Will misconduct allegations against a prosecutor sink the murder conviction of Jodi Arias, 39? Defense lawyers are trying to achieve just that in a hearing on Thursday before the Arizona Court of Appeals.
Maricopa County prosecutor Juan Martinez has faced allegations of misconduct in office for a while. Claims include sexual harassment, and revealing a juror’s name to a trial blogger. He was recently reassigned from death penalty to auto theft cases.

@Don Springstead have you seen the recent police cam footage of her out at a bar? It's infuriating, she literally murdered her daughter so she could go out & party & here she is going out to bars living her life. In the footage she called a police officer because another woman threw a drink at her & she said it was because the woman was dating Casey Anthony's ex who is a police officer. It makes me sick this woman isn't afraid or ashamed to be out in public

@Johnstable12 I recently finished reading his very good book, about the case. He was an excellent prosecuting attorney, working a little over 4 years on the case, working in his office, thruout many a night, alone, going without sleep or decent meals, til almost daylight, so it would be quiet, with no distractions. He stated that the reason he was tough on Arias, is because of her pathological lying, psychopathic, narcissistic, self. She could lie to anyone, without any problem, and was not nervous or displaying any anxiety with any of the interrogation, etc. He said that he had to be ready, with firing the questions at her, to outwit her, and throw her off. AND, HE WAS. I didn't know the details of why he was disbarred, but find it interesting that he would openly show any sexual innuendoes to the court reporter or blogger! Hmmm..... I do hope he sincerely repents of what he did, and can move forward with a productive lifestyle, of sincere character.

Absolutely nothing Martinez said changes the fact that Jodi MURDERED Travis. She admitted to it, she left DNA at the crime scene, she pre meditated it. I'm beside myself that this is happening right now.

"she left DNA at the crime scene" Jodi' and Travis' unknown DNA were mixed together in a latent impression of her partial left palm print on a blood-stained wall but it PROVED NOTHING. The lab only tested the latent impression for blood because only blood would put Jodi with Travis at the time of his death. Lisa Perry, a forensic scientist, did a Kastle-Meyer test on the latent impression and during the trial stated: "The results were NEGATIVE." All the latent impression did was show Jodi had been in Travis' house sometime during the last two years. Heather Connor, Mesa PD latent print examiner, stated: "There is no way to date a latent impression. In other words, there was no way to determine when the latent print was left there. It could have been in 2006 or 2007. Even Martinez mentions the latent print, in his book, when he's discussing another issue: "Like latent prints, the hair's presence was not enough to tell us when it was left at the house..." "she premeditated it" As for premeditation, the bullet in Travis's cheek is different than the type of bullet in Jodi's grandfather's gun. Renting a car with her credit card is not premeditation (she wasn't hiding her car rental), nor is using gas cans to travel through the desert at night. It was something she and Darryl Brewer did whenever they traveled in the desert. Jodi dyed her hair brunette on March 20, 2008 so she wasn't trying to hide her identity in early June, 2008 like Martinez said, again not premeditation. "she admitted to it" (murder) No, she claimed she killed Travis in self-defense because he was attacking her. Self-defense is not a crime or, at least it wasn't the last time I checked (1 hour ago).

@@kenmat1 no, slicing a man's neck from ear to ear nearly decapitating him does not sound like self defense. Inviting yourself to his house if you think he could potentially be dangerous doesn't sound reasonable either. And if it was all an accident and she didn't mean to kill him why are there stab wounds to the BACK of his head, why didn't she call the police, why did she attend his funeral and call his loved ones. Why, when questioned by police did she lie, first she wasn't there at all, and then she and him were attacked by men in masks, and then yes she killed him but it was because he was attacking her. None of it makes sense, the amount of times he was stabbed and where, her throwing her camera in the washing machine. Her going and pretending she had nothing to do with it leaving his body there to rot for days. Nope!

