New Zealand Centre for Sustainable Cities event. At a time when housing is becoming more unaffordable and homelessness is on the rise, facilitating the construction of homes on Māori land seems like an obvious solution. But is it as simple as that? What are the legal ramifications of building on Māori land? And what are the potential legal barriers landowners may have to navigate?

My home is on maori freehold land built in 1969 by my father who held a lease from 1950 to 1976 of his fathers land, he knew the govt were trying to break his lease and refused to concede to their offerings

Having worked for one I can say that all the land held is put in by the individual owners and they received shares back proportionately. It is often tenths land.

The Maori land Court are not Tikanga Mauri. They do not cover Mauri customary land usage, Maori land Court are a Corporation, the same as the Corporate Government The Government is registered at the securities and exchange Washington DC. This Government is equivalent to as the same Franchise business. And also county council. Mauri/Native freehold land is not for commercial franchise , business. But is wholly covered by customary usage. The word "Maori" was invented by Queen Victoria council, so that they could commercialize the Natives of Aotearoa.

Really? No more than the 'commercializing' of any other 'subject' of the Crown. Maori retained their chieftainship of their land and chattels, just as any other existing NZr retained the rights to their land and chattels as subjects. That didn't mean Maori could entirely do their own thing ignoring the laws of the land - the same ones everyone else had to obey - i.e. just as all NZ'rs have to pay their rates and taxes today. And where do you get this nonsense about the Maori Land Court being a corporation and what's the US SEC got to do with the price of fish? But you're right, they didn't have a collective name, just as they didn't have 'one voice' and underscores the utter nonsense of co-governance. Co-governance with 500-odd separate chiefs? Bollocks!

And don;t forget a lot of Maori land was legally sold by Maori to settlers and only when the title issued, other Maori in the tribe rejected the sale leading to war and confiscation. No fault of the settler.Prior to 1840, land was taken by tribal conquest. Tribal Pograms were common but not talked about today.

@@dd2451 I think the damage was done with a too humanitarian note struck in the treaty that recognized customary title/ ownership of all the land [even wasteland] to the tribes [keeping in mind that the land in NZ was vast in proportion to its inhabitants]. Previous to this, only cultivated/ possessed land, was recognized as owned [Lockean mixing of labour] and certain rights to fisheries and hunting grounds recognized. Once the tribes saw the commercial/ economic value of land, by its exchanging hands a few times, they set up a land league... and then the inevitability of conflict/ war.

War time acquisitions by the Crown for the war effort... never to be returned as promised! The leases are another example. Anyone can build on Papa kainga land, so long as you talk to most of the share holders to, build upon. It is in the best interest to build a house reasonable strong have a proper electrical fit and safe wiring. Maori have the right build with out informing any legal law. Te ture whenua land law, is not in charge, it is not the boss, The Maori share holders are the Principal owners. Maori lore is lore, the legal law does not have autonomy. Loans from any New Zealand Bank is designed to debt trap, and take the land away from the Maori land owners.

It seemed reasonable, but I gather the Maori language has different meanings for some words, so it's not surprising it departs somewhat. @@utubermax Theres always 2 sides or more to a story. Theres about 15 countries in the british commonwealth monarchy 2023. Maybe 15 stories of facts and interpretations. Im sure the Scottish and the Irish interpret what had happened to them differently than whats taught in the colonial schools in britain and even nz concerning their lands and freedoms of choice when the british invaded them. When the victims of colonisation get to tell there story after research and study of history, no matter what language they speak, most of their story is about civil war instigated by a foreign force that wanted the real estate, oils, minerals, and control of the population for industrial development. The outcome up til 2023 is the smoking gun, the monarchy still hold the bag. The Roman empire is alive and well in corporate entities including the vatican.

The English didn't come here guns blazing, nor were they an invading nearby tribe ready to take whatever, enslave, kill and/or eat you - assuming you were a local inhabitant. If you take yourself back to 1820, what was land and modern resources (like oil, gas and metals etc) to Maori, other than a means of exchange for colonial comforts and weaponry? And if life had continued as it was, where would they be today? The realty is you, personally, wouldn't be alive, because I'll wager you have some other (probably European) ancestry? But that aside, would you have anything more than you have now? I rather suspect not, unless your tribe were the successful usurpers. But perhaps to cut to the chase Reg, what's your view on whether Maori ceded sovereignty? That I think will crystallize where we respectively stand. Why don't you ask whanau who have lived on nga whenua Maori since mai rāno, what the barriers are to improving Maori land for papakainga housing. There are many barriers. Maori did not consent to their ownership of native land being changed to fee simple or freehold title. LINZ went ahead and created these titles without the owners consent transferring the whenua out of hapū ownership.

