The DMCA system is so stupidly easy to abuse. I remember those years ago when a 3rd party copyrighted pewdiepie's own music video on his own channel with the reason being quote "On behalf of pewdiepie"

It isn't IF it was Nintendo, It is that we BELIEVE it could be Nintendo. They have such little good will left that it just makes sense for them to do such a thing. If a more customer centered company did this, we might be inclined to disbelieve it.

So, this is an important question: Would this eventually include youtube videos that have this content in their videos? VanossGaming? Garry's Mod Idiot Box? Team Fabulous 2? I wouldn't even doubt they would take down the late Kitty0706's videos for their use of maps and characters from Nintendo in his videos. May he rest in peace. Where is the fair use when it comes to this? After 20 years come in and force takedown on workshop creations. It's almost like a modern day burning of the Library of Alexandria. Just history gone in the blink of an eye.
Nintendo is the only company that could have somebody impersonate them and get away with it, because the same bullying tactics are what their own people use.

A couple hours ago, Garry Newman said he verified it coming from Nintendo. This reminds me of when Nintendo was taking down music and people were swearing left and right it was a fake Nintendo until the uploader confirmed it was real. Why are people so quick to jump through hoops for Nintendo thinking they wouldn't already take down stuff like this?
People do believe that Nintendo would take this stuff down. Not only is this comment section an obvious example, but people put the blame on them all the time. Plus, we're in an age where people instantly believe that any source is legit, even if it does turn out later to be false anyway and never learn to take things with a grain of salt ( *insert relevant celebrity allegations that turn out to be false here* ), do people expect that majority to take that with a grain of salt if they said that Nintendo did it?
I think that, for the most part, people don't want it to be legit because that means that all of it is actually being deleted. They can't go 'oh it's just a troll, we don't have to delete anything', they have to delete it because it's the official company.

Reminds me of Pokémon fans who absolutely glaze them when they put out the same Pokémon game they did in the 90s but with more Pokémon and maybe 1 or 2 unique mechanics if that.
Because the idea is branding. Imagine someone sees or experiences Mario with a gun or whatever committing violence. There's gonna be an association with Mario being violent, which makes it less likely for people to consider him kid-friendly. You're probably going to say something about how only stupid people won't realize it's fan-made content. It doesn't matter, whether or not you like it, exposure is all you need for the brain to make the association. It's why advertisements work, even if you think you don't care about the product. It's called the mere-exposure effect. That said, I'm not a fan of this move either.
I would love to enter the contest because my current pc is so bad that it barely runs microsoft word to do essays for my university work but there is certainly more hard core gamers out there that will use it to its fullest potential given the specs, so i wont.
Honestly, seeing how often "Nintendo" gets brought up in DMCA Takedowns, and how there are multiple examples of people faking Nintendo to takedown stupid fun that people are having, you just have to be skeptical whenever this happens.

After Gmod putting out the thing on steam the second this was discovered, I knew everyone was gonna cover it. It's more devastating when you see something not only happen to a game you own, but see it before any youtubers or news brought attention to it. It felt frustrating and lonely. Now I feel a little better seeing everyone pick up on it. Gmod was my first steam game back in 2014, I now own hundreds others in my library. Gmod was the main reason I got a steam account. I know the game will be okay, but this is such an injustice.
I want someone to make a compilation of all the ways Steamboat Willy was bastardized, and the compilation ending with a character looking at a photograph of an Italian plumber while saying “You’re next”. And then send this compilation to every Nintendo email.

Even if it's not Nintendo, it doesn't really matter to me because Nintendo does not speak up about this. All they need to do is say it's not them and Facepunch can ignore the DMCA, the case would be over.

The moment Facepunch reached out to Nintendo, or worse, the Nintendo American branch, people say that was done and done. As they say the American branch of Nintendo is somehow worse than any other branch. People say the Australian Nintendo branch is the most lenient of the Nintendo branches internationally. The American one is said to be just as eager to strike down anything at any opportunity. So really, regardless if they were legit or not, US Nintendo would gladly side with anyone who DMCAs on their behalf. Heck impersonating and weaponizing DMCAs is completely legal if you play your cards right. Because you can weaponize moderators and administrators in places like discord or reddit. You could DMCA on behalf of Games Workshop and Disney, and they will JUMP AT THE CHANCE. Literally Disney copyright struck a Parody of We Don't Talk About Bruno... but it happened some time after the video went viral. So the creator had only one question, like why they copyright struck it when it was already past it's peak of views. Which is reasonable, he already got all his money's worth in ad revenue. Which sounds funny tbh. But it could ahve been a Disney appointed web surfer, if Disney hires 10,000 Consultants for their entertainment industry, they can afford to hire maybe two more divisions worth of people just to surf the internet and copyright strike to do stuff. Could just be a legion of interns. Nintendo America, while they are moral enough to condemn Activision Blizzard's worth place practices, they are not above jumping on DMCA takedowns a step above that of Japan's Nintendo. Or so people say. I cannot vouch for if they are worse than Japan's Nintendo branch, only that people say Nintendo of America is the most eager to jump on DMCA takedowns without a second thought. That's what people say. Either way, Nintendo is very, very anti-fan content. For the fact it kind of gives "Bad Exposure" for their brand or it shows how fans dedicated and with extra effort can make games that even surpass their own. Which some radical Nintendo fans hate for being "Not made by Nintendo".

As a recent active g mod player I can assure you that nobody is even using Nintendo stuff in gmod servers and nobody is making money off Nintendo they are just single player add-ons.

That's because Nintendo saw what happened to Bliznerd's with DOTA. It was a small game; then took over WC3 entirely. Now they can't get a *DIME* from it because it was moved off their platform. The second you make a map for anything related to Bliznerd *YOUR* IP is considered to be *THEIR PROPERTY* because of the changes to the EULA when they re-released. Nintendo behaves the same way, they just do the "Japanese Way" where they "keep face and maintain honor" which works until you know how their country is still feudal in mindsets. Sega doesn't have the manpower or lawyer power to do the same stuff Nintendo does, because Nintendo is on the spectrum when it comes to dedication to protecting their IP's at any cost.