@@kitkat9032 Dr. Kevin Horn, the medical examiner, doesn't use the term "nearly decapitated" in his autopsy. Why are you? Jodi may have been invited to Travis's place. There's no evidence if she invited herself or Travis invited her. But, of course, you are going to say she invited herself because that fits the story you want to tell. Like Juan Martinez, it's not important if it's true or not. She didn't lie when questioned by the police. She said she wasn't there. If you're being attacked, you stab as much as necessary to neutralize (police term) the attacker. One stab or 100 stabs, whatever it takes. You really think Jodi put the camera in the washer. Seriously. An experienced photographer. She explained to Det. Flores how to recover deleted photos in her interrogation so she obviously knew deleting the photos, putting the camera in the washer wasn't going to destroy the photos. Even I know that and I've never owned a camera in my life. You taken everything Martinez presented as the truth. Doesn't the fact that he withheld evidence, destroyed evidence, got Flores to perjure himself and got Dr. Horn to change the gunshot from happening first to the gunshot happening last, manipulating and destroying a blogger's marriage while seducing her and sending her to dig up dirt on Juror 17 so he could replace her with someone who would vote to kill Jodi. Doesn't all this underhanded, illegal action by Martinez cause you concern that you bought the story of a corrupt lawyer who's only goal was to win no matter what he had to do to achieve his goal.

The fact is, she did kill a naked man in his own home, she didn't call the police afterword she tried to pretend that nothing happened. Fine the medical examiner did not say near decapitation. My point is knife wounds IN HIS BACK, my point is this man had no prior history of violence in his life, and typically if a man is violent there is a behavioral pattern that shows that. My point is that man is dead. And your going to sit here and argue with a complete stranger over how!?

You can be against Martinez narrative, you could argue all day long the things he said and did, but can you seriously tell me that ALL of the evidence against Jodi is garbage? Can you tell me why instead of calling 911 that day, she chose to conceal those events. Can you tell me if it wasn't her than who was it. Can you tell me why there's a knife wound accrossed his throat. That did happen, so can you explain how that fits the description of self defense? And one more thing, can you do it without stooping to the immature level of insulting the other person? I may not be as studied on this case as you are, and clearly we're both very passionate about our POV, but please be decent. We are still people after all.

Her lying abilities and fairy tale writing skills are impressive. If she wasn’t so blatantly self serving, dishonest, and wants to hold herself above the world, she’d be better off. The way this lawyer is trashing Mr. Martinez is just shameful. How these greedy tumors can get up and defend obvious guilty killers is despicable.

Susan, you're complimenting a serial sexual harasser, a man who cheated on his long-time live in girlfriend, a man who seduced a blogger not because he even liked her but he just used her to get information on Juror #17 so he could get the one holdout booted off the trial so he could kill Jodi Arias. The blogger was a married woman with a disabled child. Martinez was named as the co-respondent in her divorce. Couldn't you find some one better to admire?

Susan Berg I don’t think he did a great job- he was aggressive even to his own witnesses and came across like a rabid dog. He also got caught up in her manipulation - a more skilled, subtle lawyer could have avoided that. She admitted she did it however - I’m not sure how the conviction can be quashed .

Don't get me wrong, Jodi Arias got exactly what she deserves and needs to stay in prison. Her personality disorders dictate that cannot be a safe member of society and her crime was heinous enough to recieve life imprisonment. However, if you look without bias, beyond this case, Juan Martinez, has a long history of misconduct in the courtroom which is on record. He also has engaged in behaviours out of the courtroom that are questionable to the morality of his character.

In my opinion the most compelling piece of evidence is her stating on record, moments before being sentenced, that Travis was conscious as she attempted to decapitate him. She said this moments after watching his family say that they constantly hoped he was unconscious while she slit his throat. This combined with the fact that she constantly claimed throughout the trial that she had no memory of anything to do with the knife. She's never getting out.

It makes me happy to know that not only did the Arizona Court of Appeals uphold Jodi's conviction and sentence; but the Arizona Supreme Court and the US Supreme Court have also declined to hear Jodi's appeal.

@@LisaSimpsonRules I honestly can't help but wonder how Juan Martinez would have done if he had been the prosecutor in the trial of Travis Reinking aka the Nashville Waffle House shooter. Travis pleaded Not Guilty by Reason of Insanity to avoid being sentenced to Death Row because Tennessee is a Death Penalty state. Travis had a very long and well-documented history of mental health issues and was diagnosed with Paranoid Schizophrenia, Bipolar Disorder, and Psychosis. Examples of his mental instability include believing that Taylor Swift was stalking and harassing him. Ultimately, the jury convicted Reinking on all charges but sentenced him to life in prison.