There is the legal, there is the lawful and there is tikanga over the land. Tikanga is lawful, but, lawful is not tikanga.Tikanga is supreme when or where maori customary land is concerned, that is, unextinguished native land title.

as to the building consents, what makes maori think they are exempt from the resources and building consents, if they own the land they can build so long as they do it the same as everyone else, who wishes to build on the land they own, this is one of the things they asked for in the treaty, to be part of the wider society of new zealand .

The reason for low incomes and poor housing had much to do with the cultural differences. Maori found it difficult to compete with the commercially driven Europeans. Some of the government wanted to protect Maori interests here, but many Maori resented this... wanting instead to be free to alienate their land if they so wished. A lot has to do with the cupidity of the chiefs at the time on the one hand... with the aggressive pushing of the land courts on the other. One way or the other, most land was going to be settled by Europeans.

The simple fact is, much of the land was uninhabitable, or not conducive to supporting native subsistence lifestyles that, and the constant waging of war and the exacting of utu wasn't good for population levels either.

Quite a history about the Maori - put the Inca's or the Aztecs to shame in degeneration. Outcast as weaker primitive Neolithic people by the invading Hawaiians & Tongans (Maori were from the original wave of primitive Asian/Melanesians pushed right out across the Eastern Pacific by successive stronger races coming from the west). They were outcast on rafts and some floated up in NZ stranded for 500 years. The weaker were pushed down to the South Island or Chathams etc. So the South Island Maori (had their own language) were the weakest of the weak. They were captured and eaten as 'Slave flesh' by the northern Maori doing raids. (Well they all ate each other - 80% of Maori pre European were dark skinned easily fattened slaves farmed and eaten by a lighter skinned 'Ariki' thin wiry elite royal caste). So it was with some righteousness as well as British cunning that they armed the southern Maori who then with muskets launched a genocidal war on the north.. That plus measles & flu halved the Maori population and removed most of the elite. The British then liberated the slaves and outlawed cannibalism. The northern Maori fought with the British against the south bad west Maori 'rebels'. The Maori sued for peace and a treaty was signed that removed all sovereignty and made them subjects to the English crown where the English would protect them from each other. Land could only be sold to or via the Crown. Maori could live on their reservations with native custom but none did. The treaty of Waitangi is strikingly clear in that the Maori cede any claim and give up and die as an original society - all 3 clauses lock that in. Nothing in today's 'Maori' culture is authentic. The music - all European (Maoris did not have tonal music, the songs are missionary tunes or introduced - Poi dance is from Islands and Stick dance from old Malaya. The carvings and art - all European - Arabesques that was the fashion at the time. Original Maori had limited dash carving and no painting of objects. No written language - all the syntax & grammar plus vowel inflection is European. No technology - some lagoon canoes and wood or stone Neolithic tools. No food sources - like pigs or crops - they left that all behind, all they had was a weak inbred fox (now extinct), some rats and a weak dismal pacific yam. They ate out all the bird-life, didn't know how to farm the sea as were island people and so they turned to societal cannibalism. Today - no full blood or half blood left. No genuine tradition and almost all are offspring of Maori slave females sold to white settlers for muskets or food. -So more fake than the 'Sioux' or 'Cherokee' or 'Crow' who had at least retained some genuineness about who they were and their history. -Everything you 'saw or experienced' is Fake. A totally convected disneyfied tokenistic set of inventions fueled by a grievance culture of almost totally European people fetishing a false past bad history because it pays benefits. Maori are subject to the same laws and legislation that every other citizen of NZ is subject to. Their biggest problem is thinking they are entitled to be a law unto themselves...they have always reneged on the treaty by continuing to deny they gave up their sovereignty. One would be a fool to build on Maori owned land....theres nothing unique about their land at all...!

Maori wanted the europen to come to Nz they wanted to live a richer more humane way of life, Waitara and Moriori have stated that Maori are not from their linagaes, the word Mauri comes from Muaritia east of Aficia and for more then a thousand years the european, Arab and indian estabislments have slave traded them across the world, the word Maori is given to them by Queen Victora, they do not know who they are
