A judge saying the words "the wrath of our holy god" in an opinion is a massive problem. Religion has absolutely no place in a courtroom when it comes to making judgements.

So if there's an electrical shortage on one of these banks with frozen embryos or the fridge breaks down is someone culpable of mass murder?

I think something should be paid to the family who is losing their potential child, but I think being tried for wrongful death is ridiculous.

Lacy Peterson was over 8 months pregnant and that fetus could have lived outside the womb. That's a far cry from an embryo that could NEVER live ......an embryo is not a child.

As a woman that is considering the option for IVF right now, yes I agree if a lab destroys the embryos without my consent and without option for me to use the embyros , I'd sue for damages. But, if a technician in that lab accidently ruined the embryos viability through preparation of implantation, slips and falls or if the lab suffered a power shortage, or was in a location that would suffer a natural disaster resulting in the clinic being destroyed or even if the embryo failed during implantation , which happens more commonly than not ( and is a potential outcome advised during consultation) No way! Condeming the doctors and technicians for unforseen circumstances out of their control, that may have me lose a once viable embryo , and then to equivocate it to manslaughter, absolutely not. This madness is all because of the unreasonable and impassioned zealots overturning Roe V Wade. They've completely muddied our ability for critical and rational thinking.

Ah Alabama. Last in Education, life expectancy, household income, per capita income… But first in teen pregnancy, in fact mortality, maternal mortality, poverty, and obesity!

Embryos are not people. The US government (yes, even the ones who try to claim it is) says so. It’s not in the census, it’s not taxed as a person. People say, “I have one kid with one on th way,” not “two kids.” You can’t have it both ways.

I went through IVF and can not imagine going through what I went through, then being told that opportunity has been taken away from me. However, I don't think that nurse went out to destroy my embryo so I would not call it murder but I would go for negligence...

We did IVF. In our view, an embryo is the dough. Not baked yet. Not alive. Not even attached to the mom.

To consider the events that led to this lawsuit to be demonstrative of "wrongful death of a minor" is ridiculous. Full stop. In doing so, the court has effectively decided that all frozen embryos must be kept in perpetuity. Those receiving or providing IVF treatments can no longer decide to dispose of, nor donate these "minors" to research - whether as a result of having successfully conceived; or, having decided to forego further attempts to avoid further heartache, etc. Any parents of these IVF “minors” in Alabama who do not wish to continue to provide for and/or protect frozen embryos - whether due to having already successfully conceived; or, because of a decision to forego any further attempts (for whatever reason, especially to avoid further heartbreak as a result of non-success) - should file with the State’s family courts to voluntarily relinquish their parental rights. If the State (namely its Supreme Court) and legislators/executive insist that these “minors” be protected as would any other child, then the State of Alabama’s Department of Human Resources can do so via foster care and adoption services. The state can pay for its own storage facilities, etc. You reap what you sow.

My mother volunteered for her church's anti-abortion efforts, she was a retired nurse. I've been warning people for years that they're coming for your birth control pills and your IVF, but hardly anybody listened. I never had to worry about it due to fertility issues, but I worry for women with similar issues that can still get pregnant.

The Alabama Supreme Court and the state of Alabama honestly have bigger fish to fry than to be worried about this IVF situation! Let’s start with where they’re ranked in education and the many other things that affect the children that they say they care about so much.

As someone who has gone through with feezing my eggs, even i was told that IVF only has about less than a 50% success rate in life birth. So even with those embryos that were unfortunately destroyed, there was no guarantee those would have turned into live births. SO How can it be a wrongful death in hypotheticals situation?

"Mistakenly dropped" an embryo in Alabama is now equivalent to a charge of Wrongful death of a minor. This was the question Sunny, not about your personal privileged journey to motherhood. Sheesh! As a Christian, I heard a pastor say once. I am so glad I was introduced to Christ first BEFORE the Christian and I get it. Our beliefs are OURS and it is egotistical to force them on someone else. Even Jesus didn't do that.

So, let's say a 30 year old woman was not sure if she wanted children because maybe her career was taking off, or maybe she didn't have a love in her life, or maybe she just doesn't want children but is constantly told "one day you'll change your mind" decides to be sure of her decision. So, she freezes her eggs to come back to it at a later time but then years go by and she makes a final decision to never have children and she gets rid of her eggs. Does that make her a murderer of her kids. Or a neglectful parent. Should she be charged? This is beyond insane.

The plaintiffs in the Alabama case had undergone IVF treatments that led to the creation of several embryos, some of which were implanted and resulted in healthy births. The couples had paid to keep others frozen in a storage facility at the Mobile Infirmary Medical Center. A patient wandered into the area and removed several embryos, dropping them on the floor and "killing them,” the ruling said. Chief Justice Tom Parker issued a concurring opinion that quoted the Bible as he discussed the meaning of the phrase “the sanctity of unborn life” in the Alabama Constitution. Justice Greg Cook, who filed the only full dissent to the majority opinion, said the 1872 law did not define “minor child" and was being stretched from the original intent to cover frozen embryos.

Because of that is what I heard that hospital and anyone else should be held liable for the fact that another patient had access to someone else’s embryos. The problem is it will affect IVF procedures in general, scientists/technicians would be liable all the time, it’s a procedure that’s not always straightforward, so where is the line, basically people will not be able to do IVF. Again religion should not be mixed with politics, politicians can have their values but represent their constituents. A woman should have the right to do what she wants with her body, imposing laws because of religious beliefs is not on.

So I have a question... If the Embryo is a minor, can a person in terms carry said embryo on their taxes? Receive benefits for said embryo? Not being funny but asking a serious question.

As an IVF patient myself who possesses photographs of all the embryos I have had transferred (one of which became the 2-year-old son I have now), I believe that a 5-day-old embryo (a blastocyst) is life...but it is not a person. The embryos which never successfully implanted or miscarried after a few weeks does not carry the same definition of life for me as the son I feed, bathe, and put to sleep every day. Embryos do not have a heart. They are not the same as a fetus. They are a clump of cells which have barely differentiated between baby and placenta. Visually, they kind of look like cauliflower under the microscope. I think it is absolutely tragic that people have lost their hard-earned embryos due to a mishap. I would have been devastated and furious and I would have sued and demanded consequences. But should the loss of my embryos carry the same weight as the loss of my son? ...I don't think so. Losing my son would be greater, because he is a living, breathing, thinking, feeling, and growing individual. Ofc all this is just my opinion, but I thought it'd be nice to share from experience. I have many friends and family members who have become biological parents, but who have never seen or thought about what an embryo looks like, or how the earliest days of development works. Many don't know they're pregnant until they missed signs and get a positive pee stick. At 5 days of life, an embryo hasn't even attached to the womb to create the hcg hormones necessary for pregnancy symptoms. It's that early; only one tiny delicate step further than eggs that get shed with menstruation or sperm that gets lost with ejaculation.