Martinez committed MISCONDUCT 1. Martinez withheld evidence. He said there was no emails, text messages. Nurmi had to sue him to get them. He found out there were 896 pages of text messages (See Trial Day 6) 2.Martinez seduced a trial blogger and manipulated her to "find dirt" on Juror #17 , the only juror in the sentencing trial who wouldn't vote for the death penalty. Martinez hoped the blogger could find something so Juror #17 could be kicked off jury and replaced by someone who would vote to kill Jodi. 3. Martinez made contact with Juror #3, who had been kicked off jury, and used her to find out how jurors were "leaning" toward executing Jodi. He also told her he was a "breast man" so she sent him photos of her breasts. 4. Martinez also leaked information on Juror #17 when the hung jury prompted a mistrial in death-penalty phase. Juror #17 received death threats and had to have police protection.

@@jizzahm Nice comment. Second degree murder (not what she was charged with) is 10-25years. If Juan & Bill Montgomery had charged her with 2nd degree murder or the jury had chosen 2nd degree, there is a possibility she would be free now. She's already served 11 years and a few months and been a model prisoner (with 1 non-violent penalty). Several lawyers stated Jodi was overcharged. There was a Mexican hit man who killed a guy in Arizona and cut off his head. He only got 14 years. There are many cases on "Jodi Arias Is Innocent" where they list worse murders in Arizona with killers who got much less time in prison. I think the reason Jodi was charged with 1st degree murder was because Martinez realized a beautiful woman who could end up on death row, a bloody Mormon corpse and lots of sex was going to draw a huge audience and make him famous and rich (and with his new fame, the ladies would be fighting to get to the front of the line for a sampling of Don Juan).

That sounds possible. I would say the same thing about the Chandler Halderson case (sentencing coming soon) were it not that the defense counsel were all older. The evidence is so ridiculously one-sided that it seemed like the defense was there to merely keep the prosecutors in line.

Jim Brown we can disagree as much as we want, at the end of the day she has the right to a fair trial like every other person that is accused of a crime. Misconduct by prosecutors is unfortunately an epidemic, that stems from an addiction to winning at all costs. This unethical (and illegal behavior can no longer be ignored).

Jennifer Willmott, one of Jodi's lawyers (I'm telling you who she is because you obviously didn't watch the trial) put her professional reputation on the line by saying: Jodi didn't lie DURING the trial but she did lie BEFORE the trial (when she wasn't under oath). But, we have to remember Juan lied all through the trial except when he was "misconducting like rabid dog" and taking a blogger into a hall closet outside the courtroom. Hmmn, wonder what he was doing in there.

Publicpersona I recently learned that prosecutors are legally allowed to LIE. Look up Ryan shoot I can't remember his last name he was wrongly convicted of murder sent to prison for 10 years. He was driving home after leaving a college class got pulled over and it took 10 years for him to be free.

I deconstruct the so-called "evidence," piece by piece, slowly and methodically. But, I have to give credit to hundreds of other people I have talked to in the 7 years I've studied this case. Many others have examined this case and shared their thoughts and beliefs with me and others. "admission to murder by Jodi" That short statement alone tells me you know nothing about this case, Freddy dear. Jodi has never admitted to any crime... period. She made a plea of "self-defense." She claimed Travis was attacking her and she had to kill him to save her life. And, only she knows the truth of that statement. And, even she may not know for sure. Martinez doesn't know if it was murder or self-defense (he added 2and 2 and came up with 5), Nurmi doesn't know, either. And, you, Freddy, definitely do not know. And, BTW, I don't know, either. "sociopathic mechanisms" Please explain how her 'mechanisms' (whatever that means) could be 'sociopathic,' since Jodi has never been diagnosed as a sociopath or a psychopath and you're obviously not in any position to diagnose her. "the overkill of Travis" A person fighting for his/her life fights until the attacker is "neutralized," as the police like to say. Only ONE wound was definitely fatal; another was potentially fatal unless there was immediate medical attention, the gun shot was not fatal since it didn't enter the brain. The other wounds were non-fatal wounds. The only people that use the term "overkill" are Jodi-haters and the uneducated. Dr. Horn, the medical examiner, never used that term. "the actions Jodi did" What proof do you have of "the actions Jodi did?" Maybe, she wasn't even there. Did you ever think that was a possibility? There is ABSOLUTELY NO PROOF JODI WAS WITH TRAVIS WHEN HE DIED. The photos taken with the *MAGIC CAMERA only showed Jodi was in Travis's house up until about 1:50PM on "June 4, 2008," ALMOST 4 HOURS BEFORE TRAVIS'S DEATH although we have no official time of death because Dr. Horn knew better than give a time of death. He wasn't willing to lie for Juan Martinez again. Even Martinez, in his ghost-written "book," wrote that Jodi could have left Travis's house after the nude photos were finished being taken around 1:50pm. *The magic camera that stamped date and times on some of the recovered photos when Travis's camera didn't have the capacity/capability to place date/time on photos. Also I know professionally the wounds very well. She shot him in the head/face (fatal), slit the throat ear to ear (fatal), stabbed him various times which causes blood loss compounding to death (fatal). My dear child you are very uneducated in the medical field. People can die from one stab wound/ gunshot let alone all of those compounding together is overkill beyond belief. Also there is video depicting her stating she did kill him. The fact that she did it from self defense was disproven by her various lies to cover it up, her beyond overkill methods, her changing the story many times, leaving a voicemail after all of that on his phone to meet up, and having a reason to do it because he was taking another person on vacation after dumping her as she was psychotically upset about it CLEARLY. Again your moral compass is very skewed, I feel for those close to you. Perhaps you can relate to something in this case clouding your judgement, in any case though goodluck on being very disappointed as she will die in prison. Jodi shot herself in the foot during sentencing when she stated "I remember the knife going in Travis' throat, and he was conscious" after months of denying she remembered anything due to 'fog' ... If there is a retrial , hopefully the death penalty will be introduced and she can get the sentence she deserves. She is a truly evil, vile human being.

