People worry that if they refuse to take voluntary DUI tests that it will look suspicious or be evidence of guilt. They worry that the officer will think they are guilty if they refuse to take a field sobriety test. In Virginia, refusal to take field sobriety tests cannot be used as evidence of intoxication in a DUI trial. But officers can sometimes use refusal as justification for arresting you, but only if there is other evidence that you are intoxicated.
