But genocide can refer to the determination to destroy a PART of a population, not necessarily the whole, isn’t that true? Palestinians are being killed in the tens of thousands (about 30,000 so far), but many more are injured, maimed, displaced and suffering from starvation, homelessness, PTSD and a break down in social order. Surely all of this points to an enormously harmful impact on Gazan Palestinians which at the very least constitutes war crimes and crimes against humanity, I would think.
About 10,000 of those deaths (of the alleged 30,000 deaths) are those of Hamas militants/terrorists (some say even higher numbers have been killed). Then you get the deaths caused by Hamas initiated collateral damage to Gazan people, such as those who were maimed or killed by the explosive booby traps and ambushes set up by Hamas, and also their failed rocket launches within densely populated areas, such as the one that landed in the hospital parking lot and killed at least 50 people and maimed many more. These figures could add another 5,000 to the total. Then you also have the deaths caused by Hamas stealing the fuel/petrol from the hospitals so they cannot run their electricity generators and keep infant incubators and other important equipment running. Then there are also deaths caused by Hamas stealing food and medical supplies, aid which was meant for the civilians, and not for themselves. And finally you have the deaths caused by Hamas launching their attacks from within or in close proximity to a) schools, b) clinics/hospitals c) mosques d) residential apartments --- basically using there proximity to civilians to try and deter IDF counter-attack --- this is in blatant contravention of the Geneva convention because it endangers the lives of the civilians. If anything, the charges of war crimes or crimes against humanity should be brought against Hamas.

A 15:2 decision despite so many of the judges come from countries that support Israel. The decision did not just get over the line. That number of judges that found against Israel indicates the strength of evidence against Israel.
I am curious: Do you usually hold the ICJ in such high esteem? Have you been following all its previous deliberations? Are you a barrister? Have you ever been in Israel or Gaza? Can you specify the "evidence" presented there and what the law says about them?
Whilst some people say there is genocide? they do not mention Hamas shooting Gazanians and also robbing them of emergency food which could help in the applying of genocide. People are picking and choosing who they accuse and leaving out others.
The South African supreme court Justice indeed has tracked back on the report but its known that he was subjected to huge pressure form several lobby groups. Honestly i felt like the guest with his level of experty level is trying to downgrade whats happening & is manipulating some aspects of the reality. Academicians are supposed to be neutral
They are not all civilians of course Israel has confirmed to have killed about 12000 combatants, so the ratio is amazingly low, close to 1:1, compare to other urban warfares around the world. Many of the killed civilians got killed by their own misfired rockets, booby traps they planted all over and more. Terror organization is not a reliable source...
It's kind of like in the ukraine conflict, you have organized armies fighting mostly from military emplacements or mostly evacuated cities, instead of ununiformed guerilla fighters who glorify death hiding amongst civilians

International law was formed as a civilised way to prevent war but killing beget killing is as old as mother nature human tribal war started where retaliation or revenge will always took place ,law or no law, Putin does not give a hood about International Law and ICJ. South Africa should care more about Rwanda genocides,their own fellow African rather than antisemitics toward Israel.
A common response from Israelis...'Do not concern yourselves with our genocide. It is ours alone. Go look at some other genocide closer to home'. Incredible moral vacuum resides in those thoughts..

The IDF has sent hundreds of thousands of phone calls, left phone messages, text messages, set up information on Social Media and used their own forces to clear a humanitarian corridor to the South. That was done to lessen casualties, not to try to kill people.