Why don't you write her complete statement? What Jodi actually said was: "I do remember the moment that the knife went into Travis' throat and he was conscious. He was still trying to attack me. It was I who was trying to get away, not Travis, and I finally did. I never wanted it to be that way, judge." I'm sure everyone (with an IQ over 60, my apologies if that excludes some of you) knew Travis' throat had been cut when he was alive. It would be unusual and pointless to cut a man's throat if he was dead. The only people making a big deal of Jodi's statement is the haters because they don't know the whole statement and therefore don't understand Jodi is making a final plea for a lesser sentence by saying she never wanted to kill Travis but he was attacking her and she had no choice. She's allowed to make that statement. It was still America in 2015.

Willmott claimed Jodi's memory, for many issues, was returning and she had remembered the throat cut long before she made her statement on April 15, 2015. It's OK though. She was pleading with the judge to not give her life in prison without any chance of getting out. But, Judge Stephens was an elected judge and knew there were thousands & thousands of Jodi-haters who would vote her out of office if she showed Jodi any mercy. So, Stephens saved her career and sentenced Jodi to die in prison. A girl's got to protect her ass and her country club membership. But, kimmybbbyeah, you can tell your way if it helps you to justify your hateful rantings about Jodi.

I don't think they will put Jodi through another trial because there won't be enough evidence to convict her. 1. Nude photos putting Jodi in TA's house on June 4, 2008 and the theft of a .25 caliber gun from Jodi's grandparent's place (where Jodi was living) may be thrown out before next trial. The photos were tampered with by unknown person(s) while in police possession (i.e., someone marked time & date on some photos before giving TA's camera containing Duo Memory Stick to Detective Michael Melendez, the forensic computer specialist . Martinez never validated the stolen gun with Jodi's grandparents but instead used "hearsay evidence" by having a police officer testify to the theft of the gun. This was an appeal issue. Both of Jodi's grandparents are now deceased. 2. No blood DNA evidence. No bloody palm print. Biological material from TA & JA mixed together on latent palm print was NOT BLOOD (Lisa Perry, MPD lab). Plus, Heather Connor, Mesa PD latent print examiner, stated: "There is no way to date a latent impression." TA's blood on JA's hair in TA's house was meaningless b/c Jodi was in TA's house many times and her hair could have been left at any time. 3. No eye witnesses. 4. No weapons recovered. 5. Jodi never dyed her hair brunette to disguise herself at TA's house. She dyed her hair brunette on March 20, 2008 (2.5 months before TA was killed). She darkened her brunette hair in early June, 2008 b/c she was meeting up with Ryan Burns (a potential new "boyfriend"). 6. She had gas cans b/c she was traveling through the desert at night alone. It was a common practice she & her former boyfriend, Darryl, had used. BTW, she did return the "gas" can at Walmart's but it was a blue kerosene can, not a red gasoline can and couldn't have been used at a gas station (illegal to put gas in a kerosene can b/c of danger). Google Jodi's Walmart receipt and see what come up. 7. She turned off her phone while driving in the middle of the night. Turning off a phone, when not using it, was a recommended practice in 2008 b/c of the quality of the batteries in those days. 8. She rented a car using her credit card. Obviously, if she was on a "covert" mission to kill someone she wouldn't use a credit card with her name on it. . 9. Jodi claims in her law suit against Kirk Nurmi that it was his idea to plead self-defense. So, her saying she killed Travis in self-defense will not be introduced in a new trial that "starts from scratch." She'll probably plead "Not Guillty" and not testify. WHAT EVIDENCE DOES THAT LEAVE FOR A NEW TRIAL?

