Very good info. I am at the waiting point. USCIS naturalization paperwork. Corrections on a birth cert. Then it's apostilles, and translation. I hired an Italian attorney for the guidance and making contacts to local officials for appointments. Already have all other documents. Phew. Yes, it will be over 2 years since the start of it all and YES, it will be worth it. Thanks.

I hit some hard snags on my Fathers side for documentation!! I keep coming back and listening to your logic on eligibility several times to help me process both sides Paternal and Maternal as I was researching and going through all the document finding!! The Maternal side was pretty cut and dry as you helped me figure out since my mother was born after 1948 and my grandfather was born in 1924 before my great grandfather had petitioned or was naturalized in 1930@@thelemonabroad

Hi! I’m glad you found the video helpful! After a quick search, I would recommend that you visit the website of your local consulate, the one that you would be submitting your application through. When you go to the “Citizenship by Descent” page, it should have a list of documents you are required to submit and where to find them. There are a few different offices that can issue a certificate of “No Record of Naturalization.” These include the USCIS and the National Archives (NARA). * The reason I suggest visiting your local consulate’s website is that it seems that individual consulates differ on which source or sources they would like this document to come from, and some have even further requirements to show that no naturalization occurred. Best of luck with your search!

I'm trying to get the Italian citizenship by descent correct. Please some help: My great-grandfather was born in Sicily in 1892 and came to America in 1910. He wasn't naturalized. He married another unnaturalized Italian in 1915 and gave birth to my grandfather in 1918. My grandfather married an Italian descent American and gave birth in 1944 to my mother (an only child). My mother was impregnated by an Italian man but they never married, and his name wasn't put on my birth certificate. Based on this narrative, might I be eligible to be an Italian citizen by descent? Thank you!

Ciao. Grazie mille

I do have one question in that if your parent my father in this case is Italian and holds a passport would you still have to provide all the aditional paperwork apart from his passpsort, birth certificate and identification card? He's my father , he lives both in the UK and Italy he divorced from my mother a long time ago but is my immediate relative and as such I assume I dont have to look for my Italian grandparents history right? This is somewhat confusing but I am in it for the long run and will do what ever it takes, thaks once again Grazie!

Hi there and thank you so much for watching! The general guiding rule is that you only need documents for people until you reach the ancestor you will try to claim citizenship through. Since you say it is your father, then you would only need the documents relating to you, to him, and to your mother. I don’t see why you would need to go back any further. You should be able to find a resource for which documents you need from your local consulate, and contact them with any questions related to your specific case. Best of luck!

I spent 4 solid full-time months obtaining my documents but have been trying to get a citizenship department appointment with my local US based Italian Consulate for nearly a full year. It is beyond frustrating and I've started to look at other options since the website used for the scheduling the initial appointment is a mess. In the last 12 months, I've managed to only get into the Calendar section of the site twice, and each of those times there were no available appointments. When I've called the nearby Consulate all they can tell me to do is keep trying, but I need to find other options for my own mental well being. One option suggested is relocating to Italy but I would be forced to reside there for a year during the application process. This is obviously a challenge with a job, mortgage and teenage child. Another option seems to be having an Italian lawyer apply through the Italian court system, but it is very expensive and I'm unsure it isn't a scam. Just wondering if you know of any other options or can comment on my sad predicament, which regretfully it seems many others are also in....?

My question is about June 14, 1912. I was under the impression that that date was the cut off for immigration date. Meaning, if the ascendant emigrated before this date then the line was broken and if they emigrated after this date, the applicant would only qualify if the ascendant didn’t naturalize. Which is right?
@thelemonabroad
@thelemonabroad 5 месяцев назад
Hi! My understanding of the 1912 date is not about emigration, but about naturalization. According to what I found online, before 1912, naturalization of an Italian citizen in a foreign country meant the loss of Italian citizenship for him, his wife, and his minor children. After that date, if an Italian citizen naturalized in a foreign country, Italian citizenship could still be passed on by blood, but only to children who were born before their parent naturalized in a foreign country. Children who were born after the naturalization were not considered citizens by descent, which is why in some families the older children are eligible to claim Italian citizenship, while their younger siblings who were born after their parents naturalized are not. This was the law until 1992, when Italians no longer lost citizenship due to obtaining a foreign citizenship. That is my very oversimplified understanding of it. However, there are many resources online that try to explain it, and if this applies to your situation, I would definitely investigate further!

Hello! As far as I know, enrollment in AIRE is not automatic, however I also don’t think a consulate would release a passport to someone if they are not registered with AIRE as a resident in that consular district. In any case, I would contact the consulate to see how to proceed and make sure the AIRE registration is current and how to take an appointment for the passport.

@thelemonabroad
@thelemonabroad Год назад
Hello! To be honest I had not heard of this declaration process before. And since I am not an expert or professional, I cannot give a definitive answer on specific cases. I will say that, in all my research, and after taking a cursory look at some Italian citizenship resources available online, it appears that the significant date here is the actual date of naturalization, since that is when someone would actually complete the process of becoming a US citizen. And since that was after the birth of your father, this declaration should not be a factor. This is at least according to the resources I have found online.
@Cryptid71
@Cryptid71 Год назад
I think you might want to add one more date. Because my grandfather announced his Italian citizenship in 1928, about 10 years after he had arrived in the United States. The Italian embassy told me that that made me an eligible for Italian citizenship. The person did, however, seem half interested, so I’m going to go ahead and talk to an immigration lawyer, because I don’t know if they were just blowing me off but that’s what I was told.
@thelemonabroad
@thelemonabroad Год назад
Hi! If you have some doubts about whether to proceed with your application, especially in special cases like the one you are mentioning, you could consider seeking external consultation to verify your claim. If an Italian citizen "renounced" or gave up their Italian citizenship before the birth of the next person in the line of descent, that could mean it is not possible to apply through that specific line of ancestry. Someone who specializes in Italian citizenship acquisition may be better able to analyze your situation. Best of luck :)

If your father was born to your grandfather before he abtained his American Citizenship then you would qualify. Your father must be listed on the Naturalization document, hence he was alive before the Naturalization date. Also you have to prove that your father never renounced his American Citizenship. Then you are good. Check with the Naturalization people for proof. Good Luck

The time to process your application can vary widely - it depends on a number of factors including how many applications your local consulate is currently processing. The consulate also may request additional supporting documentation from you that could increase the processing time. Generally speaking, one could expect a few months to one year for their application to be processed. However, you can always reach out to the consulate if it has been a long time since you've submitted documents to check on the status of your application.

@thelemonabroad
@thelemonabroad 5 месяцев назад
Hi! I would definitely check out your local Italian consulate’s website, where they will have an “Italian Citizenship by Descent” page. Here it should explain all the different dates and requirements that are necessary to be eligible for citizenship. Because each situation is unique, that would be the best place to start. I believe you have to apply through an ancestor that emigrated from Italy. However, check the dates against your specific situation, and also remember that there are some exceptional cases being made, particularly in regard to applying via a female ancestor. The consulates (and me, too) recommend to check your eligibility through finding your ancestor who emigrated’s birth certificate and naturalization record (or proof no record exists meaning they never naturalized) before collecting the other documents, which can be expensive and time-consuming. Your local registrars and the anagrafe (registry) offices in Italy should have even historical records.

How exciting! I have Italian ancestral dna but it’s too far back probably. My husband is French but lives in the us. He’ll first have to get his French passport again I guess and then give us the citizenship then. I wonder how easy it is to move to Italy if you’re a French citizen? 🫢
