bar me from applying for an immigrant visa? Currently, NVC has not been taking any phone calls since May 2022. So, if you could reply to this comment it would be a lifesaver! Thank you.
@V, you can use "ask nvc" to let them know that you are pursuing your visa so it will not be terminated. You need to let them know if you will "adjust" or "consular" process.
Thanks for replying. I hope they do not terminate the case, it’s for my parents. They are not currently in the US, they do have multiple entry visa. I will ask them whether they would like to proceed consular or adjust.

I have a question My dad is a green card holder and I am his child and I'm 19 years 11 months old.i'm currently in the US on non immigrant visa and we are planning to apply for the green card. Visa bulletin shows that F2A category is "C" so I can do concurrent filling (I 130 & I 485) what happens if I reached 21 years old before getting the interview for green card?
@star, it depends wether the petitioner is a PR(depends when the category is current) or Citizen(again, need to look at the visa bulletin. USCIS tends to adjudicate when the category becomes current.

@@GrayLawTV Thanks for the response! Accomplished combined I-751 and N-400 interview on the first week of Nov 2022. Presently, medium risk for CoVid-19 at the county level where we are located at. Staff were not wearing masks. My husband and I showed up to the USCIS facility with our almost-four-month old baby, we encountered no issues. The personnel who received us after the security check said my two-year old would have been allowed entry had I brought him in with me.
Taking your children is a good sign. It shows a family unit. They cant refuse entry to your children. I am glad that worked out for you. Congratulations.

You won't be able to move here just like that. You can come over to the US on a Fiance Visa and get married within 90 days and file for adjustment of status.

you can file another i 751 right away and consult a family attorney on how to get your divorce. hopefully by the time of the interview you will have the final decree.

I have a friend that was deported from the U.S for a narcotics conviction. He wants to apply for a business visitor visa to conduct some transactions for his business. I conveyed to him that he needs to apply for Permission to Re-apply for Admission Into the United States After Deportation or Removal under I-212. I am looking to see if the annoucement you referred to would apply to his case since he was deported for an aggravated felony of narcotics trafficking.