Ruple Thaker to give you an idea - an interviewer once asked her point blank - is the public safe when you are out? And her answer was ‘yes, if they don’t abuse me and threaten my life’. We all know from the evidence Travis was no threat to Jodi when she killed him. So in her twisted mind she still feels justified in killing him because her feelings were hurt by him. When she was sentenced she said she remembers slitting his throat - when all trial long she has these ‘memory gaps’. Dr deMarte said its uncommon for that memory gap to occur the way she described (such a huge chunk of time just gone)- and now we know those memories are not gone. All of that goes to show just how convicted she is in her lies. She can even manipulate herself into believing she is justified in doing what she did with little remorse. She is dangerous because she has no remorse, feels justified in comitting her crime and has never told the truth about why she did what she did.

I’ve just finished listening to the whole of the trial and I take my hat off for Martinez. He did an amazing job and especially listening to the scrambled egg when she was on stand. You can see the frustration in Martinez’s voice many times but he maintained his composure. His goal was to see her put away for her heinous crime and he did an incredible job at doing just that. Jodie Arias wis dangerous and should never be let out in society. And yes if you listen to Martinez’s interview with Fox, apparently on the day they arrested her she had a rental car and she had a gun and a knife in her possession. Sound familiar?

Juan Martinez would have been awesome if he was the prosecutor in the trial of Casey Anthony and he would have been gotten her sentenced to death. I wonder how Juan would have been if he was the prosecutor in the trial of James Holmes. He is the perpetrator of the shooting at the Century 16 Movie Theater in Aurora, CO in July of 2012. This was the worst mass shooting spree in the Denver metro area since the 1999 shooting at Columbine High School in Littleton. James pleaded Not Guilty by Reason of Insanity to avoid being sentenced to death for his crime because Colorado was still a Death Penalty state in 2012. Ultimately, the courts rejected James' insanity defense but did not sentence him to death. Instead the jury sentenced James to twelve life sentences plus seventy years. Those who disagree with James' insanity defense tend to cite his rather meticulous planning of the shooting and also rigging his apartment with numerous boobytrap explosive devices; which would indicate that James was not insane and knew his actions were wrong. Those who agree that James has a history of mental health issues will cite the numerous therapy sessions with his psychiatrist Dr. Lynne Fenton.

Don't hate her because she's beautiful. You obviously don't know being a psychopath isn't a choice. It's a condition related to genetic makeup and upbringing. Also, Jodi has never been diagnosed as a psychopath except by uneducated haters without medical degrees. If you're trying to make friends by hating Jodi, you're probably succeeding. I'm grateful that the Arizona Court of Appeals and the Arizona Supreme Court declined to hear Jodi's appeal because it would have worsened the emotional distress of Travis' family. If Jodi's conviction had been overturned and she was set free; she would be opening herself up to civil litigation by Travis' family and would have to pay the cost of Travis' funeral expenses as they had to be the ones that picked out a casket and flowers as well as set a date for the memorial service.

The missing point here I dare to say, is that Martínez was most likely attempting to make it visible for everyone how Arias was a massive manipulator. For that, he needed a certain amount of toughness. Otherwise, she could have manipulated the whole jury as well. Maybe.

!. Martinez withheld evidence. He said there was no emails, text messages. Nurmi had to sue him to get them. Found out there were 896 pages of text messages (See Trial Day 6) 2. Seduced a trial blogger and manipulated her to "find dirt" on Juror #17 , the only juror in the sentencing trial who wouldn't vote for the death penalty. Martinez hoped the blogger could find something so Juror #17 could be kicked off jury and replaced by someone who would vote to kill Jodi. 3. Made contact with Juror #3 who had been kicked off jury and used her to find out how jurors were "leaning" toward executing Jodi. 4. He also leaked information on Juror #17 when the hung jury prompted a mistrial in death-penalty phase. Juror #17 received death threats and had to have police protection.

The defense attorney could have made her appeal simple. make - briefly - a reasonable point of law argument and sat down. Not obviously attacking the prosecutors behavior which was in and of itself a dead give away of how desperate she was. A certain loss. She could have met the letter of the law without embaressing herself futher and completely destroying what was left of her career. It wasn't required to come up with multiple childish, not thought out , foolish to the point she had to be aware how much of a fool she was making of herself arguments. The law doesn't require multiple appeal points. One would have satisfied the law. Make the appeal, accept the judges decision and sit down. End of story. Couldn't be accused of not representing her client completely, legally. if you want an example... Watch the appeal of the obviously tired, knew he was beaten before the trial begain because his client had confessed, sad, embaressed attorney of that nutjob Anthony Toldt. that attorney leagelly represented his murderous client without destroying his career. At any time she could/should have stopped digging that hole. At any point she had met her legal duty of making an appeal for her client. There is Nothing in our laws which requires an attorney bury her career any more than she already had. To continue arguing nonsense was appalling and jaw dropping to watch. Martinez got Detective Flores and Dr. Horn to change their testimony to the gun shot came last after they had been saying the gun shot was first for more than 3 years. Martinez had to have the gun shot last so it would appear Alexander was alert & conscious during his killing. That way Martinez could bring an "excessive cruely" factor into play and get the possibility of a death penalty. Martinez told the jury Jodi stole her grandfather's gun when there was no proof she did and he entered "hearsay evidence" by having a cop testify about the stolen gun instead of having the grandfather testify about the gun. Police stated there had been a bunch of gun thefts in the area around that time. But, you can support a crooked prosecutor and make jokes. It's only a woman's life and future on the line.

Detective said on the witness stand it was his misunderstanding of Dr Horns reporting. It happens, an honest mistake. Before Jodi stabbed Travis, he never left the shower stall.He was sitting down at 5:30:30 PM in the shower stall when Jodi stabbed him in the heart. Travis was able to get himself over to the sink and cough up blood while she continued to stab him. Are you saying she stabbed him in the chest and shot him in the head while he was sitting in the shower stall? The evidence do not support that. If this is true, Travis would not be able to walk to the sink that alone stand at the sink with such a head injury. You are not presenting the facts. The evidence prove that the gunshot was last. For one the shell casing landed on blood, not covered with blood. If he was shot first the shell casing would not land on blood but on a clean floor. Any blood thereafter would cover it Let’s consider the incident of the stolen DVD player. Jodi gave the stolen DVD PLAYER to Darryl and drove off with the remote control still in her car. She was in possession of the stolen DVD in order to give it to Darryl. You get it? Think. How did she come into possession of the stolen DVD. One way, she stole it or had an accomplice steal it for her. Use common sense and logic if you have any. Juan asked her about it being in her car and how it got there. Epic moment watching Jodi try to explain this boo boo. She was almost lost for words but manage to give a lame excuse. Juan busted her. She tried to wiggle out of it. It was an EPIC bust. It was crystal clear to the jury that Jodi is guilty of stealing both grandpa’s gun and DVD Player. Probability 100% Jodi used her grandfather’s gun to put a bullet in Travis head. The shell casing at the crime scene matched the ammo at Jodi’s grandfather’s home. Busted again. Another fact, she told Detective Flores on June 9, 2008 that Travis did not own a gun. Then years later, after she was arrested, Jodi changes her story and now say that Travis did own a gun. Really? Why did she lie the first time saying that Travis DID NOT OWN A GUN. I suppose at the time, 2008, Jodi did not know that she was going to be arrested for Travis’ murder, henceforth, would need a plea. Later, like 2 years later, she pleads Self Defense. Now Travis owns a gun as needed for her self defense to work. It’s nothing but lies only to prove it was not premeditated murder.

Travis standing at the sink and being stabbed 9 times in the back and not trying to get away from the knife was one of Martinez's most dopey lies. No one would stand there and allow themselves to be stabbed 9 times. It's crazy. He'd have to be shot in the head to act that way. I don't know where he was stabbed or shot. No one does. The judge before Stephens read a report saying the stab in the chest was second to last and the throat cut last. "Jodi incriminated herself when she gave the stolen DVD PLAYER to Darryl and drove off with the remote control still in her car." That's not true. The DVD player would link her to the break-in and theft of the .25 caliber gun.. No one knows who stole the gf''s gun. Jodi was never charged. The .25 caliber shell casing was the same caliber of gun. But, the gun at the gf's home had steel jacketed, hollow-point bullets in it, different from the bullet in Travis's cheek. The only reason Jodi might have told Flores that Travis didn't own a gun was to protect his memory/reputation. After all, it was a tiny, little, girly (no offense) gun while his friends were going to the shooting range with AK-15's.

Martinez was not just aggressive with Arias but simply unprofessional....the courts and the attorneys should be NON-emotional. There may be MANY emotional aspects of a case, but people who are working in the court system SHOULD behave according to the law and not emotionally. When Martinez questioned the man who Arias went to see after she killed Alexander, his tone was so gentle, almost fake, and the man had a terrible or faulty memory. Listen to the unending attacks Martinez made towards Arias about her memory. And do a little research on Martinez being DISBARRED, and why. Did he just engage in misconduct during the Arias trial? Doubtful. There is NO justification for killing Alexander, but he was no angel in his treatment of Arias and probably other women. Check out the book, Women Who Kill. Women who kill are treated VERY differently from men who kill. They are demonized in this way that has NOT changed for hundreds if not thousands of years or whenever the earliest court systems have been used in human societies.

We don't know exactly what happened that precipitated Jodi to kill Travis, so no the death penalty is not appropriate in this case, if it ever is appropriate for the State to kill its citizens.

Had to burst out laughing as soon as she said the first sentence. Aawww poor Jodi, they were mean to her. Also, her attorney has such a shaky nervous voice that made me feel insecure and uncomfortable just listening to it.. Throw away the key I say

Martinez committed MISCONDUCT 1. Martinez withheld evidence. He said there was no emails, text messages. Nurmi had to sue him to get them. He found out there were 896 pages of text messages (See Trial Day 6) 2.Martinez seduced a trial blogger and manipulated her to "find dirt" on Juror #17 , the only juror in the sentencing trial who wouldn't vote for the death penalty. Martinez hoped the blogger could find something so Juror #17 could be kicked off jury and replaced by someone who would vote to kill Jodi. 3. Martinez made contact with Juror #3, who had been kicked off jury, and used her to find out how jurors were "leaning" toward executing Jodi. He also told her he was a "breast man" so she sent him photos of her breasts. 4. Martinez also leaked information on Juror #17 when the hung jury prompted a mistrial in death-penalty phase. Juror #17 received death threats and had to have police protection.

In that case, what about this specific case and this specific case alone made you displeased with the reached verdict and Martinez's behavior? I admit, yes, Martinez was forceful and blunt during the trial but certainly nothing I'd call "misconduct" and "abusive" as I've been hearing. Professional, yet strict, I'd call it. Additionally, the court adequately proved Arias' guilt in the trial. Hearing portions of the proceedings and reading the case at large, there was no way it was "self-defense" as she claimed. I mean, really? Stabbed several times, shot in the head, throat slit, and then body left to rot at the crime scene until found days later? Too many things that paved the way to her guilt. But, who knows? I may be missing something. So, I repeat: What about this specific case and this specific case alone made you displeased with the reached verdict and Martinez's behavior?

Arias was unquestionably guilty of a heinous crime, but these appeals processes are vital. Fair trial by a jury of one's peers is a cornerstone of a civilised society, and reviewing cases in this way can help to keep the process fair.

I think that sometimes it ok to do a review after maybe 20 years and do a retrial. Maybe this was a 2:d degree and she covered her tracks afterwards. Sometimes people deserve a 2:d chanse if a psychiatrist can say that the individual is no longer a threat to society.

I watched the trial every day and Juan Martinez was amazing. If he wasn't as strong as he was, Jodi would have gotten away with Murder. He was a FANTASTIC LAWYER FOR Travis Alexander's family and this appeal is really ridiculous and Jodis way of again, trying to get away with murder.

Even if he didn't give out specifics, would speaking about her character or lack there of be violating attorney client privilege? I would guess yes. This just made me think if she wanted to appeal why didn't she do it on the basis of infective council (is that what they call it) ? Or has she already tried that route? Well everything happens for a reason I'm glad he is healthy and happy. He was a public defender wasn't he? I should remember I was born and raised here in Phoenix and followed the case very closely. I suppose thats what happens when going through your own life's drama and trauma. Your brain basically removes useless information to make room for important life changing lessons. 😊
